6. PROPOSAL EVALUATION AND BASIS FOR MATOC AWARD
6.1. This acquisition will utilize the Best Value source selection procedures using Technical, Past Performance, and Price to make an award decision.
6.2. The Government anticipates awarding a series of Multiple Award Task Order Contracts as a result of this Request for Proposal (RFP), based upon the results of a complete and thorough Government evaluation of proposals in accordance with this section. Contract award will be made to those "responsible" Offerors whose proposals are determined to represent the Best Value, and are Technically Acceptable to the Government based on the Volumes/Factors and Subfactors set forth herein. (See FAR Subpart 9.104, which describes the standards that prospective contractors must meet to be determined “responsible”.) To receive consideration for award, overall evaluations of not less than "Acceptable" must be achieved for Volume I and Volume II. An evaluation rating of "Unacceptable" at the Subfactor level will cause the entire Proposal Volume/Factor and the entire Proposal to be evaluated as "Unacceptable. NOTE: THE GOVERNMENT RESERVES THE RIGHT TO AWARD ANY
RESULTANT CONTRACTS BASED UPON INITIAL SUBMISSIONS, WITHOUT EXCHANGES AND/OR
DISCUSSIONS. ALSO NOTE THAT FAILURE TO SUBMIT A TIMELY PROPOSAL IN EXACTLY THE
MANNER REQUIRED BY THE SOLICITATION MAY RESULT IN THE GOVERNMENT REJECTING THE
PROPOSAL AS NON-COMPLIANT/UNACCEPTABLE, AT THE SOLE DISCRETION OF THE
CONTRACTING OFFICER.
6.3. The Government intends to evaluate proposals and award any resultant contracts without discussions with Offerors (discussions are defined at FAR Subpart 15.306(d)). Therefore, the Offeror's initial proposal should contain the Offeror's best overall terms. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In accordance with FAR Subpart 15.306(a)(2), if award will be made without conducting discussions, Offerors shall be given the opportunity to clarify certain aspects of their proposals, e.g., the relevance of an Offeror's Past Performance information and adverse Past Performance information to which the Offeror has not previously had an opportunity to respond, or to resolve minor clerical errors.
6.4. The source selection process will be conducted in accordance with FAR Subpart 15.3, Source Selection.
Proposals will be evaluated using the criteria listed in Evaluation Factors and Basis for Award.
6.5. The Contracting Officer will conduct a proposal compliance review after RFP closing for determination of basic proposal responsiveness prior to providing the proposals to the evaluation board.
6.6. In order to effectively and equitably evaluate proposals, the Contracting Officer must receive information containing sufficient detail to allow review and evaluation by the Government. Proposal clarity, organization, and cross-referencing are mandatory. Failure to submit an organized proposal may adversely affect an Offeror’s evaluation. Offerors should provide sufficient detail and clearly define all items required in this section. The Contracting Officer may remove any Offeror from further consideration during any phase of the procurement if the Offeror fails to meet the submittal requirements of the RFP. Noncompliance with the RFP requirements raise serious questions regarding an Offeror’s understanding technical requirements and/or cost and are grounds to eliminate the proposal from consideration for contract award. Failure to include all information requested may adversely affect the evaluation. A proposal that merely reiterates or promises to accomplish the requirements of the RFP will be considered unacceptable. A proposal that is not presented in an orderly format may be considered noncompliant with solicitation instructions will not be evaluated and will be removed from consideration for award.
A proposal that is orderly and sufficiently documented will be easy for the Government to understand and will enable the Government to perform a thorough and fair evaluation.
6.7. The Government reserves the right to reject any or all proposals at any time prior to award if such action is in the Government's best interest or considered nonresponsive; negotiate with any or all Offerors after the competitive range is determined; award a contract to offerors submitting other than the lowest price(s); and award contracts to offerors submitting a proposal determined by the Government to be the most advantageous to the Government.
7. FACTOR 1 - TECHNICAL PROPOSAL EVALUATION
7.1. Subfactor 1 - Demonstration of Successful Adherence to Project Milestones: The Offeror shall demonstrate successful completion of critical path milestones under a prior effort of their choosing (private sector or Government), showing their capability to perform contract requirements within a stated period of performance;
specifically, detailing manpower and working-hour management throughout the period of performance, any milestone actions that were performed to meet the schedule, and addressing all lead times and sequencing of major disciplines/operations throughout the contract.
7.2. Subfactor 2 - Demonstration of Successful Communication with Government Project Teams: The Offeror shall demonstrate their ability to provide clear and pro-active communication with the government project team (COR, KO, and the user of the space) throughout the project period of performance. This section seeks to evaluate the offeror’s capability to provide prompt responses to Government requests, pre-emptive identification of any potential scheduling or other contractual issues, and identification of steps that will be taken to remediate these issues so that the project schedule does not slip. There is no particular submission format associated with this subfactor.
7.3. Subfactor 3 - Demonstration of Design and Shop Drawing Preparation Capabilities: The Offeror shall demonstrate their ability to design and prepare shop drawings for projects of varying scope and specialties, especially with regard to the following: architectural, electrical & data, and mechanical. There is no specific submission format associated with this subfactor.
7.4. Subfactor 4 - Demonstration of Successful Completion of Multiple-Phase Construction Efforts: The Offeror shall demonstrate their successful completion of a multiple-phase construction effort of their choosing (private sector of Government), with significant emphasis being placed on the offeror’s successful demonstration of their ability to multi-task in an inter-disciplinary environment, while still meeting all milestone and contractual requirements. There is no specific submission format associated with this subfactor.
8. FACTOR 2 - PAST PERFORMANCE
8.1. The Government will evaluate the relevancy to this construction contract of the Past Performance information provided by the Offeror, Past Performance Evaluation Questionnaires received, and information obtained from the SPM.
8.2. The Government will assign one rating for each Offeror based on a relevancy and confidence assessment.
Offerors with no past performance information will be given a rating of Acceptable. Offerors will be provided an opportunity to address any negative past performance information about which the Offeror has not previously had an opportunity to respond.
8.3. The Government’s confidence assessment will be based on the elements listed below:
8.3.1. Quality of Construction. Based on all information available, the Government will assess the quality of the actual construction undertaken and the standards of workmanship exhibited by the Offeror.
8.3.2. Timeliness of Performance. The Government will evaluate all information available with respect to the Offeror completing past projects within the scheduled completion times.
8.3.3. Customer Satisfaction. The Government will evaluate all information available with respect to the Offeror’s past customer satisfaction, cooperation with customers, and interaction on past projects. SPM evaluations and Past Performance Evaluation Questionnaires received will be evaluated.
8.3.4. Subcontractor Management. The Government will evaluate all information available with respect to the Offeror’s management of subcontractors, including mitigation of conflicts and resolution of disputes at the lowest level.
8.3.5. Documentation. The Government will evaluate all information available with respect to the Offeror’s level of meeting customer satisfaction on timeliness and quality of the documentation, reports, and other written materials completed by the Offeror on past projects.
8.3.6. Safety Record. All information available with respect to the Offeror’s safety record, to include SPM rating and OSHA Form 300 or 300a for safety, lost time incident rate, safety incentive program, safety awards, and other indications of improvements in safety will be taken into consideration in evaluating the Offeror’s overall safety record.
9. FACTOR 3 – SEED PROJECT PRICING
9.1. Pricing for the Seed Project will be evaluated using the price proposal submitted on the Bid Schedule at Attachment 2. The Government will evaluate total price in accordance with FAR Subpart 15.305(a)(1), and by using one or more price analysis techniques identified in FAR Subpart 15.404-1 to ensure that prices are fair and reasonable. Note that adequate price competition alone may not establish reasonableness.
9.2. If it is concluded that additional information is necessary to determine the reasonableness of the proposed price, the Contracting Officer may request information to determine the reasonableness of the Offeror’s price. This additional information may include, but is not limited to, indirect rates, material, labor and any other information that can substantiate the reasonableness of a proposed price. If applicable, a Certificate of Current Cost and Price will be requested at time of award.
10. EVALUATION PROCESS.
The technical panel will provide a detailed evaluation and assign a technical rating for the Technical Volume and a performance confidence rating for the Past Performance Volume. Pricing will be evaluated by the Contracting Officer in accordance with Section 9.0 of this solicitation.
The technical panel will rate each Factor and Subfactor by consensus for each proposal submitted and will prepare initial and final reports. Offerors are advised that the Government intends to award without discussions but reserves the right to conduct discussions at the sole discretion of the Contracting Officer, to identify significant, deficiencies, and other aspects of the Offeror’s proposal which, if addressed, may improve the proposal’s chances of award. The Government technical evaluation panel will evaluate proposals in accordance with the process and evaluation criteria stated herein, and will document the evaluation by providing a narrative discussion of the evaluation of each proposal in terms of the evaluation criteria and proposed strengths, weaknesses, and deficiencies. This narrative discussion shall be incorporated into a report, which will be presented to the Contracting Officer to assist in the competitive range determination, if needed. Upon establishment of the competitive range, and to the extent deemed necessary at the sole discretion of the Contracting Officer, written discussion items (DI) will be issued to remaining Offerors, using control numbers, to further investigate any weaknesses, deficiencies, or other subjects identified by the technical panel as germane to the evaluation process. These DIs are considered exchanges/discussions in accordance with FAR Subpart 15.306(d). The Contracting Officer may also issue DIs relating to any matter that requires written revisions to a proposal for which a binding agreement is required/desired. The technical panel will be responsible for briefing the Contracting Officer at all steps of the evaluation process. The technical panel shall provide its report to the Contracting Officer for a final briefing, if necessary.

11. RATING METHODS/DEFINITIONS
11.1. TECHNICAL FACTOR: One of the following ratings will be assigned:
TECHNICAL RATINGS
Rating Definition Acceptable Proposal meets requirements of the solicitation.
Unacceptable Proposal does not meet requirements of the solicitation.
11.2. QUALITY/PERFORMANCE CONFIDENCE ASSESSMENT: Assess the quality of the Offeror's past performance on those recent efforts that were determined relevant by determining how well the contractor performed on the contracts. Documented results from Performance Risk Assessment Questionnaires, interviews, PPIRS, and other sources form the support and basis for this assessment. Once the Relevancy and Contract Performance of the past performance contracts has been established, the Offeror will be assigned one Performance Confidence Assessment for the Past Performance Volume as described by the table below:
PAST PERFORMANCE RELEVANCY RATINGS
Rating Definition Very Relevant Present/past performance effort involved essentially the same magnitude of effort and complexities this solicitation requires.
Relevant Present/past performance effort involved much of the magnitude of effort and complexities this solicitation requires.
Somewhat Relevant Present/past performance effort involved some of the magnitude of effort and complexities this solicitation requires.
Not Relevant Present/past performance effort did not involve any of the magnitude of effort and complexities this solicitation requires.
PAST PERFORMANCE RATINGS
Rating Description Acceptable Based on the Offeror's recent/relevant performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown. (See note below.)
Unacceptable Based on the Offeror's recent/relevant performance record, the Government has no reasonable expectation that the Offeror will be able to successfully perform the required effort.
Note: In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a) (2) (iv)).
Therefore, the Offeror shall be determined to have unknown (or "neutral") past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable”.
11.3. PRICE FACTOR: Price proposals submitted for the seed project will not be given an adjectival rating, but will be evaluated to determine reasonableness.
11.4. A written notice of award or acceptance of an offer, mailed or otherwise, furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
11.5 Davis-Bacon Wage Determination no. MA20240001, Rev. 15, is applicable to this Contract and is incorporated at Attachment #5.
