About this file

This document is a Draft Attachment 3 detailing Warranty Terms and Conditions for a Coast Guard Next Generation Surface Search Radar (NXSSR) procurement. The warranty requirements mandate that contractors provide a comprehensive commercial hardware warranty of at least 24 months after equipment installation on Coast Guard assets, with an objective (preferred) warranty period of 36 months. The warranty terms are not dependent on installation by the Original Equipment Manufacturer (OEM) and must include a product return policy, with any OEM warranties to be directly available to the Coast Guard.

The warranty terms will be incorporated into the final contract, with contractors required to clearly articulate their proposed warranty period and conditions in the technical proposal's "Warranty Terms and Conditions Section". This draft attachment is part of a pre-solicitation document for replacing multiple existing Surface Search Radar systems currently in use across 13 cutter platforms and 113 Vessel Traffic Service (VTS) remote sites, which includes AN/SPS-50, AN/SPS-78, AN/SPS-79, AN/SPS-73, and Terma Scanter 2001 radar systems.

DRAFT ATTACHMENT 3

WARRANTY TERMS AND CONDITIONS

1. The contractor must provide, at a minimum, a standard comprehensive commercial hardware warranty for a minimum of 24 months after installation of equipment on Coast Guard (CG) assets regardless of the date of purchase.

2. The warranty terms and conditions must not be affected by who installs the hardware (i.e. Original Equipment Manufacturer (OEM) installation will not be required).

3. Product warranty must include a product return policy. Any OEM warranty associated with products delivered under this contract/order must be available directly to the CG.

The contractor’s proposed warranty period and terms/conditions must be clearly articulated in the “Warranty Terms and Conditions Section” of their technical proposal. The awarded contractor’s warranty period and terms/conditions will be included within this attachment at time of contract award.

An “Objective” is a preferred/desired warranty period, term, and/or condition, but not a minimum requirement.

4. Objective: The contractor shall provide a comprehensive commercial warranty for a minimum of 36 months after installation of equipment on CG assets regardless of the date of purchase.

5. Product warranty must include a product return policy. Any OEM warranty associated with products delivered under this contract/order must be available directly to the CG.
