About this file
This is an Americans with Disabilities Act (ADA) compliance document issued by the Commonwealth of Pennsylvania on October 14, 2011, applicable to all contractors engaging in purchase orders, contracts, or grants with the state. The document establishes mandatory compliance requirements for any bidder, offeror, supplier, or grantee furnishing goods, supplies, services, construction, or other activities under state agreements. The provisions require contractors to comply with federal regulations under 28 C.F.R. 35.101 et seq., ensuring that no individual with a disability is excluded from participation in or services provided under the agreement. Contractors must specifically adhere to the "General Prohibitions Against Discrimination" outlined in 28 C.F.R. 35.130 and all applicable Title II regulations of the Americans with Disabilities Act relating to benefits, services, programs, and activities provided through Commonwealth contracts.
Contractors are required to indemnify and hold harmless the Commonwealth of Pennsylvania from all losses, damages, expenses, claims, demands, suits, and actions resulting from the contractor's failure to comply with ADA provisions. This indemnification clause places full responsibility and financial liability on the contractor for any violations or non-compliance with disability discrimination requirements. The document serves as a standard exhibit requirement for Commonwealth contracts and is incorporated into Management Directive 215.12, establishing it as a binding condition for all contractors seeking to do business with Pennsylvania, including those pursuing the Greene County Uniform Services contract for PennDOT Engineering District-12-2.
