About this file
This document is an Americans with Disabilities Act (ADA) provisions file applicable to contractors working with the Commonwealth of Pennsylvania. The provisions establish mandatory compliance requirements for all bidders, offerors, suppliers, and grantees furnishing goods, supplies, services, or construction work under Commonwealth purchase orders, contracts, or grants. The contractor must ensure that no individual with a disability is excluded from participation in the agreement or related activities based on their disability status. Compliance with federal regulations under 28 C.F.R. 35.101 et seq., specifically the "General Prohibitions Against Discrimination" outlined in 28 C.F.R. 35.130, and all applicable Title II regulations of the ADA is mandatory for all benefits, services, programs, and activities provided through Commonwealth contracts.
The contractor assumes full responsibility and agrees to indemnify and hold harmless the Commonwealth from all losses, damages, expenses, claims, demands, suits, and actions arising from the contractor's failure to comply with these ADA provisions. This document, dated October 14, 2011, serves as a standard contractual requirement and is incorporated as Enclosure 1 to Management Directive 215.12. Non-compliance creates direct financial and legal liability for the contractor with respect to disability discrimination claims.
