About this file
This is a Compliance Certification Form from the City of New Smyrna Beach, Florida, related to the procurement process for the elevation of six flood-prone single-family homes in Special Flood Hazard Areas. The project, funded through FEMA's Hazard Mitigation Grant Program, requires bidders to certify their affirmative efforts to include minority business enterprises (MBEs), women's business enterprises (WBEs), veteran-owned businesses (VOBs), and labor surplus area firms (LSAFs) in project execution. The certification encompasses six properties located at 455 DeSoto Drive, 645 Goodwin Avenue, 647 Goodwin Avenue, 508 South Indian River Road, 529 South Peninsula Avenue, and 640 South Pine Street. A non-mandatory pre-bid meeting is scheduled for December 9, 2025, at 2:00 PM via Microsoft Teams, with written questions due by December 18, 2025, at 5:00 PM. Bids are due electronically by January 8, 2026, at 2:00 PM, with bid opening at 3:00 PM the same day. Work must be completed by October 31, 2026, in compliance with FEMA grant requirements and applicable building standards.
The compliance form requires bidders to document affirmative steps including placing qualified MBEs/WBEs/VOBs/LSAFs on solicitation lists, actively soliciting these enterprises as potential sources, dividing project requirements into smaller tasks when economically feasible, establishing delivery schedules that encourage participation, and utilizing assistance from organizations such as the Small Business Administration. The requirement does not mandate set-asides but rather encourages documentation of affirmative action efforts. The project is 75% federally funded through FEMA's Hazard Mitigation Grant Program, with the remaining 25% funded by the City of New Smyrna Beach and participating homeowners. Contractors must provide bid security equal to 10% of the total bid amount, maintain active registrations with the Florida Department of State and Sam.Gov, and comply with E-Verify requirements. Liquidated damages are assessed at $1,694 per calendar day for work not completed by the October 31, 2026, deadline. Required insurance includes Workers' Compensation, Commercial General Liability ($1,000,000 per occurrence), Automobile Liability ($1,000,000 combined single limit), and Professional Liability ($1,000,000).

COMPLIANCE WITH 2 C.F.R. §200.321:
"Contracting with small and minority business enterprises (MBEs), women's business enterprises (WBEs), veteran-owned businesses (VOBs), and labor surplus area firms (LSAFs)"
The undersigned bidder hereby certifies that __________________________________ has taken (Name of Business) the next affirmative steps, if subcontractors are to be used, to ensure that MBEs/WBEs/VOBs/LSAFs are used, whenever possible:
i. Placing qualified MBEs/WBEs/VOBs/LSAFs enterprises on solicitation lists;
ii. Assuring that MBEs/WBEs/VOBs/LSAFs are solicited whenever they are potential sources;
iii. Dividing total requirements, when economically feasible, into smaller tasks or quantities to permit maximum participation by MBEs/WBEs/VOBs/LSAFs (however, this requirement does not authorize the City to break a single project down into smaller components in order to circumvent the micro-purchase or small purchase thresholds so as to utilize streamlined acquisition procedures (e.g. "project splitting");
iv. Establishing delivery schedules, where the requirement permits, which encourage participation by MBEs/WBEs/VOBs/LSAFs; and
v. Using the services and assistance, as appropriate, of such organizations as the Small
Business Administration and the Minority Business Development Agency of the Department of Commerce.
The requirement outlined above does not impose an obligation to set aside either the award of a subcontract to MBEs/WBEs/VOBs/LSAFs. Rather, the requirement only encourages carrying out and documenting the affirmative steps identified above.
As the person authorized to sign this statement, I certify that this firm has complied fully with the above requirements.
