This is a Drug-Free Workplace Certification Form related to a classroom and office supplies procurement bid issued by the School Board of Polk County, Florida (Bid 029-RW-0126). The certification applies to Florida Statute 287.087 requirements and outlines the conditions under which bidders can receive preference in the award process. The six-month contract for classroom and office supplies runs from February 1, 2026, through July 31, 2026, with sealed bids due electronically through VendorLink by 3:00 PM on January 8, 2026. The bid award recommendation is anticipated on January 15, 2026, with Superintendent approval targeted for January 20, 2026. The procurement encompasses a comprehensive range of supplies including binders, index cards, clipboards, file folders, pencils, post-it notes, staplers, chart tablets, and transparent tape, with estimated quantities ranging from 105 to 12,535 units depending on the specific item. All supplies are to be delivered to the School Board's warehouse in Bartow, Florida.
To qualify for drug-free workplace preference, bidders must implement and certify compliance with six specific requirements: publishing a workplace drug prohibition statement, informing employees of drug abuse dangers and company policies, distributing the statement to relevant employees, requiring employee notification of drug-related convictions within five days, imposing sanctions or requiring participation in rehabilitation programs for violations, and maintaining good faith efforts to sustain a drug-free workplace. Vendors must complete the certification form with an authorized signature and printed name. Pricing must remain firm for the entire contract duration and include freight and handling charges, with the anticipated total bid value approximately $88,000 based on historical data. Additional compliance requirements include submission of an Affidavit Regarding Foreign Countries of Concern and E-Verify employment eligibility verification. Out-of-state bidders must submit a legal opinion regarding state bidding preferences. The School Board reserves the right to purchase additional quantities during the contract period, delete items, and adjust pricing after 90 days if marketplace volatility meets specified criteria.

Drug-Free Workplace Certification Form
In accordance with Florida Statute 287.087, preference shall be given to businesses with drug free workplace programs. Whenever two or more bids which are equal with respect to price, quality, and service are received by the State or by any political subdivision for the procurement of commodities or contractual services, a bid received from a business that certifies that it has implemented a drug-free workplace program shall be given preference in the award process.
Established procedures for processing tie bids will be followed if none of the tied vendors have a drug-free workplace program. In order to have a drug-free program, a business shall:
1) Publish a statement notifying employees that the unlawful manufacture, distribution, dispensing, possession, or use of a controlled substance is prohibited in the workplace and specifying the actions that will be taken against employees for violations of such prohibition.
2) Inform employees about the dangers of drug abuse in the workplace, the business’s policy of maintaining a drug-free workplace, any available drug counseling, rehabilitation, and employee assistance programs, and the penalties that may be imposed upon employees for drug abuse violations.
3) Give each employee engaged in providing the commodities or contractual services that are under bid a copy of the statement specified in subsection (1).
4) In the statement specified in subsection (1), notify the employees that, as a condition of working on the commodities or contractual services that are under bid, the employee will abide by the terms of the statement and will notify the employer of any conviction of, or plea of guilty or nolo contendere to, any violation of chapter 893 or of any controlled substance law of the United States or any state, for a violation occurring in the workplace no later than five (5) days after such conviction.
5) Impose a sanction on, or require the satisfactory participation in a drug abuse assistance or rehabilitation program if such is available in the employee’s community, by any employee who is so convicted.
6) Make a good faith effort to continue to maintain a drug-free workplace through implementation of this section.
As the person authorized to sign the statement, I certify that this firm complies fully with the above requirements.
