About this file
This document is a Certification of Non-Involvement in Prohibited Activities in Russia or Belarus form issued by the State of New Jersey, specifically addressing vendors seeking to enter into or renew contracts with state agencies. The form requires vendors to certify their status regarding the Office of Foreign Assets Control (OFAC) Specially Designated Nationals and Blocked Persons list, with three possible certification options: (A) not being identified on the list for Russia/Belarus-related activities, (B) being identified on the list for Russia/Belarus-related activities, or (C) being identified but engaged in activities consistent with federal law.
The certification is mandated by New Jersey State statute N.J.S.A. 52:32-60.1 and applies to a broad definition of "vendor" including corporations, partnerships, governmental entities, and other organizational structures. The document outlines potential consequences for incorrect certification, which may include sanctions, compliance actions, damage recovery, default declarations, and potential debarment or suspension. Vendors must provide comprehensive contact information and are required to carefully review the OFAC list before completing the certification, with the understanding that the New Jersey Department of the Treasury will take appropriate action if a violation is discovered.
