Addendum to 52.212-2 Evaluation- Commercial Products and Commercial Services (Nov 2021)
Basis for Contract Award: This is a subjective tradeoff in which competing Offerors’ technical capability and past performance history, when combined, are equal and significantly more important than price considerations.
By submission of its proposal, the Offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or subfactors. Failure to meet any one requirement may result in the submitted proposal being determined unacceptable on a technical basis. Offerors must clearly identify any exceptions to the RFP terms and conditions and provide a complete accompanying rationale. While the Government will strive for maximum objectivity, the evaluation process, by its nature, is subjective; therefore, professional judgment is implicit throughout the entire process.
Evaluation Factors for Award: The following evaluation factors and subfactors will be used to evaluate each proposal. The award will be made to the proposal that provides the best value to the Government, rated against the following factors and subfactors. Technical capability and past performance history, when combined, are equal and significantly more important than price considerations.
Factor 1 - Technical Capability Subfactor I - Staffing Plan Subfactor II – Maintenance Plan Subfactor III – Environmental Compliance Plan Factor 2 – Past Performance Subfactor I – Past Performance Information Form Subfactor II – CPARS Factor 3– Price

The Government’s Evaluation team shall evaluate the Technical Evaluation factor on an Acceptable or Unacceptable basis, assigning one of the ratings described below for each subfactor. Offerors that fail to clearly address any of the following requirements may receive an Unacceptable rating for a subfactor. Any subfactor under Factor 1: Technical Capability evaluated as “Unacceptable” will render the entire proposal unacceptable and, therefore, unawardable. Only those proposals determined to be technically acceptable will be considered for award.
Technical Risk Ratings Rating Description
Acceptable Proposal meets the requirements of the solicitation, with a low to moderate risk of unsuccessful contract performance.
Unacceptable Proposal does not meet the requirements of the solicitation and/or there is a high risk of unsuccessful contract performance.
*Low risk has little potential to disrupt schedule, increased cost, or degradation of performance. Normal Contractor effort and normal Government monitoring will likely be able to overcome any difficulties.
*Moderate risk can potentially disrupt schedule, increased cost, or degradation of performance. Special Vendor emphasis and close Government monitoring will likely be able to overcome difficulties.
*High risk has a strong potential to cause significant disruption of schedule, substantial cost increases, or severe degradation of performance. Even with extensive Vendor emphasis and continuous government oversight, it is unlikely that these difficulties can be effectively mitigated, creating a high probability of unsuccessful contract performance.
Factor 2: Past Performance
There are two aspects to the Past Performance evaluation: Recency and Relevancy. Past Performance evaluation results in an assessment of the offeror’s probability of meeting the RFP requirements. The Government will seek Recent and Relevant Past Performance information on all Offerors.
PPIFs will first be evaluated for Recency. To be Recent, the effort must be ongoing or completed within the past three (3) years from the date of issuance of this RFP. Past Performance information that fails this condition will not be evaluated. The government will only review the first five (5) PPIFs received for a given Offeror, based on the time that a given PPIF reaches the initial point of entry to the Government infrastructure.
PPIFs will then be reviewed for Relevancy. Relevant Past Performance demonstrates experienced operation and maintenance of wastewater treatment plants with a total contract dollar value of at least $500,000.00 and having similar complexity and function to the subject requirement. PPIFs and information obtained from other sources will be used to establish the Relevancy of Past Performance. The Government is not bound by the Offeror’s opinion of Relevancy. Offerors are responsible for tracking and ensuring the PPIFs are received prior to the RFP deadline.
Subfactor I: Past Performance Information Form (PPIF)
1. Did the Offeror have any PPIF references submitted.
2. Did the PPIF identify Recent and Relevant service contracts performed within three (3) years of the issuance date of this RFP.
3. Points of contact listed on the PPIF will be contacted. Information gathered will supplement the technical capability rating.
The Government’s evaluation team shall evaluate Past Performance on a Relevancy basis, assigning one of the ratings described below for each subfactor. The ratings “Very Relevant” and “Relevant” will be deemed Acceptable. The ratings “Somewhat Relevant” and “Not Relevant” will be deemed Unacceptable. Any subfactor under Factor 2: Past Performance evaluated as “Unacceptable” will render the entire proposal Unacceptable and, therefore, unawardable. Only those Proposals determined to be Acceptable will be considered for award.
Past Performance Relevancy Rating
Rating Definition
Acceptable
Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Unacceptable
Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.
Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
In the case of Offerors for which there is no information on past contract performance or where past contract performance information is not available, the Offeror may not be evaluated favorably or unfavorably. In this case, the Offeror’s Past Performance is unknown and assigned a Performance Confidence rating of Neutral. A strong record of Relevant Past Performance may be considered more advantageous to the Government than a “Neutral Confidence” rating.
Subfactor II: CPARS
1. All offerors found technically acceptable in FACTOR 1: Technical Capability, and FACTOR 2 - Subfactor I: PPIFs, will be assessed in CPARS. The Government will be reviewing the Vendor Performance Assessment Reporting System (CPARS). The categories reviewed in CPARS will be:
Technical/Quality of Product or Service; Schedule/Timeliness; Management or Business Relations; and Regulatory Compliance. The Government will review reports that are recent and relevant to this current requirement based on the previously defined criteria for each.
CPARS reports are rated on a scale from Unsatisfactory, Marginal, Satisfactory, Very Good, and Exceptional.
The Government’s evaluation team shall evaluate on an Acceptable or Unacceptable basis. Only those proposals determined to be Acceptable on Past Performance/ CPARS basis will be considered for award. In the case of Offeror’s for which there is no information on past contract performance whatsoever, the Offeror may not be evaluated favorably or unfavorably. In this case, the Offeror’s past performance is unknown and is assigned a Performance Confidence rating of Neutral. A strong record of Relevant Past Performance will be considered more advantageous to the Government than a “Neutral Confidence” rating
CPARS Ratings Rating Description
Acceptable Final CPARS rating is Satisfactory, Very Good, and Exceptional in a majority of scored categories. This will be reviewed to determine if there are outliers or significant information in data set.
Unacceptable Final CPARS rating is Unsatisfactory and Marginal in a majority of scored categories.
This will be reviewed to determine if there are outliers or significant information in data set.
Factor 3: Price
1. Did the Offeror submit a Pricing Worksheet using Attachment 2.
2. Does the pricing information submitted in the proposal represent realistic and balanced figures.
The government will evaluate all CLINs for purpose of determining award in accordance with the evaluation criteria outlined in this solicitation. These CLINs will be evaluated to determine if prices are Unbalanced.
Unbalanced pricing occurs when the prices of one or more line items are significantly overstated or understated, despite an acceptable total evaluated price. Offers may be rejected if it is determined there is a lack of Balance in the proposed pricing to the Government.
For a price to be reasonable, it must represent a price to the Government that a prudent person would pay in the conduct of competitive business. The Government will determine prices Fair and Reasonable through the use of one or more of the price analysis techniques at FAR 13.106-3(a).
These CLINs (0004, 1004, 2004) will be evaluated for reasonableness, balance; however they will NOT be included in the total evaluated price. Excluded CLINs will not impact total evaluated price but may be considered for responsibility determinations, price reasonableness, and overall assessment of the offeror’s understanding of the requirement.
The six-month Option to Extend Services will be calculated by dividing the proposed total of option year two by two. Offerors shall not submit pricing for the six-month Option to Extend Services. Any pricing submitted for the six-month Option to Extend Services will not be utilized for either Price Analysis or any potential Award. The six-month extension of services is IAW FAR 52.217-8, "Option to Extend Services". The six-month extension of services is not to be considered part of any option period and will be a separate Option exercised if it is utilized. Offerors are not required to submit pricing for a six-month extension of services.
Evaluation of Options or Optional CLINs shall not obligate the Government to exercise such Options or Optional CLINs.
