About this file
This justification document approves the use of other than full and open competition for a brand-name foundation system on a federal highway project. The Diamond Pier Foundation System from Pin Foundations, Inc. will be used for the CA SOBO Trail(1) - Rock Hill Trail project located in the Sonny Bono Salton Sea National Wildlife Refuge in California. The pin foundation system minimizes environmental impacts compared to traditional concrete footings by avoiding excavation and soil disturbance. The Federal Highway Administration's Central Federal Lands Highway Division conducted market research and found Pin Foundations to be the only manufacturer of this type of foundation system, thereby requiring the use of other than full and open competition. The project involves rehabilitation of approximately one mile of existing trail along with selective clearing, construction of an overlook and parking improvements. Estimated costs range from $700,000 to $2,000,000.

DEPARTMENT OF TRANSPORTATION
FEDERAL HIGHWAY ADMINISTRATION
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
1. Identification of the agency and the contracting activity
Department of Transportation, Federal Highway Administration, Central Federal Lands
Highway Division (CFLHD), 12300 Dakota Avenue, Lakewood, Colorado.
2. Nature and/or description of the action being approved Justification and approval to use other than full and open competition for a brand-name product peculiar to one manufacturer for the Diamond Pier Foundation System for project CA SOBO Trial(1) – Rock Hill Trail. The pin foundation systems use the strength of a precast concrete head to lock in four weight-bearing, galvanized steel pins that transfer the load to a larger area of undisturbed soil than the traditional concrete footing. Functioning like tree roots, this spread pile technology is fast, smart, low-impact, and sturdy.
3. Description of the supplies or services required to meet the agency’s needs (including the estimated value) This justification only covers a portion of the acquisition that is brand-name and specific to the Diamond Pier Foundation System from Pin Foundations, Inc., 4810 Pt Fosdick Dr NW PMB 60, Gig Harbor, WA 98335.
4. Statutory authority permitting other than full and open competition
The authority to enter a contract for this effort without full and open competition is:
6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited Searches conducted on Google and Bing indicate that there is no other company manufacturing the pin foundation systems. The Diamond Pier Foundation System from Pin Foundations, Inc., minimizes impacts to the project area and environment. There is no excavation involved using the foundation system, the soil is preserved without being disturbed, eliminating erosion and other run-off problems. If not used the project would involve excavation, loss of topsoil, erosion prevention measures, and drainage control would be needed creating additional costs for the project and unnecessary impacts to the environment.
6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized
The Justification for Other than Full and Open Competition will be posted with the solicitation as required by FAR 5.102(a)(6).
7. Determination that the anticipated cost to the Government will be fair and reasonable
CFLHD will ensure that all costs associated with the proposed contract are fair and reasonable. CFLHD will perform a thorough analysis of the Offeror’s bid and/or proposal to substantiate this determination.
8. Description of the market research conducted and the results or a statement of the reason market research was not conducted
An internet search was conducted using the Google and Microsoft Edge search engines.
There were no other companies found that manufacture foundation systems similar or equal to the Diamond Pier Foundation System for decks.

9. Other facts supporting the use of other than full and open competition
This foundation system has been used for the construction of pedestrian overlooks on several recent FWS Pacific Southwest Region National Wildlife Refuge projects including projects in the Sonny Bono Salton Sea NWR. The Refuge is satisfied with the performance of this product. Using a system, they are familiar with and one that has been installed at other locations in the refuge will allow for easier and more economical maintenance.
This type of foundation can be installed rather quickly and easily and does not require the time needed for a conventional concrete footing to cure. Due to environmental constraints, construction of the overlook is on the critical path to meet the overall construction schedule. Use of this foundation system will reduce the construction period for the overlook.
10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.
N/A. This is being posted with the project solicitation, vendors are unable to express interest until posted.
11. Statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
There are no actions available to remove or overcome the barriers to competition.
Market research accomplished per the above, shows that Pin Foundations, Inc., is the only manufacturer of this type foundation system.
12. Certification
I certify that the information provided in this justification is complete and accurate to the best of my knowledge and belief.
