(e) Multiple offers. DELETED FROM THIS COMBINED SYNOPSIS/SOLICITATION

(f) Late submissions, modifications, revisions, and withdrawals of offers.

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)

(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and—

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary.

The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

Offerors are hereby advised that the Government, unless otherwise specified, i.e., by law acquire that right to use, duplicate, or disclose in any manner and for any purpose whatsoever, and have or permit others to do so, all subject data required to be delivered under any contract resulting from this solicitation. Any reservations to those stated Government rights to data should be enunciated in your proposal and will be resolved during any subsequent negotiations.

iv. To permit a thorough and effective evaluation, the proposal should be as concise, complete and clear as possible. Inclusion of any important consideration not covered by this request is encouraged. The technical proposals shall be as detailed, specific and complete as to enable the Government to make a thorough evaluation of the proposal, and a sound determination that each proposal will have a reasonable likelihood of meeting the requirements of the Government as set forth in the Statement of Objectives. A proposal which merely offers to conduct a program in accordance with the requirements of the Government's scope of work will not be eligible for award. Offerors shall!

Include an explanation of the proposed technical approach in conjunction with the requirements of Statement of Objectives (SOO). Statements to the effect that the offeror understands and will comply with the SOO in whole or in part, phrases such as "standard procedures will be used" or well-known techniques will be utilized" and generalities of textbook theories and techniques will not constitute compliance with the requirements concerning the content of the technical proposal. It is essential that the offeror present information in sufficient detail so as to permit the Government to make evaluation of the technical proposal without further information being required from the Offeror.

v. The proposal must include information on how the project is to be organized, staffed, and managed. Information should be provided which will demonstrate your understanding and management of the objectives contained in the SOO. 10. VOLUME II - PAST PERFORMANCE /PAST EXPERIENCE INSTRUCTIONS

ii. Offeror shall provide the past performance survey at Attachment 3 to their references, for them to complete and email directly to pamela.robinson@do.treas.gov before the closing date of proposals. The Government will evaluate the quality and extent of offeror's experience deemed relevant to the requirements of this RFP. The Government will use information submitted by the offeror and other sources such as the Federal Government offices and commercial sources, to assess experience. Provide a list of three (3) of the most relevant contracts performed for Federal agencies and commercial customers within the last 5 years of this solicitation closing date that demonstrate your ability to perform the proposed effort. Past Performance regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement will be given a rating. Offerors with no relevant past or present performance history shall receive the rating "neutral", meaning the rating is rated neither favorable nor unfavorable.

iii. The Government will evaluate each offeror on its performance under existing and prior contracts for similar services. The Government will use performance information for both responsibility determinations and as an evaluation factor In determining the acceptability of an offeror. iii. Note that unrealistically low or high proposed costs or prices initially or subsequently, may be grounds for eliminating a proposal from competition either on the basis that the offeror does not understand the, requirement or has made an unrealistic proposal. An offer using a sliding price scale or subject to escalation based on any contingency will not be accepted and will be considered as non-responsive to this solicitation. Offers should be sufficiently detailed to demonstrate their reasonableness. The burden of proof for credibility of proposed costs/prices rests with the offeror.

mailto:pamela.robinson@do.treas.gov

iv. If additional information is required to support price reasonableness, each offeror may be requested to provide a hard copy of the following information listed below from the prime offeror and any subcontractors:

(End of Provision)

ADDENDUM TO 52.212-2 - EVALUATION—COMMERCIAL ITEMS (JAN 1999)

1. Basis for Award. Award will be made to the responsible offeror whose offer, conforming to the solicitation, is the best overall value to the Government, price and other factors considered.

2. Evaluation Factors. In selecting the best overall value, the following factors will be evaluated:

a. TECHNICAL / MANAGEMENT EXPERIENCE

(1) Understanding of the Work Required

The offeror shall demonstrate in their SOW that they have a clear understanding of the work required in the SOO. In particular, the offeror shall demonstrate that they have a clear understanding, knowledge and experience of work required under each of the items listed in

Section 2. (benefits determination/correction, customer service, records management, change management/business process reengineering, training and annuity quality) of the

SOO. Offerors shall also demonstrate that they have knowledge, understanding and experience with D.C. pension plans or other comparable experience regarding various legislation listed in Section 3. of the SOO. The Government will evaluate the offeror’s understanding, knowledge and experience of the work required based on the information submitted regarding Section 2. and Section 3. of the SOO.

(2) Technical Approach to Performing Work The offeror shall demonstrate their technical approach in their SOW to conduct the specific types of work outlined in Section 2. of the SOO. In particular, the offeror shall describe their technical approach to performing the work for each of the areas mentioned in Section 2. of the SOO. The Government will evaluate the offeror’s technical approach to performing the work mentioned in Section 2. of the SOO.

(3) Key Personnel The offeror shall identify in their SOW, by name those individuals that are being proposed as key personnel. The offeror shall submit to the Government resumes of key personnel which describe the key personnel’s specific qualifications and experience. Identified experience should be relevant to the proposed effort. The Government will evaluate the key personnel experience in the offeror’s SOW; relative to the experience required to perform the work mention in the SOO.

b. PAST PERFORMANCE / PAST EXPERIENCE

Offerors shall submit three (3) references (company name and address, phone number and point of contact) for similar work as mentioned in this solicitation regarding on public pension plans. This work must be currently active or completed within the last five (5) years. The

Government will evaluate how well the offeror performed the work by contacting the references cited.

c. PRICE The IRS intends on issuing a Firm Fixed Price Task Orders under the IDIQ contract. As a result, vendor shall submit a price proposal based on their best offer to include any discounts for the Sample Task (Attachment 4). The offeror shall also submit a copy of the terms and conditions listed in their GSA Schedule contract. DO NOT

SUBMIT YOUR ENTIRE GSA SCHEDULE CONTRACT.

3. Relative weight. Non-price factors (Technical Approach, Management Approach and Past Performance/Past Experience), when combined, are more important than Price. Of the non-price factors, Technical and Management Approach being equal are more important than Past Performance/Past Experience. The importance of price in the evaluation for award will increase as the relative differences in non-price factors of offerors decreases.

Offerors should consider these factors when preparing proposals. The rating for each evaluation factor will be based on the Government's determination of the degree to which the proposal satisfies the requirements of each factor. The highest possible rating is Exceptional, with the lowest possible rating being Unacceptable.

Proposals will be evaluated using the following adjectival ratings: Exceptional, Very Good, Satisfactory, Marginal, Unacceptable or Neutral.

52.217-8 OPTION TO EXTEND SERVICE (NOV 1999)

The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 15 days of contract expiration.

(End of Clause)
