About this file

This is a certification form issued by the State of California Department of Pesticide Regulation regarding compliance with the Darfur Contracting Act under Public Contract Code Sections 10475-10481. The form applies to any company that has conducted business activities or operations outside the United States within the previous three years and seeks to bid on or submit proposals for State of California contracts. Companies without international business activities during this period are exempt from completion of this form. The document does not specify particular products, services, quantities, response dates, or contract terms, as it functions as a general compliance requirement rather than a specific solicitation document.

The form provides two compliance pathways for eligible bidders. Under Option 1, companies must certify under penalty of perjury that they are not "scrutinized companies" as defined by Public Contract Code Section 10476, and provide their company name, Federal ID Number, authorized signature, and execution location. Under Option 2, companies that are classified as scrutinized companies may still submit bids or proposals if they have obtained written permission from the Department of General Services, which may be granted on a case-by-case basis when deemed in the state's best interest. Bidders selecting Option 2 must provide the same identifying information along with evidence of DGS approval. No pricing terms, set-asides, incumbent information, or funding sources are addressed in this compliance document.
