(End of provision Addendum to 52.212-1)
Provision 52.212-2, Evaluation-Commercial Products and Commercial Services applies to this procurement. The evaluation criteria included in paragraph (a) of the provision are as follows:
EVALUATION CRITERIA
The Government intends to award a single firm fixed price purchase order (PO) from this solicitation using simplified acquisitions procedures for Certain Commercial Products and Commercial Services in accordance with FAR subpart 13.5. The Government reserves the right not to award a PO and to make an award without discussions based solely upon initial quotes. Contractors are strongly encouraged to submit their best technical solutions and price in response to this RFQ.
Basis for Award:
The government will make an award based on best value to the vendor with the proposed solution that is most advantageous, price and other factors considered. When combined, non-price factors 1-3 are significantly more important than factor 4. Upon evaluation, if a quotation is deemed Unacceptable on any given non-price factor, that quotation may not be evaluated further by the Government
Once the Government determines the quoter that is the best-suited (i.e., the apparent successful quoter), the Government reserves the right to communicate with only that quoter to address any remaining issues, if necessary, and finalize a contract with that quoter. These issues may include technical and price. If the parties cannot successfully address any remaining issues, as determined pertinent at the sole discretion of the Government, the Government reserves the right to communicate with the next best-suited quoter based on the original analysis and address any remaining issues. Once the Government has begun communications with the next best-suited quoter, no further communications with the previous quoter will be entertained until after the task order has been awarded. This process shall continue until an agreement is successfully reached and a contract is awarded.
Evaluation Factors:
Factor 1: Technical and Organizational Approach: The Government will evaluate the adequacy of the proposed solution to meet solicitation requirements, and the extent to which the offer demonstrates a sound Technical and Organizational Approach. In particular, the contractor’s methodology to secure subcontractor for review of plans as well as execution after mobilization, methodology to organize and run review meetings with all direct stakeholders to this project, management of quality control of third-party vendors (machine shops, mobilized work force), and demonstrated level of understanding of the task at hand will be considered.
Factor 2: Technical Experience: The Government will evaluate the Offeror’s technical experience to determine the level of experience the Offeror possesses in providing the requirements as defined in the SOW. The degree of relevance between the technical experience described and the work required in the SOW shall be considered, particularly the familiarity of all technical steps included but not limited to the ones already identified in Attachment B TCT Replacement Procedure, proven relevant experience in a test reactor or comparable environment, and the ability to commit to training requirements.
Factor 3: Past Performance: Evaluation of this factor will be based on information contained in the technical portion of the proposal, CPARS, and information provided by the Offeror’s identified references. The Government will evaluate past performance information by contacting the references, including NIST references if applicable, for feedback on the Offeror’s performance. The Government may also consider other available information in evaluating past performance and will assign a neutral rating if the Offeror has no relevant past performance information.
Factor 4: Price: Price will be evaluated on quotations that are acceptable in the non-price factors within the solicitation. The evaluation will determine whether the proposed prices are fair and reasonable in relation to the solicitation requirements. A price realism analysis will not be conducted. Prices must be proportionate with the technical portion of the quotation.

A revenue ruling is the conclusion of the IRS on how the law is applied to a specific set of facts. The work stoppage shall remain in effect until the lapse is resolved and notification is provided via the NIST website at https://www.nist.gov/ and/or the NIST operating status lines. Additionally, Contractors are encouraged to monitor public broadcasts or the Office of Personnel Management’s website at www.opm.gov for the Federal Government operating status.
