Questions Received in Response to RFP #DoDCC-2019-R-0001 – Retail Drug Store and Full-Service Pharmacy, The Pentagon dated June 13, 2019
The following questions and answers are incorporated in the RFP as set forth at length.
Q. Is the reason that DoDCC is going to RFP because the contract and its extensions are up for the Pentagon store with CVS or did they decline to renew their lease?
A. Please refer to Section A.1.h., page 4 of 55 of the RFP. The period of performance for CVS’ License Agreement with the DoDCC expires 2/29/20. As there are no additional option periods to be exercised, the DoDCC is soliciting the requirement with the intention of awarding a follow-on License Agreement to the successful offeror.
Q. Since the Pentagon resides both in the District of Columbia and the Commonwealth of Virginia, please advise which state license architects should use when submitting stamped plans as part of proposal submission.
A. Please have all plans submitted with offerors’ proposals stamped using a Virginia license.
Q. On page 49 of the RFP, we are asked to indicate whether or not have an Affirmative Action plan on file. Is it a requirement or does the DoDCC simply want to know the answer. Also, can you tell me if the successful offeror will be required to develop and/or have on file an affirmative action program as required by the rules and regulations of the Secretary of Labor?
A. Section K, “Representations and Certifications”, Item K.5., page 47 of 55 of the RFP, requires offerors to complete the Affirmative Action section of the RFP as part of proposal submission. Specific questions regarding your company’s requirements to develop and have on file an affirmative action plan should be directed to the Department of Labor.
Q. Regarding the timeframe from CVS moving out to a new management starting its business is under a month. This is practically impossible as the new ownership has to apply for state board license, DEA license and PBM contracts, which takes a couple of months at the very least. Is CVS willing to transfer its license and contracts to new ownership instead of surrendering?
A. The successful offeror (Licensee) will be required to discuss these issues with CVS after License Agreement award. As for the timeframe for opening of the follow-on retail drug store and full-service pharmacy by the successful offeror (Licensee) after License Agreement award, the timeframe necessary between time of the current Licensee’s end date of performance, February 29, 2020 and opening of the follow-on store will be as accepted by the DoDCC based on the successful offeror’s construction timeline/milestones as submitted in its proposal in response to Section L., “Proposal Submission Requirements”, Item (5), “Construction Timeline”, page 50 of 55 of the RFP.
Q. How many prescriptions does CVS fill on a daily basis?
A. The DoDCC does not have access to this information as it is proprietary to CVS.
Q. Would CVS take all the patient records/prescriptions with it, or would CVS transfer them to the new pharmacy ownership?
A. The successful offeror (Licensee) will be required to discuss these issues with CVS after License Agreement award.
Q. Please provide the following details around any additional pharmacies/locations where prescriptions can be filled on Pentagon property:
a. Who
b. Where
c. What are they filling that we can’t and vice versa
d. Gross sales A. The following responses to the questions above are provided:
a. The DiLorenzo Clinic is located in the Pentagon and fills prescriptions for its patients – active duty military and dependents.
b. The DiLorenzo Clinic is located in the Pentagon.
c. We are unable to provide any specific information pertaining to its patients’ prescriptions.
d. We are unable to provide any specific information pertaining to sales generated at either the DiLorezno clinic or the currently operating CVS pharmacy.
Q. How many individuals can attend a site visit? The bidder’s conference?
A. There are no specific limitations to a company’s number of people attending either a site visit or the preproposal conference. Regarding site visits, due to coordination of building access and to avoid disruption to the current CVS operation, the DoDCC would like to limit attendance to no more than four (4) people. Regarding the preproposal conference, there is no limit, but the DoDCC generally expects no more than four (4) or five (5) people to attend.
Q. Please provide clarity on submission expectations.
a. When the document refers to the RFP, does this refer to and must we include in our submission the entirety of pages 1 – 55 of #DoDCC-2019-R-0001?
b. In addition, must a separate document containing the Proposal Submission Requirements (pages 49 – 52, Items 1 – 16) be included.
c. Please confirm the number of copies required.
i. Page 1/5 states that two originals and 0 copies must be submitted.
ii. Page 49/55 states that two originals and (separately) two proposals containing the Proposal Submission requirements must be submitted.
1. Does this mean that there should be a total of six binders submitted (two originals, one set of Proposal Submission
Requirements spread over two binders and then a second set of Proposal Submission Requirements spread over two binders)?
iii. Page 53 of 55 once again states (Mb1) that we must submit two complete copies of the RFP document and any amendments.
iv. Can we submit two binders, each binder containing the following (with a table of contents and separated by tabs):
1. Full completed RFP (pages 1 – 55 of #DoDCC-2019-R-0001
2. Deviations to the full RFP (or redlines contained within Section
1, above)
3. Proposal Submission Requirements
4. Any addenda
5. Requested attachments/other such documentation
A. The following responses to the questions above are provided:
a. Please refer to Section L., “Proposal Submission Requirements”, second paragraph, page 49 of 55 of the RFP. Yes, the RFP consists of pages 1 – 55 of 55 and all attachments provided in hard copy format.
b. Please refer to Section L., “Proposal Submission Requirements”, second paragraph, page 49 of 55 of the RFP. In order to be considered for award, offerors shall submit two (2) complete and completed originals of the entire RFP and any issued Amendments (signed and dated) and two (2) proposals containing Items (1) through (16), pages 49 – 52 of 55.
c. As stated above, offerors are required to submit two (2) complete and completed originals of the entire RFP and any issued Amendments (signed and dated) and two (2) proposals containing Items (1) through (16), pages 49
– 52 of 55 of the RFP.
c.ii.1. Please refer to Section L., “Proposal Submission” requirements, pages 49 – 52 of 55 of the RFP. Offerors can submit two (2) complete proposals in two (2) binders that contain the complete and completed entire RFP and any issued Amendments (signed and dated) and the proposal submission requirements, identified in Items (1) through (16), pages 49 – 52 of 55 of the RFP.
c.iv.1-5. Offerors must provide all of the proposal submission requirements stated in pages 49 – 52 of 55 of the RFP. Any sections of the RFP that offerors’ proposals take exception with must be clearly stated as part of proposal submissions. There are clauses in the RFP that are required and cannot be modified or changed.
Q. Should exceptions to the document be provided as redlines within the document provided or as a separate list?
A. Please see answer above. Any sections of the RFP that offerors’ proposals take exception with must be clearly stated as part of proposal submissions. It is easier if offerors annotate proposed exceptions to the RFP as a separate list. As stated above, there are clauses in the RFP that are required and cannot be modified or changed.
Q. Where in relation to the retail pharmacy, is the storage room located?
A. The CVS store is located on the second floor and the storage room is located almost below the CVS store first level (ground floor).
Q. Is there a format (ex; CAD drawing) in which you expect to see the proposed design of the store?
A. Please refer to Section L., “Proposal Submission Requirements”, (3) Concept/Artist Rendition/Layout, pages 49 – 50 of 55 of the RFP. Offerors must provide a written detailed description of the proposed concept of operations and a sufficient number of artist renditions to convey the offeror’s store plans. If construction is being proposed, offerors must submit A&E drawings. Please refer to Section C.3.d., page 13 of 55 of the RFP for the definition of construction for purposes of this requirement.
Q. It is stated the new pharmacy is expected to be open in April 2020. It is our understanding that the exact date is negotiable based on expected construction timelines. Please confirm.
A. Yes.
Q. The RFP states the operator has the right to close the pharmacy on Saturdays. Can you provide an estimate on the number of prescriptions which are currently filled on Saturday?
A. The DoDCC does not have this information to provide to offerors.
Q. Regarding 3G, capturing internet sales, how is this requirement currently fulfilled?
Without a way to identify Pentagon purchasers, we have no way of knowing if a purchase is made by a Pentagon employee given our website is company-wide, not Pentagon specific.
A. The DoDCC is unable to provide the current operator’s process for capturing Internet sales. Offerors are to address company specific ability and processes to meet the requirement as set forth in Section L., “Proposal Submission Requirements”, (1) Offered Sales Commission, page 49 of 55 of the RFP.
Q. Item B2 requires that payments be made by the 10th. Please confirm if this is calendar days or business days.
A. Commission payments are due by the 10th day of the month (calendar).
Q. Is it possible to use the existing Verizon phone line, or must a new one be installed?
A. Please refer to Section B.4.b., “Utilities”, pages 9 – 10 of 55 of the RFP. The Licensee will be required to order its own telephone/DSL lines/T1 lines.
Q. Are there any typical retail pharmacy items we cannot sell? For example, liquor, photo, etc., or other items which are not mentioned as a list of items which can be sold.
A. Offerors should submit with the proposals all items/merchandise categories it proposes to sell in the Pentagon store. Until the lists submitted with proposals are evaluated, the DoDCC is unable to advise of specific items that are prohibited with the exception of all types of alcohol and items such as knives, pocketknives, etc. that are expressly prohibited. Please refer to Section C.2., “Scope of Work”, pages 11 – 12 of 55 for the current list of prohibited items currently sold by other DoDCC retail concessionaires. The list is subject to change at the DoDCC’s discretion.
Q. How much does/does not offering a medical clinic impact consideration of a bid?
A. Please refer to Section C.2., “Scope of Work”, pages 11 – 12 of 55 of the RFP.
Licensee may offer a small scale medical clinic. It is not required to be offered.
Q. Item C2 states the pharmacy must accept all medical plans. Please provide a list of plans we are expected to accept.
A. The Licensee is required to accept all insurance plans that it accepts at its other commercial establishments. Licensee should have the ability to accept civil service/military (active duty and retiree) medical plans in effect at any given time so that the Pentagon’s civilian, active duty military and dependents and military retirees and dependents may utilize the full-service pharmacy. Examples include but are not limited to: Tricare, Medicare, Aetna, United Concordia, Blue Cross, etc.
Q. Please provide a sample ICE survey so we may better understand the customer evaluation process. How are customer complaints reviewed and resolved?
A. Please refer to Section C.5.b., “Customer Complaints”, page 17 of 55 of the RFP. The Interactive Customer Evaluation (ICE) surveys are available on-line. ICE is located on the following website: http://ice.disa.mil, and the information will be found by clicking “OSD, Agencies & Activities – CONUS”, then clicking “Pentagon Virginia”, and then finally by clicking “Shopping & Services”. The DoDCC Contracting Officer, as well as the Licensee, is sent all ICE comments via email. The Licensee shall address all ICE comments and return them to the Contracting Officer within forty-eight (48) hours.
Q. What type of background checks does the Pentagon require for contracted service employees?
A. Please refer to Section C.6.b., “Employees”, pages 17 – 18 of 55 of the RFP. Tier 1 – National Agency Check with Inquiries (NACI) background investigation, or other similar reviews of Licensee employees may be required by the Department of Defense (DoD).
Typical investigations for Pentagon building access/badging is performed by the Pentagon Pass Office and is free of charge. The Pentagon Pass Office and the Pentagon Force Protection Agency (PFPA) reserve the right to deny, at their sole discretion, employees’ access to the Pentagon.
Q. Are charity promotions, such as Red Nose Day, allowed?
A. No. Please refer to Section C.16., “Solicitation of Charitable Funds”, page 23 of 55 of the RFP.
http://ice.disa.mil/
Q. Regarding the monthly sales and commission report – is this the only document that is expected to accompany our monthly commission checks? Is a more detailed monthly report required to support audit requirements?
A. Yes. The sample monthly sales and commission report was provided as an attachment in Section J., “Attachments”, Item 11., page 45 of 55, “Sample Monthly Sales Report”. No additional monthly reports are required to support audit requirements, however if offeror is selected for audit, then a detail list of reports and supporting documents will be requested.
Q. How much advance notice of an audit would be provided? Are these physical audits or book audits?
A. The DoDCC typically provides thirty (30) calendar days advance notice of audits.
Audits conducted are book audits.
Q. Wage Determination. We do not see certain positions listed which would be required to fulfill staffing of the store; ex. Pharmacist.
A. Please refer to Section H.11., “Service Contract Act”, pages 36 – 37 of 55 of the RFP.
The Service Contract Act covers non-exempt employees. All questions pertaining to applicability of and compliance with the Service Contract Act should be addressed to the Department of Labor at http://www.dol.gov.
Q. Please confirm the Pentagon wants a list of every item that will be stocked in the store with the standard selling price. How are promotional items, special packs, etc.
expected to be handled? Also, again to confirm, you want to see source or origin, material content, model number etc.? For a retail pharmacy, this will amount to millions of lines of data.
A. No, the DoDCC does not expect offerors to submit comprehensive lists of all of the products to be offered/sold in the Pentagon in proposal submissions. Rather, the DoDCC would like offerors to provide a breakdown of merchandise categories it intends to sell in the Pentagon retail drug store and full-service pharmacy and the associated range of prices. Offerors need to propose merchandise categories with associated price ranges for these items that meet the requirement set forth in Section C.7., “Merchandise and Products”, page 18 of 55 and Section H.12., “Price Warranty”, page 37 of 55 of the
RFP.
Q. When will answers to questions be provided? Will Q&As from each bidder be shared with all potential vendors?
A. Answers to all questions received between the date of issuance of the RFP and the preproposal conference are contained herein as an attachment to Amendment A001 to the RFP. Any additional questions will be addressed in future amendments to the RFP.
All offerors will be provided copies of all issued Amendments to the RFP that may contain additional information regarding the RFP and answers to questions submitted by all offerors.

A. The DoDCC does not have this information.
Q. Is there any inventory in place or will we have access to inventory, ex. counters, shelving, etc.?

A. Please refer to the Q&A above. The DiLorenzo Clinic may disburse prescription medication to those authorized to utilize it.
Q. Will we be allowed to place Auto script prescription units in other areas outside of the Mall but still inside the Pentagon?
A. The DoDCC cannot guarantee space will be available for these units. Offerors should submit details regarding these types of units (size, power needed, etc.) as part of their proposals to be evaluated accordingly.
Q. If a military Exchange is selected as a source, could we operate similar to our agreement for Military Clothing Sales since both of our entities are NAFIs?
A. The proposed operation must be adequately and clearly outlined in offerors proposals. The successful offeror (Licensee) must have the capability and ability to sell in its retail drug store and full-service pharmacy to all Pentagon patrons and collect and pay taxes. Please refer to Section B.3., page 9 of 55 of the RFP. The responsibility for Exchanges to garner legal/regulatory permission to sell to all Pentagon patrons rests solely on the Exchanges, and the details as to how this will be permitted and operate at the Pentagon should be detailed in proposals.

A. No. These types of sales are expressly prohibited within the Pentagon and on the Pentagon Reservation.

A. Please refer to Section C.2., “Scope of Work”, page 12 of 55 for a list of unauthorized items currently provided by existing DoDCC concessionaires in the Pentagon. The list is subject to change at the DoDCC’s discretion.
Q. Will an Exchange be permitted to sell to all Pentagon patrons under established DoDCC patron eligibility procedures?
A. The DoDCC has no restrictions on patron eligibility. Please refer to Section A.1.f., page 4 of 55 of the RFP.
Q. As a note and for the concurrence of DoDCC, an Exchange would plan to subcontract the Pharmacy portion of the business. An Exchange would only comply with the Service Contract Act in areas of business that are subcontracted with other than direct Exchange personnel.
A. Please refer to Section H.11., “Service Contract Act”, pages 36 – 37 of the RFP. The awarded License Agreement is subject to the requirements of the Service Contract Act.
Any questions regarding the extent of these obligations should be addressed to the Department of Labor.
Q. Is the term Pentagon Reservation equivalent to the definitions of isolated or overseas for patronage eligibility/authorization in accordance with AR 215-8 or DoDi 1330.21?
A. No.
Q. In the agreement, on page 38 para 1.f., are you seeking only franchisees of name brand pharmacies?

Q. Provide a list of all FAR or other mandatory clauses that must be included in any subcontract agreements awarded. Or, please clarify if FAR regulations apply or do not apply since DoDCC is a NAFI agency.
A. FAR regulations do not apply to DoDCC procurements. All clauses provided in the RFP that will become part of the awarded License Agreement would be required to be included in any subcontract agreements awarded by the successful offeror (Licensee).
Q. Can we obtain a full copy of the current CVS contract agreement to include their previous technical proposal responses?
A. No, the DoDCC will not provide this information as it is source selection/procurement sensitive.
Q. Can we get a breakdown of the top accepted manage care insurance benefit plans currently accepted by CVS?
A. The DoDCC is unable to provide this information.
Q. Can the bids be broken into two separate proposals? Can a source be awarded just the retail or pharmacy portion of the business?
A. Please refer to Section L., “Proposal Submission Requirements”, page 49 of 55 and Q&As above. The DoDCC intends to award one License Agreement for the successful offeror (Licensee) to operate a retail drug store and full-service pharmacy in Room 2B1080 on the Concourse in the Pentagon.
Q. Could the retail store open ahead of the pharmacy?
A. Offerors should detail plans regarding opening of the retail store and full-service pharmacy in proposals submitted in response to the RFP.
Q. What is the difference between military installations and reservations as it pertains to the Pentagon?
A. The Pentagon is the headquarters for the Department of Defense. There may be additional or different applicable laws, statutes, and regulations than a military installation.
Q. May we be provided a breakdown of total sales between retail sales and prescriptions?
A. No. This information is proprietary to the incumbent. Further, the DoDCC does not have this information.
Q. Will the incumbent concessionaire, CVS, be given special consideration regarding evaluation of past performance?
A. No. All offerors will be evaluated in accordance with Section M., page 53 – 55 of 55 of the RFP.
Q. How are offerors to provide fair estimates of what commissions should be offered in proposals?
A. Please refer to Section B.2., “Financial Proposal/Licensee Fee”, first paragraph, page 8 of 55 of the RFP. Commission payment proposals are invited on the basis of a fixed percentage of sales (e.g., flat rate, sliding scale, etc.). Offerors should provide details regarding commission proposals as part of proposal submission.
Q. Can the DoDCC provide a base commission or minimum suggested commission?
A. No.
Q. What is the population on any given day in the Pentagon?
A. Please refer to Section A.1.i., page 4 of 55 of the RFP. The Pentagon presently houses approximately 26,000 military and civilian employees and about 3,000 non-defense support personnel.
Q. Can you provide the demographics of the Pentagon?
A. The Pentagon workforce is about 50/50 for men and women and about 50/50 for military and civilian. The military population is approximately 60% officer, 40% enlisted.
Q. What is the distance from the furthest point of the proposed retail drug store and full-service pharmacy to the furthest point of the Pentagon?
A. This information is unknown. However, the Pentagon was designed so that people can get to any point within the Pentagon within seven (7) minutes.
Q. May we propose our business model tiered to a service (e.g., retail vs. pharmacy)?
A. Offerors should provide details regarding proposed business models in the proposals.
Q. Are commissions on pharmacy to be based on sales?
A. Yes.
Q. Could you please clarify the overall revenue/sales for the Pentagon?
A. Please refer to Attachment 3, “Historic Retail/Food Sales (2015 – 2018) within the Pentagon”, of the RFP.
