Description: This is a combined synopsis/solicitation for commercial services prepared in accordance with the format in the Federal Acquisition Regulations (FAR) Subpart 12.6 – Streamlined Procedures for Evaluation and

Solicitation for Commercial Services in conjunction with FAR Part 13.0 Simplified Acquisition Procedures. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.

This Request for Quotation (RFQ) is being issued as full and open competition under NAICS 811310 with a size standard of $12.5M and PSC Z1GZ. SP3300-25-Q-0290 is being issued to establish a Firm Fixed-Price (FFP) and

Time & Materials (T&M) purchase order for a contractor to provide preventative and corrective maintenance services on elevators, dumbwaiters, and platform lifts at DLA Distribution Susquehanna PA.

This acquisition is not a Defense Priorities and Allocations System (DPAS) rated procurement.

The contractor shall provide all labor, supervision, tools, materials, equipment, transportation, and management necessary to provide preventive and maintenance services, unscheduled service calls (as needed) and all repair and or replacement parts necessary to keep all portions of the weigh scale systems covered by this requirement in good operating condition. The services shall be performed in accordance with Statement of Work (SOW) provided at

Attachment 1. The Government intends to award one (1) purchase order as a result of this RFQ which will be issued on a Standard Form (SF) 1449.

CLINs 0001-4001: Firm-Fixed Price: Is for monthly preventative maintenance on 11 elevators and 1 dumbwaiter.

This includes inspection and testing.

CLINs 0002-4002: Time and Materials: Labor to perform Corrective Maintenance (Equipment Repairs) on

Elevators, Dumbwaiters, and Electric Platform Lifts as a result of a service call, in accordance with the attached

Statement of Work. NOTE 1: The numbers of hours shown below are estimates only. Contractor will be paid only for the actual number of labor hours used for Corrective Maintenance service calls during the Period of

Performance. NOTE 2: The Government will not pay for travel between the contractors' location and DLA

Distribution Susquehanna; the Government will pay only for the actual number of labor hours that the technician is at DLA Distribution Susquehanna. The contractor shall not exceed the CLIN/contract ceilings without prior approval from the Contracting Officer

CLINs 0003-4003: Time and Materials: Replacement Parts for Corrective Maintenance (Equipment Repairs). This is an estimated amount to reimburse contractors for replacement parts required for Corrective Maintenance of the

Elevators, Dumbwaiters, and Electric Platform Lifts. Prices shall not exceed the contractor’s established catalog or market price. If the contractor obtains a part at a discounted cost, the contractor shall pass the savings on to the

Government. Upon request of the Government Point of Contact, the contractor will be required to provide invoices and/or proof of pricing for the contractor purchased part.

CLINs 0004-4004: Firm-Fixed Price: Is for monthly preventative maintenance on 3 platform lifts to include inspection and testing. This CLIN will be exercised on an option basis if/when the platform lifts are operational.

Vendors must quote all CLINs on the Schedule of Supplies to be eligible for award.

ILLEGAL ITEMS NOT AUTHORIZED ON FEDERAL INSTALLATION: Illegal drugs, guns or other contraband are not authorized on this Federal installation. It is the contractor’s responsibility to ensure that its employees working on-site at this installation are U. S. citizens or legal aliens with no outstanding warrants. This installation is manned by a DoD Police Force who possesses apprehension authority, which includes holding suspects for local authorities. The local authorities can issue a citation that charges the individual with a specific offense and requires the individual to appear before a Federal Magistrate. This agency processes illegal aliens in accordance with INS instructions.

THE FOLLOWING PROVISIONS ARE INCORPORATED BY FULL TEXT:

52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or

Equipment (NOV 2021)

(a) Definitions. As used in this provision--Covered telecommunications equipment or services, Critical technology, and Substantial or essential component have the meanings provided in clause 52.204-25, Prohibition on

Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year

2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Contractors are not prohibited from providing--

(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

FAR 52.216-1 Type of Contract (APR 1984)

The Government contemplates award of a single Fixed-Priced Price/Time and Materials Purchase Order as a result of this solicitation.

FAR 52.216-31 Time-and-Materials/Labor-Hour Proposal Requirements—Commercial Item Acquisition

(NOV 2021)

(a) The Government contemplates award of a Time-and-Materials or Labor-Hour type of contract resulting from this solicitation.

(b) The offeror must specify fixed hourly rates in its offer that include wages, overhead, general and administrative expenses, and profit. The offeror must specify whether the fixed hourly rate for each labor category applies to labor performed by—

(1) The offeror;

(2) Subcontractors; and/or

(3) Divisions, subsidiaries, or affiliates or the offeror under a common control.

FAR 52.209-11 Representation by Corporations Regarding Delinquent Tax Liability or a Felony Conviction under any Federal Law (Feb 2016)

(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations

Act, 2015 (Pub. L 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--

DLAD 5452.233-9001 Disputes – Agreement to Use Alternative Dispute Resolution (ADR) (JUN 2020)

(a) The parties agree to negotiate with each other to try to resolve any disputes that may arise. If unassisted negotiations are unsuccessful, the parties will use alternative dispute resolution (ADR) techniques to try to resolve the dispute. Litigation will only be considered as a last resort when ADR is unsuccessful or has been documented by the party rejecting ADR to be inappropriate for resolving the dispute.

(b) Before either party determines ADR inappropriate, that party must discuss the use of ADR with the other party.

FAR 52.212-1 Instructions to Offerors – Commercial Products and Commercial Services (SEP 2023)

The provision at 52.212-1 and the following addenda are applicable to this acquisition.

(1) Paragraph (c) of 52.212-1 is tailored to read as follows: (c) Period of acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of quotes.

e. The Contractor shall provide resumes and certificates pertaining to the specific training completed by all contractor personnel performing work under this SOW; resumes and certificates shall be submitted with the contractor’s quote. The required information is described in paragraph 11.0

f. The contractor shall provide certificates and documentation showing that they are an established provider of Elevator Maintenance services.

(7) Quotes shall include all required documentation as listed above. Submission of a quote that does not contain all items requested below may result in elimination from consideration for award. Instructions contained herein are to serve as a guide in preparation of quotes; however, they are not intended to be all inclusive. The instructions generally describe the type and extent of information, which should be provided in the quote. The offeror is expected to completely examine and analyze all aspects of the technical/business, past performance, and price areas to be addressed, and to include information in the quote, which will enable the evaluators to determine the offeror’s understanding of the requirements in each of the above areas.

FAR 52.212-2 Evaluation – Commercial Products and Commercial Services (NOV 2021)

Quotes will be evaluated in accordance with FAR 13.106-2. The Government intends to award one purchase order on an all-or-none basis to the responsible offeror who: 1) quote complies with the terms and conditions of this solicitation, complies with laws and regulations ; and 2) offers the total overall lowest price for all contract line items.

Quoter must be determined to be responsible according to the standards of FAR Part 9 to be eligible for award. As part of this evaluation the Government reserves the right to review any sources or people the Government determines reliable including those sources which relate to past performance.

Although the Government intends to award a purchase order as a result of this solicitation, the Government reserves the right to reject any and all quotes received and not award any item or items from this solicitation.

Technical Requirements

Technical capability shall be established by submittal of information that clearly demonstrates that the offeror possesses the necessary qualifications to perform the required Preventive and Corrective Maintenance set forth in the Statement of Work.

The Government will evaluate the Quoter’s Technical Capability to determine acceptability of the quote. Technical acceptability will be evaluated on an Acceptable/Unacceptable basis.

To be technically acceptable, the quoter must:

• comply with the requirements of law, regulation, and all conditions set forth in this solicitation.

• be an established provider of Elevator Maintenance Services, with valid/current training, certification, and work experience.

• clearly demonstrate their ability to perform the Elevator Maintenance Services required by the

Statement of Work.

Past Performance Requirements

The Government will evaluate the offeror’s Past Performance to determine acceptability of the quote in response to this solicitation. Past Performance will be evaluated on an acceptable/unacceptable basis and shall not be rated. The offeror will be evaluated on their past performance record and any other relevant information obtained from available sources which may include: Supplier Performance Risk System

(SPRS), the Contractor Performance Assessment Reporting System (CPARS) at https://www.cpars.gov;or other databases.

In the case of a supplier without a record of relevant past performance history in SPRS for the PSC of the supplies being purchased, the supplier will not be evaluated favorably or unfavorably for its past performance history. In the context of acceptability/unacceptability, “unknown” shall be considered acceptable.

FAR 52.212-3 Offeror Representations and Certifications – Commercial Products and Commercial Services

Offerors must complete Representations and Certifications at 52.212-3 in the System for Award Management prior to submission or provide a completed copy with quote submission.
