About this file
This document contains a Justification and Approval for a single source acquisition and a related Notice of Intent to sole source a contract. The Naval Facilities Engineering Command Southwest requires original equipment manufacturer certified repair services and certified OEM parts to inspect, troubleshoot and repair five government-owned Link-Belt cranes. The scope of work includes resealing hydraulic cylinders and overhauling winches. Per the NAVFAC equipment manual, all maintenance on Link-Belt cranes must be performed by an OEM certified dealer using OEM parts. Historical repairs and market research show Nixon-Egli Equipment Company as the only authorized Link-Belt dealer in California equipped to perform this work. Responses to the Notice of Intent are due by June 1, 2022 and award is anticipated on or around June 16, 2022 to Nixon-Egli for approximately 90 days. The total estimated value is $129,400.

Revised December 2010
All personnel responsible for developing, reviewing and approving a single source determination shall ensure that sound business judgment is applied in researching, documenting and approving such actions.
The rationale for a single source determination is not constrained by this form. If filled out electronically, the form will expand to the written narrative. If not available electronically, the drafter shall attach continuation sheets to ensure rationale is fully supported.
SIMPLIFIED ACQUISITION PROCEDURES (SAP)
SINGLE SOURCE DETERMINATION FOR ACQUISITIONS NOT EXCEEDING THE SIMPLIFIED ACQUISITION
THRESHOLD AS DEFINED IN FAR 2.101
SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER (within its warrant authority) DETERMINES THAT ONLY ONE SOURCE IS AVAILABLE IAW FAR 13.106-1(b). THIS DETERMINATION SHALL BE SUPPORTED WITH FULL JUSTIFICATION FOR SINGLE SOURCE FROM THE CUSTOMER. THE CUSTOMER SHALL PROVIDE THE FOLLOWING INFORMATION:
QUOTE/SOLICITATION NUMBER: (1) $39,000.00, (2) $55,000.00, (3) $17,000.00, (4) $9,200.00, (5) $9,200.00.
ESTIMATED AMOUNT (Not exceeding $250,000): $129,400.00
DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED AND THE INTENDED USE:
Naval Facilities Engineering Systems Command Southwest (NAVFAC SW) requires Original Equipment Manufacturer (OEM) certified repair services and certified OEM parts on five (5) government-owned Link-Belt Cranes, ((3) RTC-80100, (1) RTC-80110 and (1) HTC-3140). Scope of work:
Contractor shall provide all coordination, equipment, labor, management, materials and parts, supervision, supplies, tools, facilities, and transportation necessary to accomplish inspection, troubleshooting and repair of the following:
1) Crane #82-05737: Reseal (3) telescope cylinders
2) Crane #82-05739: Reseal (3) telescope cylinders, and overhaul/rebuild (2) winches
3) Crane #82-05758: Reseal (1) single telescope cylinder
4) Crane #82-05734: Reseal center hydraulic swivel
5) Crane #82-05772: Reseal center hydraulic swivel
UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR
SERVICES CAN BE USED:
Per the NAVFAC P-307, Management of Weight Handling Equipment Manual (P-307): All work, repairs, and services required on Link-Belt cranes are to be performed by an OEM certified/authorized dealer. Additionally, per P-307, all load-controlling parts that require replacement, must be replaced with OEM parts. Use of non-OEM parts would be incompatible to the existing systems on the cranes, which could result in component and/or system failures. Link-Belt identifies Nixon-Egli Equipment Company (Nixon-Egli) as the only authorized distributor and service provider in California.
REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES:
Historical repairs and market research verified Nixon-Egli as the only qualified vendor to perform the repairs to these government-owned Link-Belt RTC-80100, RTC-80110 and HTC-3140 cranes. Nixon-Egli is the only authorized dealership on the west coast that is certified and equipped to perform maintenance services with the required tools, equipment, and skilled/trained technicians. Their location in Ontario, California is the authorized service location within closest to the San Diego areas that can fulfill this requirement.
EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN
COMPETITION HAS NOT BEEN DEVELOPED OR IS NOT AVAILABLE:
In accordance with FAR 5.2, Synopses of Proposed Contract Actions, and as required by the Small Business Act (15 U.S.C. 637(e)) and 41 U.S.C.
1708, NAVFAC SW will post an approved sole source J&A, via SAM.gov, to improve small business access to acquisition information and enhance competition by identifying contracting and subcontracting opportunities. While an adequate scope of work exists, NAVFAC SW has determined that use of competitive means would not only result in unacceptable delays in completing the required scope of work, but would be futile as the maintenance of these cranes are proprietary and only Nixon-Egli is authorized to perform these services in California.
PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO
COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED:
This is a one-time procurement for urgent crane repair services. Once completed, these services will not be required again for several years. If NAVFAC SW determines that additional Link-Belt crane repairs are required beyond the scope of this contract, a competitive solicitation will be issued to determine whether other sources with appropriate qualifications are able to meet the requirement.
I certify that the statements above are complete and correct to the best of my knowledge.
