About this file

This is Addendum No. 1 to a state contract issued by the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) Hudson Valley District for historic building restoration at John Jay Homestead State Historic Site. The project scope encompasses wood shingle roof replacement, masonry restoration, exterior and interior restoration, structural repairs, finishes, electrical and lighting upgrades, HVAC upgrades, fire and security systems, utility infrastructure, IT infrastructure and building Wi-Fi, walkways, soil and sod plantings, heritage tree protection and removals, and site lighting. The contract is designated as a single lump sum prime project labor agreement contract with a project duration of 550 days. A pre-bid meeting was held on July 9, 2026, with 33 bidders and 4 non-bidders registered on the plan holders list. The bid opening is scheduled for August 13, 2026, at 1:00 p.m., with bids due by 12:30 p.m. The addendum includes responses to eight of the contractor requests for information (RFIs 11-14, 16, 18, 20, 23, and 28) and references to additional RFI responses to be provided in a subsequent addendum, along with supporting documentation including the RFI log, plan holders log, pre-bid sign-in sheet, and pre-bid meeting agenda.

The engineer's estimate range is $16,365,991 to $22,142,223, with field order allowances of $916,850 and a bid bond requirement of $962,750. The project is tax-exempt as a New York State OPRHP project. Minority and Women Business Enterprise (MWBE) contracting goals include 20 percent MBE participation, 10 percent WBE participation, and 10 percent Service-Disabled Veteran-Owned Business (SDVOB) participation. Key addendum updates clarify that temporary security fencing is not required beyond erosion and tree protection measures; the baby grand piano in the ballroom must be protected in place; work described in the Tree Survey Appendix 5 is for reference only and not part of the contract; shoring is not required for the 10-foot courtyard excavation but the contractor is responsible for site safety; and specialty and artisan contractors may be employed under the project labor agreement upon verification with Local 7 and DC9 that union entities cannot provide the required work. Proof of Department of Labor registration and Gender-Based Violence and the Workplace Certification are required submissions with the bid, with failure to provide resulting in automatic disqualification.

Question:

Specification Section 312000 1.1 C. states “The Engineer shall determine the suitability of materials that are to be used in the work and should any materials encountered be unsatisfactory for the purpose intended, they shall be removed from the site at the Contractor's expense.” In addition, Specification Section 312000 3.2 B. states “All suitable materials removed in excavation shall be used in the construction of embankments, subgrade, shoulders, slopes, and at such other places as directed. The Engineer shall be the sole judge of what constitutes suitable material.”

For bidding purposes, please confirm that the existing onsite material is suitable and that the existing excavated material may be used as site fills.

Answer:

Company: CHA Consulting Response:

No. The Contract Documents do not represent that all excavated on-site material is suitable for reuse as fill. Bidders shall base their bids on the information provided in the Contract Documents, including the Geotechnical Engineering Report. As noted in Section 5.6 of the Geotechnical Report, the on-site soils generally do not meet the requirements for Structural Fill.

The suitability of excavated material cannot be determined in advance for all materials encountered during construction. Material proposed for reuse will be subject to field review and testing. The Engineer's determination of suitability will be based on observations in the field and the results of Contractor required preconstruction qualification testing in accordance with subpart 2.1 performed by a qualified soils laboratory. The Geotechnical Report specifically requires testing of fill materials to verify that they meet the project requirements. Material found to be suitable and meeting the specified requirements may be reused where approved.

Material found to be unsuitable or not meeting the specified requirements shall be handled in accordance with the Contract Documents.

Company: CHA Consulting Response:

No separate rock excavation allowance or unit price is included in the Contract Documents.

Should rock or ledge be encountered that was not reasonably anticipated based on the available information, the Contractor shall notify the Director's Representative for review prior to proceeding. Any necessary adjustments to the Work will be handled in accordance with the Contract's Field Order and Change Order procedures. Spec Section No.: PLA Agreement Drawing No:

Remarks:

Question: How should we handle the need for specialty/artisan contractors such as plasterers, wall coverings, carpeters, wood restoration (floors, ect), specialty masonry restoration and historic window repair and replacement, with regard to the PLA Agreement? These scopes are often (almost always) excluded by union Painters, Carpenters, Masons and Glaziers and necessitate bringing in small, specialty historic contractors (with the specified experience level) for this work to be completed correctly.

Does the Owner have a pre-qualified list of union restoration contractors that could be utilized, specifically with regard to wood door restoration, wood window restoration, wood floor restoration, masonry restoration, and plaster/stucco restoration?

Company: New York State Parks, Recreation & Historic Preservation

Response:

Article 3.4.i allows a contractor to employ "Artisans", individuals or entities that have unique one of a kind skillsets that are needed for the project. The contractor must first, however, verify with Local 7 and DC9 that they do not have entities or individuals to do that work and who are capable of doing the needed work in a way acceptable to the Contractor. Regarding all other trades not specifically mentioned, such as carpenters, plasterers and masons, Article 4.2.A governs. A contractor must make a request from the referring union for the specific qualifications of an individual or individuals. If the referring union cannot provide the requested employee or employees, the contractor may obtain the skill set from any other available source.

If there are any questions regarding available skillsets, it is highly recommended that you contact the trade(s) in question and discuss the needs. Please contact Mr. Ed Cooke, VP of the Trades Council at (914) 393-3910. He will provide you with the necessary point of contact.

It should be noted that there are no prohibitions on participation in the work under this contract including specialty contractors. All contractors or subcontractors, including specialty contractors or any tier must abide by the PLA. No exceptions. All contractors of any tier must pay prevailing wage and benefit rates. Please refer to ARTICLE 11.2 for options relevant to payment of benefits
