About this file

This document is Addendum Number 1 to RFP DOA 21-12, issued by the Palm Beach County Board of County Commissioners Department of Airports on October 4, 2021, for Airport General Engineering Consultant Services under the Local EBO Program. The addendum provides clarifications and modifications to the original proposal documents, including revised workload percentages for various engineering disciplines. The prime consultant must be CCNA certified in Engineering. Proposed disciplines include Civil Engineering (Prime, 43%), Drainage Engineering (3%), Environmental (11%), Structural (6%), Geotechnical Engineering (2%), Surveyor Services/Land (2%), Architectural Consulting (11%), Electrical Engineering (9%), Mechanical Engineering (6%), Highways/Streets/Airport/Parking Lots Engineering (5%), and Security and Access Systems (2%). The contract term is two years with two one-year renewal options at the County's sole discretion. The addendum includes a sample Standard Consulting Contract for Design Professional Services and clarifies scope items including security camera improvements that may encompass infrastructure installation such as power and fiber.

The procurement establishes a mandatory minimum 20% Small Business Enterprise (SBE) subcontracting goal with 15 evaluation points awarded based on the level of M/WBE dollar participation committed on the prime respondent's team. If a proposal pledges higher SBE participation than the minimum requirement, that pledged percentage becomes the contract requirement. The addendum references a "Consultant Fees Considered" summary dated September 16, 2021, documenting fees paid to various consultants during Fiscal Year 2021 and prior years, which proposers should use as reference while noting that additional fees through the end of the fiscal year may not be reflected. The document includes detailed historical fee information for over 300 consulting firms across multiple years, providing the County's actual expenditure patterns for consultant services related to engineering, architecture, surveying, environmental, and construction administration work.

This addendum includes the following:

Questions/Clarifications/Corrections

1. Clarification on Attachments F and G Section D. Volume of Work Proposers should utilize information relative to Fiscal Year 2021 (FY21) as the current year. A “Consultant Fees Considered” summary dated September 16, 2021 is provided on the County’s Engineering –Roadway Production and is included as an attachment to this addendum. Please be advised that the information contained on this website should not be used as the sole reference for providing this information. It is incumbent for the firm to add the value of any additional fees through the end of the current fiscal year that may not be reflected in the attachment.

Questions:

1. Question: The name of the RFP says Engineering consultant, but the scope of work of the tasks includes architectural related I just wanted to verify if this RFP is only for an Engineering Company to prime, or if it can also be primed an Architecture company.

October 4, 2021 Page 3 of 4

Response: The prime consultant for this RFP is to be CCNA certified in Engineering.

2. Question: The task called Security Camera Improvements – is the consultant scope limited to adding, relocating or adjusting cameras and cable only to the data/IT rooms? External cameras via fiber to a designated Access point or room. Backbone by others?

Response: The scope could include adding, relocating security cameras in addition to the infrastructure which could include installing power and/or fiber to designated IT rooms. This may also include multiple projects under this description dependent on funding.

3. Question: DOA 21-12 references a “Standard Consulting Contract for Design Professional Services”.

Could you send us a copy of this? As we prepare our submittal we would like to have the opportunity to review this document. Thanks for your help.

Response: A copy of the Standard Consulting Contract is included as part of this Addendum.

4. Question: On page 9 is a maximum workload chart to be used for the Consultant Questionnaire. Is the Prime allowed participation in multiple Descriptions beyond Civil? Is there a percentage for Construction Management, Administration and Coordination as well as CEI Services? What Category is for QA and QA reviews? What category for GIS Services and CCTV? What is Category for Way Finding and Signage improvements? Is there a landscaping component? Is seems illogical to have estimated participation to a hundredth percentage for unknown work tasks. Is it acceptable to add Descriptions to maintain 100% -otherwise in it required to use these maximum percentages as the sole way to get to 100%?

If a proposal pledges a 40% SBE participation, does this total become contract requirement or does the 20% minimum still govern?

Response:

4.01 On page 9 is a maximum workload chart to be used for the Consultant Questionnaire. Is the Prime allowed participation in multiple Descriptions beyond Civil?

Yes. The prime could have participation on multiple descriptions.

4.02 Is there a percentage for Construction Management, Administration and Coordination as well as CEI Services?

Those would be included under the applicable description for those firms providing those services dependent on the project. For instance a project could require multi-disciplines for CM, CA, CEI services. (Electrical, Civil, Geotechnical, etc.)

4.03 What Category is for QA and QA reviews?

Same response as number 4.02 above.

4.04 What category for GIS Services and CCTV?

GIS Services would fall under Land Surveyor Services. CCTV would fall under Security and Access Systems (Airports, Library, Hospitals etc.)

4.05 What is Category for Way Finding and Signage improvements?

Same response as number 4.02 above.

4.06 Is there a landscaping component?

There is not a separate component for landscaping.

October 4, 2021 Page 4 of 4

4.07 It seems illogical to have estimated participation to a hundredth percentage for unknown work tasks.

Is it acceptable to add Descriptions to maintain 100% - otherwise in it required to use these maximum percentages as the sole way to get to 100%?

The calculations were estimated amounts per discipline used for determining the S/M/WBE participation but when calculated on the total contract amount reflected the hundredth percentage. The table has been revised to round up the percentages as part of this addendum.

4.08 If a proposal pledges a 40% SBE participation, does this total become contract requirement or does the 20% minimum still govern?

If the proposal pledges a 40% S/M/WBE participation then this will govern and the firm will be expected to meet the 40% participation.

5. Question: Just wanting some clarification to Item 1 (page 1). The RFP states the goal for SBE Subcontracting is 20%, along with 15 points for utilizing M/WBE firms. Does this mean there is no special interest in only utilizing African American firms as last years RFP had stated?

Response: Correct. The API established for this Contract is as referenced in the RFP document

1. SBE Subcontracting

The SBE goal for this contract is a mandatory minimum of 20% participation

2. M/WBE Evaluation Preference:

15-points shall be awarded based on the level of M/WBE dollar participation that has been committed to on the prime respondent’s team.

ARTICLE 21 - NONDISCRIMINATION

A. Non-Discrimination in County Contracts. The COUNTY is committed to assuring equal opportunity in the award of contracts and complies with all laws prohibiting discrimination. Pursuant to Palm Beach County Resolution R2017-1770, as may be amended, the CONSULTANT warrants and represents that throughout the term of the Contract, including any renewals thereof, if applicable, all of its employees are treated equally during employment without regard to race, color, religion, disability, sex, age, national origin, ancestry, marital status, familial status, sexual orientation, gender identity or expression, or genetic information. Failure to meet this requirement shall be considered default of the Contract.

As a condition of entering into this Agreement, CONSULTANT represents and warrants that it will comply with the County's Commercial Nondiscrimination Policy as described in Resolution 2017-1770 as amended. As part of such compliance, CONSULTANT shall not discriminate on the basis of race, color, national origin, religion, ancestry, sex, age, marital status, familial status, sexual orientation, gender identity or expression, disability, or genetic information in the solicitation, selection, hiring or commercial treatment of subcontractors, vendors, suppliers, or commercial customers, nor shall the company retaliate against any person for reporting instances of such discrimination. CONSULTANT shall provide equal opportunity for subcontractors, vendors and suppliers to participate in all of its public sector and private sector subcontracting and supply opportunities, provided that nothing contained in this clause shall prohibit or limit otherwise lawful efforts to remedy the effects of marketplace discrimination that have occurred or are occurring in the County's relevant marketplace in Palm Beach County. CONSULTANT understands and agrees that a material violation of this clause shall be considered a material breach of this agreement and may result in termination of this agreement, disqualification or debarment of the CONSULTANT from participating in County contracts, or other sanctions. This clause is not enforceable by or for the benefit of, and creates no obligation to, any third party. CONSULTANT shall include this language in its subcontracts.

B. Federal Nondiscrimination Covenants.

The CONSULTANT agrees that it will comply with pertinent statutes, Executive Orders and such rules as are promulgated to ensure that no person shall, on the grounds of race, creed, color, national origin, sex, age, or handicap be excluded from participating in any activity conducted with or benefiting from Federal assistance. This provision binds the CONSULTANT from the solicitation period through the completion of this Contract. This provision is in addition to Title VI of the Civil Rights Act of 1964.

2. Title VI Clauses for Compliance with Nondiscrimination Requirements. During the performance of this Contract, the CONSULTANT, for itself and its assignees and successors in interest, agrees as follows:

c. Solicitations for Subcontracts, Including Procurements of Materials and Equipment:

In all solicitations, either by competitive bidding, or negotiation made by the CONSULTANT for work to be performed under a subcontract, including procurements of materials, or leases of equipment, each potential subcontractor or supplier will be notified by the CONSULTANT of the CONSULTANT’s obligations under this Contract and the Acts and Regulations relative to non-discrimination on the grounds of race, color, or national origin.

d. Information and Reports: The CONSULTANT will provide all information and reports required by the Acts and Regulations, and directives issued pursuant thereto and will permit access to its books, records, accounts, other sources of information, and its facilities as may be determined by the COUNTY or the Federal Aviation Administration to be pertinent to ascertain compliance with the Acts and Regulations, and instructions. Where any information required of the CONSULTANT is in the exclusive possession of another who fails or refuses to furnish the information, the CONSULTANT will so certify to the COUNTY or the Federal Aviation Administration, as appropriate, and will set forth what efforts it has made to obtain the information.

e. Sanctions for Noncompliance: In the event of the CONSULTANT’s noncompliance with the non-discrimination provisions of this Contract, COUNTY will impose such Contract sanctions as it or the Federal Aviation Administration may determine to be appropriate, including, but not limited to:

1. Withholding payments to the CONSULTANT under this Contract until the CONSULTANT complies; and/or

2. Cancelling, terminating, or suspending this Contract, in whole or in part.

f. Incorporation of Provisions: The CONSULTANT will include the provisions of this Article 22 in every subcontract, including procurements of materials and leases of equipment, unless exempt by the Acts and Regulations and directives issued pursuant thereto. The CONSULTANT will take action with respect to any subcontract or procurement as the COUNTY or the Federal Aviation Administration may direct as a means of enforcing such provisions including sanctions for noncompliance. Provided, that if the CONSULTANT becomes involved in, or is threatened with litigation by a subcontractor, or supplier because of such direction, the CONSULTANT may request the COUNTY to enter into any litigation to protect the interests of the COUNTY.
