The purpose of this Amendment is to:

52.219-14 Limitations on Subcontracting (Nov 2011)

(a) This clause does not apply to the unrestricted portion of a partial set-aside.

(b) Applicability. This clause applies only to --

(I) Contracts that have been set aside or reserved for small business concerns or 8(a) concerns;

(2) Part or parts of a multiple-award contract that have been set aside for small business concerns or 8(a) concerns; and

(3) Orders set aside for small business or 8(a) concerns under multiple-award contracts as described in 8.405-5 and 16.505(b)(2)(i)(F).

(c) By submission of an offer and execution ofa contract, the Offeror/Contractor agrees that in performance of the contract in the case of a contract for-

(I) Services (except construction). At least 50 percent of the cost of contract performance incurred for personnel shall be expended for employees of the concern.

(2) Supplies (other than procurement from a nonmanufacturer of such supplies) . The concern shall perform work for at least 50 per cent of the cost of manufacturing the supplies, not including the cost of materials.

(3) General construction. The concern will perform at least 15 percent of the cost of the contract, not including the cost of materials, with its own employees .

( 4) Construction by special trade contractors. The concern will perform at least 25 percent of the cost of the contract, not including the cost of materials, with its own employees.

TECHNICAL EVALUATION CRITERIA

AIRBORNE IMAGING SYSTEMS

Evaluation Factors Listed in Descending Order oflmportance

The following are the technical evaluation factors and subfactors that will be used in evaluating each proposal. Factors are listed in descending order of importance.

Subfactors are also listed in descending order of importance. All technical proposals must be typed in Times New Roman type, at least 11 point font, double-spaced, and one sided. TECHNICAL PROPOSALS MUST NOT EXCEED THIRTY (30) PAGES, EXCLUDING THE PAST PERFORMANCE SECTION. The technical evaluation factors when combined are significantly more important than Cost/Price; however, as technical becomes more equal, Cost/Price will become more important.

1. Technical Capabilities

1.1 Performance Requirements

The Offeror's technical approach shall define solutions that encompass the work to be completed for the acquisition and installation of the Airborne Imaging Systems and options on the government-owned aircraft in support of DEA law enforcement missions.

The Off eror shall demonstrate its ability to satisfy the unique requirements for all types of aircraft listed as specified in the Statement of Objectives (SOO), as follows:

• Bell 407 helicopters (see SOO Section 3 .1.1)

• Eurocopter AS350 helicopters (see SOO Sections 3.1.2 and 3.1.3)

• Cessna 206 aircraft (see SOO Section 3.2)

1.2 Delivery Schedule

The Offeror' s technical approach shall also include the offerors' expected completion time for the Airborne Imaging System and individual options (sections 3.3 and 3.4). This shall be broken down by each aircraft type and shall define, as specifically as possible, all steps related to the acquisition and installation/modification of equipment as specified in the SOO, in particular sections 3.1, 3.2, 3.3 and 3.4. The offerors' shall be evaluated according to specificity, completeness, and ability to perform the work in the most time efficient manner. Upon acceptance by the government, the successful offerors' expected completion time for the Airborne Imaging System and individual options will be incorporated in to the contract pursuant to SOO section 4.0.

2. Past Performance

The Government will evaluate each Offeror' s experience providing commercial items of a similar nature to that requirement described in this solicitation. Specifically, past performance of similar size, scope, and complexity, in relation to the requirements of this solicitation, is of particular interest to the Government. The Government reserves the right to conduct telephone interviews to validate past performance and to obtain additional information from other internal and external sources, if known. The quality of the Offeror's past performance will be evaluated based on a comparison of the information the offeror provides in its proposal with information the Government obtains through reference checks, its own knowledge/experience, and/or from other sources (e.g.

Contracting Offices, Past Performance Information Retrieval System (PPIRS), and Contractor Performance Assessment Reporting System (CP ARS)). Offerors with no relevant past performance history shall receive the rating of "neutral," meaning the rating is treated neither favorably nor unfavorably.

3. Corporate Capabilities

3.1 Quality Control Plan

The Offeror shall provide a Quality Control Plan (QC Plan) in accordance with requirements specified in SOO Section 10.0. This QC Plan shall include a description of the offeror' s overall corporate strategy and solutions for contract management. The Offeror shall demonstrate its corporate quality control and inspection procedures, including management of resources, quality assurance, risk mitigation, and problem resolution. The Offeror shall discuss its methodology to identify issues and to correct any deficiencies in services that may occur.

3.2 Requirements and Deliverables

The Offeror shall demonstrate its ability to provide the deliverable products and data specified in the SOO Section 7 .0.
