This is a draft hardware queuing contract between the State of Colorado, acting through the Colorado Department of Revenue's Division of Motor Vehicles (DMV), and a contractor to be named. The contract calls for the contractor to provide kiosks and ancillary hardware for DMV operations. The work must be completed by May 31, 2015. The contract includes an initial term with a two-month extension option at the State's discretion if a replacement contract has not been executed, and further provides the State with options to extend maintenance and support services for two additional one-year periods at the same rates, with a maximum total contract duration of five years. Key personnel positions are identified in the contract, though specific names are not provided in this draft version.
Payment will be made upon project completion and acceptance by the State, with retainage of ten percent (10%) of each payment milestone if the timeline is extended; retainage is released upon final system acceptance. The maximum contract amount is to be determined from available funds and is specified in Exhibit B. The State shall pay invoices within 45 days, with uncontested amounts bearing interest at no more than one percent per month if unpaid beyond 45 days. The contractor must obtain and maintain a $2,000,000 performance bond, comprehensive insurance coverage including general liability, professional liability, cyber privacy liability, and automobile liability, each with minimum limits of $1,000,000. Liquidated damages are assessed at $300 per hour per Driver's License Office impacted by system outages caused by the contractor. The contract requires strict compliance with Colorado and federal law, including confidentiality and data security standards, background checks for employees with access to personally identifiable information, and adherence to the Colorado Cyber Security Program requirements.
