Contracting Officer’s Question

1. Under Section L.6.H., Proposal Format, Pages 77-78, the RFP states that the Business Management Proposal (BMP) is limited to 100 pages. Normally, the BMP is stated as not having a page limit. Is this an error and the BMP is intended to have an unlimited page restriction? If this is not an error, please clarify which BMP requirements will be included and excluded in the 100 page limit.

Answer – Yes this is an error and BMP Requirements will be unlimited pages.

2. Please confirm the cost incentive fees for center operation, OA and CTS should be as follows:

Minimum cost incentive = 3.0% Target cost incentive fee = 3.5% Maximum cost incentive fee = 4.0% Cost over/under run share ratio = 50% government/50% contractor The charts in Attachment J-1 reference an older fee structure

Answer – Yes, this information is correct.

3. Please confirm offerors should consider the new rule and guidance provided in Training and Employment Notice No. 36-15 issued May 23, 2016, announcing the publication of the Final Rule Defining and Delimiting the Exemptions for Executive, Administrative, Professional, Outside Sales and Computer Employees under the Fair Labor Standards Act. The Job Corps contract is proposed to start after the December 1, 2016, effective date of the rule.

Answer – Yes, the rule applies as the contract is schedule to begin after December 1, 2016.

4. Per Section L.6.H, the RFP states that the Past Performance and Business Management Proposal shall be separately bound from the Technical Approach, Staff Resources, and Relevant Experience. However, the requested copies ask for one original of Past Performance and four copies of BMP. Please clarify if the Past Performance should be bound with the Business Management or separately by itself.

Answer – Please bind the Past Performance and BMP Separately

5. Please provide a copy of the J-13 form

Answer – Attachment J-13 is no longer being provided in the solicitation. DOL has decided that the data was outdated and that it was not doing to re-create a new version. Offerors should use their own business judgment when proposing the salaries for employees.
