(c) Volume I:

A. Tab A: Executive Summary B. Tab B: Contract Documentation – SIR Sections A – K; Business Declaration Completion of documents specified below indicates that the Offeror has read and agrees to the terms and conditions contained in the SIR/RFO. The FAA may consider offers that take exception to the terms and conditions of the SIR/RFO to be unacceptable and thereby ineligible for award. Offerors submitting such offers may not be given the opportunity to revise their offer.

(1) Section B, Supplies or Services and Prices/Costs; Government format.

(2) Section K, Representations and Certifications

(3) Business Declaration (Section J, Attachment 12)

(d) Volume II, Tab A: Evaluation Factor 1 – Relevant Past Performance Information

The documentation provided by the Offeror relative to past performance and experience should evidence the distinction between past performance— “how well” the Offeror has performed, and experience—the Offeror has “done it” before.

Past Performance Information Form (Attachment 8): The Government will evaluate the quality of the Offeror’s past performance. Past Performance Information shall demonstrate the experience of the offeror and/or proposed team, including sub-contractors, on projects same/similar to that described in the Statement of Work.

To assist the Source Evaluation Team in evaluating the offeror’s past performance, the Offeror shall complete a minimum of five (3), but no more than eight (5), “Past Performance Information” forms, (Section J, Attachment

8) in response to this factor. All blocks must be filled in and all data should be accurate, current, and complete.

For each contract the offeror must provide accurate, current, and complete information that meet the following relevancy and recency requirements:

(1) Contracts are similar to the size and complexity of the FAA requirement

(2) At least three (2) contracts valued at over $500,000

(3) Projects submitted have been completed or underway within the last two (2) years.

Offerors should include information on problems encountered with contract(s) and corrective actions taken to resolve those problems. General performance information will be obtained from references listed and possible other sources for each contract identified.

If any of the information required is not included in the form then the Offeror’s proposal may be deemed non-responsive and significantly deficient and may not be considered.

Past Performance Surveys (Attachment 9): Offeror is required to provide corresponding Past Performance Surveys (Section J, Attachment 9), to the projects provided on the Past Performance Information forms; along with Client Authorization Letters (format at Section J, Attachment 10) to customers/contractors who are familiar with the work ethic, standards, performance, and deliverables demonstrated for those submitted projects.

A copy of all Past Performance Surveys issued to Offerors’ customers shall be included in Volume II, Tab A.4 of the technical proposal.

Past Performance Surveys completed by the offeror’s customers must be submitted directly to the Contract

Offerors are cautioned to propose pricing for Project #2012-018539 CAI Replace AHU2-5 in the format provided as omission of any required pricing information constitutes incomplete pricing and therefore, unreasonable pricing.

L.12 Proposal Information

(a) The FAA reserves the right to consider as acceptable only those proposals submitted in accordance with the requirements set forth in the SIR which demonstrate an understanding of the complexity and scope of the requirements.

(b) The FAA further reserves the right to reject, as unacceptable, proposals deleting or altering technical requirements.

(b) Page Size and Format A page is defined as each face of a sheet of paper containing information. When both sides of a sheet display printed material, it shall be counted as two pages. Page size shall be 8.5 x 11 inches, not including foldouts.

Except for the reproduced sections of the solicitation document, the text size shall be no less than Times New Roman 12 font. The Past Performance Surveys shall be submitted as attached and shall not be reformatted or re-constructed. These limitations shall apply to both electronic and hard copy proposals.

(c) Electronic Offers Electronic copies may NOT be submitted via email. The electronic copies of the proposal shall be submitted via CD/DVD-ROM or USB Flash Drive with no .zip files included. Proposals should be in a format readable by Microsoft (MS) Word 2007, MS Excel 2007, MS Project 2007, and MS Power Point 2007 as applicable.

(d) Distribution The proposal shall be clearly identified. Proposals shall be addressed to the Contract Specialist and mailed or hand-delivered to the address shown in Section A of the model contract/solicitation (Block 8 of SF1442). The offeror shall ensure the time and date specified for receipt, the solicitation number, and the name and address of the offeror are clearly marked on the outer packaging of the proposal.

(e) Disposition of Unsuccessful Proposals Proposals from unsuccessful Offerors will not be returned. Original proposals will be retained in the contract file. All other copies will be destroyed by the Contracting Officer.

(f) Relationship Between Sections L and M Your attention is directed to the functional relationship between Sections L and M of this SIR. Section L provides information for the purpose of organizing the proposal and is not intended to be all-inclusive. Section M describes evaluation factors for award. Since the Government evaluation of proposals will cover all areas identified in Section M, proposals should address all such areas for evaluation.

L.16 PREVENTION OF OTHER FORMS OF HARASSMENT (MAY 2002) CLA.4551

(a) 'Harassment', as used in this clause, means any verbal, written, graphic, or physical form of harassment or other misconduct that creates or that may reasonably be expected to create an intimidating, hostile, or offensive work environment based on race, color, religion, gender, sexual orientation, national origin, age, or disability.

(b) It is FAA policy that harassment as defined in paragraph (a) above will not be tolerated or condoned in the FAA workplace. It is also FAA's intent to effectively address inappropriate conduct.

(c) The Contractor agrees to support this policy in performing work under this contract, and that harassment in any form will not be tolerated in the FAA workplace.

(d) If the Contractor, or a subcontractor of any tier, subcontracts any portion of the work under this contract, each such subcontract shall include this provision.

(e) The Contractor shall take whatever corrective action it deems necessary to promptly address harassment in the FAA workplace, or on an FAA site. The Contractor agrees to immediately provide the Contracting Officer all relevant information pertaining to any such conduct, and notify him/her of its planned action.

(f) The Contracting Officer may require the Contractor to remove employee(s) from the FAA worksite that the Contracting Officer deems to have engaged in harassment as defined in paragraph (a) above.

M.10 TECHNICAL EVALUATION CRITERIA

Evaluation factors as listed below are intended to determine the offeror's capabilities to effectively and efficiently accomplish the performance of the contract.

Factor 1. – Past Performance Information

Evaluation Criteria: When evaluating an offeror's past performance and experience, a distinction is made between past performance and experience. Past performance represents "how well" an offeror accomplished the effort. Experience simply means an offeror has "done it." Of additional importance is that past performance and experience must be current and relevant as well as comparable in scope and magnitude.

Past Performance Information: The offeror must submit a minimum of three (3) but no more than five (5) Past Performance Information forms to the Contract Specialist by the date specified on the form.

Past Performance Information must meet the following requirements:

(1) Contracts are similar to the size and complexity of the FAA requirement.

(2) At least two (2) contracts valued at over $500,000.

(3) Projects submitted have been completed or underway within the last two (2) years.

Current past performance and experience shall be understood to mean within the previous two (2) years. While the Past Performance Survey (Attachment 9 to the SIR,) completed by government and industry recipients of the offeror's services, is a significant means of gathering information on both past performance and experience, it is not necessarily accepted at face value. Individual biases or differences in interpretation and application of the rating scale; i.e., 0 to 4, may occur. Accordingly, a simple roll up of the scores received through completed surveys will not likely provide a complete picture of an offeror's past performance and experience. Additional information and follow-up may be required.

Key to an effective evaluation will involve an initial determination of relevancy. A relevancy determination of an offeror's current/past performance and experience will include, as applicable, the extent of its subcontractor(s)/ teaming partner(s). The following criteria will assist the TET's determination of relevancy.

Very Relevant: Involved the magnitude of effort and complexities that are essentially what the SIR requires and are currently ongoing or were completed within the last two (2) years.

Relevant: Involved less magnitude of effort and complexities, including most of what this SIR requires and were completed within last two (2) years.

Semi-Relevant: Involved much less magnitude of effort and complexities, including some of what this SIR requires and were completed within the last two (2) years.

Not Relevant: Did not involve any aspects of above.
