52.212-2 Evaluation-Commercial Products and Commercial Services. Nov 2021

Evaluation-Commercial Products and Commercial Services (Nov 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(1) Price: The quotations will be evaluated according to their total evaluated price (TEP) as identified by contract line-item total pricing provided from Attachment 02 – TOPR Pricing.

The Government will evaluate offers for award purposes by adding the total price for all CLINs for the required period of performance. The pricing used for the TOPR must match the unit price data submitted on this solicitation form. If the pricing does not match, the offeror will be found non-responsive.

All future orders off this IDIQ will be placed using the unit pricing as quoted on page 6 - 8 of this solicitation. The pricing information from the successful offeror's quote will be incorporated into the IDIQ. Each year will equate to the next calendar year (for example: CLINs 00XX will be CY26, CLINs 10XX will be CY27, and so on). This pricing shall be all inclusive for maintenance, supervision, overhead, profit, G&A, etc. All future task order pricing must match the successful offeror's quoted unit pricing for the base and all option periods.

The offeror’s price quotation will be evaluated using one or more of the procedures and techniques defined in FAR 13.106-2 and FAR 13.106-3 in order to determine price reasonableness. For a price to be reasonable, it must represent a price that a prudent person would pay in the conduct of competitive business. Normally, price reasonableness is established through competitive quotations as described in FAR 13.106-3. Additionally, the government may evaluate the pricing for option years to ensure that pricing is not unbalanced. An offeror submitting unbalanced pricing will be determined to be non-responsive and ineligible for award.

(2) Technical Capability: The Vendor shall submit a plan describing how they will meet the requirements outlined in the Performance Work Statement (PWS). The Vendor shall demonstrate that they can provide all content within the PWS.

Quotes will be evaluated to be technically acceptable or not technically acceptable based on the evaluation factors listed above.

(a) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(b) Basis for Award. If the lowest total evaluated priced offeror receives an "Acceptable" technical rating, evaluation of that quote is complete, award will be made to that offeror, and the evaluation process will stop. If the lowest total evaluated priced offeror receives an "Unacceptable" technical rating, evaluation of that quote will stop. In that instance, the second lowest total evaluated priced offeror will be evaluated using the methodology above and the process will continue (in order by price) until an offeror is evaluated to have an "Acceptable" technical rating, or until all offerors are evaluated.

Clarifications conducted to resolve minor or clerical errors will not constitute discussions and the Contracting Officer reserves the right to award a contract without the opportunity for a quote revision. The Government intends to award a contract without discussions (while keeping with FAR Part 12, 13, and 19).
