COMBINED SYNOPSIS / SOLICITATION

70Z08021R15001B00

154’ FRC MTU DIESEL ENGINE OVERHAULS

NOTICE FOR FILING AGENCY PROTESTS

United States Coast Guard Ombudsman Program

It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time- consuming litigation.

OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO).

Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative

Dispute Resolution (ADR) forum rather than filing a protest with the GAO or some external forum.

Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the Contracting Officer or Ombudsman.

Informal Forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer. If the Contracting Officer is unable to satisfy their concerns, interested parties are encouraged to contact the U.S. Coast Guard Ombudsman for Agency Protests. Under this informal process the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable).

Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions. If the protester’s concerns are unresolved, an Independent Review is available by the

Ombudsman. The protester may file a formal agency protest to either the Contracting Officer or as an alternative to that, the Ombudsman under the OPAP program.

Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103(d) (2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. To be timely protests must be filed within the period specified in FAR 33.103(e).

Formal protests filed under the OPAP program should be submitted electronically to OPAP@uscg.mil and the Contracting Officer or by hand delivery to the Contracting Officer.

Election of Forum. After an interested party protests a Coast Guard procurement to the Contracting

Officer or the Ombudsman, and while the protest is pending, the protester agrees not to file a protest with the GAO or other external forum. If the protest is filed with an external forum, the agency protest will be dismissed.

The Ombudsman Hotline telephone number is 202.372.3695.

Attachment (2) is the Offeror’s Proposed Delivery Schedule. The Government will evaluate equally, as regards to time of delivery, offers that propose delivery of each quantity within the applicable delivery period specified above. Offers that propose delivery that will not clearly fall within the applicable required delivery period specified above, may be considered nonresponsive and may be rejected. The

Government reserves the right to award under either the required delivery schedule or the proposed delivery schedule, when an offeror offers an earlier delivery schedule than required above. If the offeror proposes no other delivery schedule, the required delivery schedule above will apply.

(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed, or otherwise furnished to the successful offeror, results in a binding contract. The Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor’s date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or

(2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term “working day” excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer may be considered nonresponsive and may be rejected.

(End of Clause)

BEYOND ECONOMICAL TO REPAIR (BER): The Contracting Officer will determine if any unit is BER. The Contractor will be instructed to complete Standard Form (SF) 1424 Inventory Disposal

Report. BER units will be scrapped at the Contractor’s facility at no charge. The Contractor is required to remove all Government markings and comply with all environmental regulations.

VIII. FAR 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS (JUN 2020)

APPLIES TO THIS ACQUISITION AND IS INCORPORATED BY REFERENCE.

(ADDENDUM)

A. To ensure timely and equitable evaluation of the proposal, the offeror must follow the instructions contained herein. The proposal must be complete, self-sufficient, and respond directly to the requirements of this solicitation.

B. The contracting officer has determined there is a probability of adequate price competition in this acquisition. Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer's opinion, adequate price competition exists no additional data will be requested. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; offeror may be required to submit cost and pricing data to the extent necessary for the contracting officer to determine the reasonableness and affordability of the price.

ALL CONTRACTORS ARE RESPONSIBLE FOR VERIFYING RECEIPT OF THEIR

PROPOSALS.

C. This is a two Phase solicitation.

Phase I

Factor 1 – Demonstrated Prior Experience

Phase II

Factor 2 – Oral Presentations

Factor 3 – Price

Phase II will include offeror oral presentations as described bellow. After the Government completes evaluation of Phase I, Factor 1 – Demonstrated Prior Experience, Offerors will receive an advisory notification via email from the Contracting Officer to the Offeror point of contact listed on the cover page. Offerors who rate most highly for Factor 1 will be advised to proceed to Phase II. Offerors who were not among the most highly rated will be advised not to proceed to Phase II as they are unlikely to be viable competitors, along with the general basis for that opinion. Offerors will be advised that their

Factor 1 evaluation results will carry forward to Phase II and will be considered in the best value award decision. The intent of this advice is to minimize proposal development costs for those Offerors with little chance of receiving an award. This will be a recommendation only and discontinuing the pursuit of the requirement following the notification is voluntary.

The Government does not intend to provide debriefings after the completion of the advisory down select notifications. Failure to participate in Phase I precludes further consideration of an Offeror. Phase II

Offeror submissions will not be accepted from Offerors who have not submitted Phase I requirements by the due date and time provided for in this solicitation.

The advisory notification will include the Phase II submissions due date and include the date and time for the Offeror’s oral presentation as well as oral presentation guidance and the rules of engagement for oral presentations. The order in which Offerors are scheduled for oral presentations will be randomly selected by the Government. Oral presentations will be conducted using Zoom, MSTeams or similar video conferencing platform. The oral presentations may or may not be recorded by the Government.

The advisory notification will include instructions on how to join the oral presentation meeting established by the Government. The Phase II due date will be approximately two weeks from the date of the advisory notification and Phase II submissions will be due prior to oral presentations. Offerors shall adhere to the format for oral presentation guidance in addition to the rules of engagement for oral presentations.

D. Submission of offers. Submit signed and dated Phase I proposals electronically to David Packard at

David.A.Packard@uscg.mil and Jennifer Lucas at Jennifer.B.Lucas@uscg.mil on or before 28 January

2021, by 3:00 PM Eastern Time. Each submitted electronic file of the proposal shall be submitted in

Adobe PDF and ensure it is compatible with Microsoft Office 2016. It is the sole responsibility of the

Offerors to ensure that the electronic media submitted is virus-free and can be opened and read by the

Government. The deadline for submission of the electronic copy of the proposal is firm. As the closing date and time draws near, heavy traffic on the web server may cause delays. Offerors are strongly encouraged to plan and leave ample time to prepare and submit their proposals. Early submission of proposals is encouraged. Documents may have to be sent in separate emails due to USCG email size restrictions, ZIP files are not permitted. The electronic copy of the proposal will constitute the official copy for timely receipt. Late submissions will not be accepted.

All offerors submitting proposals must be registered and active in System for Award Management

b. Quality assurance and control plans

c. Personnel recruitment and training plans

IX. FAR 52.212-2 EVALUATION – COMMERCIAL ITEMS (OCT 2014) (ADDENDUM)

The Government intends to award a contract based on the initial offers and without discussions, although clarifications (as defined in FAR 15.306(a) may be needed). If discussions are held, the

Government will conduct discussions with all companies that have been found to be technically acceptable and request final proposal revisions. A Pre-award Site Survey may be required prior to award.

In evaluating Contractors past performance, general trends in a Contractor’s performance will also be considered. Contractors may provide information on problems encountered during the performance of any contract/order and any corrective actions the contractor made. In the case of a contractor without a record of relevant past performance or for whom information on past performance is not available, the contractor may not be evaluated favorably or unfavorably on past performance.

A. The Government intends for the oral presentation to be an interactive dialogue between the Offeror and the Government. These exchanges are viewed as a component of the oral presentation itself and do not constitute discussions. The Government will not ask questions that will invite or allow the Offeror to change its offer. The Offeror shall not volunteer any information that might be construed as changing its offer. Oral presentations are distinct from the Government’s reserved right to conduct discussions.

The Government intends to make an award based on initial proposals and Offerors are encouraged to ensure their initial proposal is their best and final.

B. The Government will award contracts resulting from this solicitation to the responsible offerors whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(i) Factor 1 – Demonstrated Prior Experience

(ii) Factor 2 – Oral Presentations

(iii) Factor 3 – Price

Order of Importance – Factor 1 is more important than Factor 2. When combined, Factors 1 and

2 are more significantly important than Factor 3.

C. Evaluation of Offers.
