About this file
This is a Department of Labor worker rights poster (Form WH1321, Revised 07/24) that must be displayed by employers at federal and federally assisted construction project sites where workers can readily see it.
The poster outlines prevailing wage requirements under the Davis-Bacon Act, mandating that workers be paid not less than the applicable Davis-Bacon Wage Decision rate for their work. Workers must receive overtime pay at a minimum of one and one-half times their basic hourly rate for all hours exceeding 40 per work week, with limited exceptions. Apprentice rates apply only to properly registered apprentices under approved federal or state apprenticeship programs. The poster details enforcement mechanisms, including contract payment withholding, liquidated damages, contract termination, and three-year debarment from federal contracts for non-compliance. Contractors who falsify payroll records or induce wage kickbacks face civil or criminal prosecution, fines, and potential imprisonment. The document also protects workers from retaliation for filing complaints, cooperating in investigations, or testifying in proceedings under the Davis-Bacon and Related Acts. Workers who do not receive proper pay or need wage information should contact the Contracting Officer or the U.S. Department of Labor's Wage and Hour Division at 866-487-9243 or dol.gov/agencies/whd.
