About this file
This is a compliance certification form from the City of New Smyrna Beach, Florida, related to a Hazard Mitigation Grant Program (HMGP) project for the elevation of six flood-prone single-family homes located in Special Flood Hazard Areas. The project requires contractors to provide comprehensive turnkey services including structural assessments, boundary surveys, geotechnical assessments, construction plans, permitting, utility disconnection and reconnection, and elevation of structures to 10 feet above existing ground level. The six properties are located at 455 DeSoto Drive, 645 Goodwin Avenue, 647 Goodwin Avenue, 508 South Indian River Road, 529 South Peninsula Avenue, and 640 South Pine Street. A non-mandatory pre-bid meeting is scheduled for December 9, 2025, at 2:00 PM via Microsoft Teams, with written questions due by December 18, 2025, at 5:00 PM through the City's eProcurement portal. Bids are due electronically by January 8, 2026, at 2:00 PM, with bid opening at 3:00 PM the same day, and all work must be completed by October 31, 2026.
The compliance form requires all bidders to certify that they have taken affirmative steps to include minority business enterprises (MBEs), women's business enterprises (WBEs), veteran-owned businesses (VOBs), and labor surplus area firms (LSAFs) as subcontractors whenever possible, including placing these enterprises on solicitation lists, soliciting them as potential sources, dividing work into smaller tasks when economically feasible, and establishing schedules that encourage their participation. The project is 75% federally funded through FEMA's Hazard Mitigation Grant Program, with the remaining 25% provided by the City of New Smyrna Beach and homeowners. Contractors must provide bid security equal to 10% of the total bid amount and maintain insurance coverage including Workers' Compensation, Commercial General Liability ($1,000,000 per occurrence), Automobile Liability ($1,000,000 combined single limit), and Professional Liability ($1,000,000). Additional requirements include Florida Department of State registration, Volusia County licensure, active Sam.Gov registration, and E-Verify compliance, with liquidated damages set at $1,694 per calendar day for work not completed by the deadline.

COMPLIANCE WITH 2 C.F.R. §200.321:
"Contracting with small and minority business enterprises (MBEs), women's business enterprises (WBEs), veteran-owned businesses (VOBs), and labor surplus area firms (LSAFs)"
The undersigned bidder hereby certifies that __________________________________ has taken (Name of Business) the next affirmative steps, if subcontractors are to be used, to ensure that MBEs/WBEs/VOBs/LSAFs are used, whenever possible:
i. Placing qualified MBEs/WBEs/VOBs/LSAFs enterprises on solicitation lists;
ii. Assuring that MBEs/WBEs/VOBs/LSAFs are solicited whenever they are potential sources;
iii. Dividing total requirements, when economically feasible, into smaller tasks or quantities to permit maximum participation by MBEs/WBEs/VOBs/LSAFs (however, this requirement does not authorize the City to break a single project down into smaller components in order to circumvent the micro-purchase or small purchase thresholds so as to utilize streamlined acquisition procedures (e.g. "project splitting");
iv. Establishing delivery schedules, where the requirement permits, which encourage participation by MBEs/WBEs/VOBs/LSAFs; and
v. Using the services and assistance, as appropriate, of such organizations as the Small
Business Administration and the Minority Business Development Agency of the Department of Commerce.
The requirement outlined above does not impose an obligation to set aside either the award of a subcontract to MBEs/WBEs/VOBs/LSAFs. Rather, the requirement only encourages carrying out and documenting the affirmative steps identified above.
As the person authorized to sign this statement, I certify that this firm has complied fully with the above requirements.
