About this file
This Addendum No. 2 document, issued October 8, 2021, modifies the Request for Proposals for DOA 21-12 Airport General Engineering Consultant Services issued by the Palm Beach County Department of Airports and the Board of County Commissioners. The project seeks a single prime consultant firm certified under Florida's Consultant's Competitive Negotiations Act (CCNA) in Engineering to provide comprehensive general engineering consulting services across Palm Beach County's four airport facilities: Palm Beach International Airport (PBI), North Palm Beach County General Aviation Airport (F45), Palm Beach County Park Airport (LNA), and Palm Beach County Glades Airport (PHK). Services encompass horizontal and vertical infrastructure design, facilities inspection, environmental planning and compliance, construction management and engineering inspection, quality assurance, pavement management, IT/GIS services, and permitting across approximately eleven identified tasks. The pre-proposal conference was held virtually on October 7, 2021, with proposal submissions due October 28, 2021 at 3:00 p.m. (one original and six copies plus one electronic PDF copy). One firm will be selected for an initial two-year term with two optional one-year renewal periods at the County's discretion. Shortlisting of a minimum of three firms is scheduled for December 2021, with final selection and Board approval anticipated in February/March 2022.
This solicitation implements Palm Beach County's Equal Business Opportunity (EBO) Program, requiring mandatory 20% Small Business Enterprise (SBE) subcontracting participation and offering 15 evaluation points for Minority/Women Business Enterprise (M/WBE) dollar commitments. All funding is derived from local airport revenue sources with no ad valorem tax support. Subconsultants may operate under the prime consultant's $5,000,000 minimum liability insurance umbrella rather than maintaining individual policies. Addendum No. 2 clarifies that only the maximum workload percentages revised in Addendum No. 1 shall apply to consultant participation calculations, permits Standard Form 330 documents to satisfy both reference and resume requirements, and confirms that the PBI Turnage Boulevard Rehabilitation/Reconstruction project will not be included as a task due to its distinct funding source. The document was inadvertently referenced during the pre-proposal presentation but has been excluded from the contract scope. Additional clarifications address prime consultant certification requirements, insurance umbrella provisions, and the applicability of Florida Statute 725.08 indemnification language, which the County Legal Department will review prior to contract execution.

ADDENDUM NO. 2
ISSUED October 8, 2021
This addendum includes the following:
Questions/Clarifications/Corrections
1. Consultant Questionnaire Workload percentage The maximum workload percentage reflected in the RFP (revised in Addendum No. 1) shall be used as the basis for the consultant participation in Attachments F, G and H. No other workload percentage shall be used unless issued as part of an addendum.
Questions:
1. Question: Should a MEP firm apply as a Prime on this or would you recommend we pursue this as a sub to an architect?
Response: The prime consultant for this RFP is to be CCNA certified in Engineering. It is incumbent on each firm to make the determination to submit as a prime or a subconsultant based on the selection criteria.
2. Question: In the RFP it states Five (5) verifiable references for work of a similar nature completed in the last ten (10) years. This can be accomplished in the Standard Form 330.
On the pre-proposal call today References was listed a separate section. Is it okay to just utilize the 330 for the references or does the DOA prefer separate section with only the 5 references?
Response: The 330 forms can be used to meet both the reference requirements and the resumes.
3. Question: The RFP state requirements of the insurance a minimum of $5,000,000 liability applies to Prime and Subconsultants. Can the Ssubconsultants fall under the umbrella of the prime's insurance or is the expectation that all subconsultants are also required to maintain $5,000,000 of liability insurance.
Response: Yes. The subconsultants can fall under the umbrella of the Prime’s insurance.
4. Question: Respectfully, we believe that the indemnity provision in Article 11 on Page 8 of Addendum Number 1 dated October 4, 2021 is not in compliance with FL Statute 725.08 which declares that an indemnity not written as required by the statute is void and unenforceable. Please consider rewording same to conform with the statute. Suggested language per FL Statutes 725.08: “The Consultant shall indemnify and hold harmless the agency, and its officers and employees, from liabilities, damages, losses, and costs, including, but not limited to, reasonable attorneys' fees, to the extent caused by the negligence, recklessness, or intentionally wrongful conduct of the design professional and other persons employed or utilized by the Consultant in the performance of the contract.
Response: The document provided is a draft document that will be reviewed by Palm Beach County Legal Department prior to execution with the selected firm. The language related to FL Statute 725, 08 is under review.
October 8, 2021 Page 3 of 3
5. Question: Section II Scope of Work, on page 2 of the base solicitation, itemizes 11 tasks contemplated by the Department under the DOA 21-12 agreement. However, during the pre-proposal meeting held on October 7th the same list appeared in the presentation with the addition of the PBI Turnage Boulevard Rehabilitation/Reconstruction project. Was this a typo in the presentation or will this project be included by addenda as a twelfth task to be considered?
Response: Due to the funding source for the PBI Turnage Boulevard project it will not be one of the tasks that may be assigned under this contract. It was inadvertently listed in the presentation.

To that end, the Board adopted an Equal Business Opportunity Ordinance which is codified in Sections 2-80.20 through 2-80.30 (as may be amended) of the Palm Beach County Code, (EBO Ordinance) which sets forth the County’s requirements for the EBO program, and which is incorporated in this solicitation. A Proposer must comply with the requirements contained in this section for a Proposer to be deemed responsive to the solicitation requirements. The provisions of the EBO Ordinance are applicable to this solicitation, and shall have precedence over other provisions of this solicitation in the event of a conflict.
API Waiver Requests/Good Faith Efforts. If Proposer is unable to comply with the API requirements as set forth in this solicitation, such Proposer shall submit a request for a waiver or partial waiver at least (7) days prior to the proposal due date as stated in the solicitation. If a Proposer requests a waiver from an API from the Office of EBO at least 7 days prior to the proposal due date, then the proposal due date will be extended pending the outcome of a waiver request. Additionally, if the waiver is granted, the solicitation will be amended accordingly and the due date extended again. See Attachments B and C for Waiver Request Form and Good Faith Efforts form. Fillable pdfs of all EBO forms can be found on the OEBO website at http://discover.pbcgov.org/oebo/Pages/Compliance-Programs.aspx.

M/WBE dollar committed to on the prime respondents team.
Proposal Submission Documentation. In order to be deemed responsive to this solicitation, all Proposers are required to submit with their proposal the Consultant Questionnaire and the Subconsultant Questionnaires on all subconsultants intended to be used for performance of the contract, if awarded.
S/M/WBE Certification. Only those firms certified by Palm Beach County at the time of proposal opening shall be counted toward an S/M/WBE goal. Upon receipt of a complete application, IT TAKES UP TO NINETY (90) DAYS TO BECOME CERTIFIED AS AN S/M/WBE WITH PALM BEACH COUNTY. It is the responsibility of the Proposer to confirm the certification of any proposed S/M/WBE; therefore, it is recommended that Proposers visit the Office of EBO on-line Vendor Directory at http://discover.pbcgov.org/oebo/Pages/default.aspx to verify S/M/WBE certification
Post Proposal Waiver Request. After submission of a proposal, if Proposer, through no fault of its own, is unable to meet the S/M/WBE participation specified in its proposal, then Proposer must immediately seek substitute S/M/WBEs to fulfill the requirements and obtain the approval of the EBO Director. If, after reasonable Good Faith Efforts, the Proposer is unable to find an acceptable substitute S/M/WBE, a post-proposal submission waiver may be requested. The request shall document the reasons for the Proposer’s inability to meet the goal requirement.
