PL352 TASK ASSIGNMENT 20
TASK DESCRIPTION
Fire Management Restoration following Hurricane Michael
1. TASK DESCRIPTION: FORESTECH Consulting, Inc. (dba F4 TECH) (hereinafter referred to as the “Contractor”) will perform the following services, actions, and/or tasks in completing the proposed work for the Department of Environmental Protection (hereinafter referred to as the “Department”).
Goals of this work are to regain the ability to manage frequent prescribed fire, and control wildfires on lands managed by the Department. Restoration of fire-dependent natural communities will likely be a decade or longer process of reducing or removing these fuels. Before restoration can begin, fire breaks must be re-established, fuels must be managed, and access re-opened. In order to regain the ability to perform prescribed burning and protect the park or neighbors from wildfire threats, firelines and interior roads must be functional along with a defensible space created. Having defensible space is imperative for the safe, effective, and efficient management of these natural communities. A defensible space is simply a width of low or no fuels to carry a fire. The width of this space will vary depending upon the height and density/volatility of adjacent trees and brush, as well as groundcover conditions, topography, vegetation components, and imperiled/rare species occurrences.
Fire management restoration projects are located within properties being managed by the Department.
Example activities are intended to re-open and re-establish firelines, lessen or remove fuel loading, and repair access roads, utilizing a mixture of equipment and manpower to conduct tree cutting/pickup/cleanup; stump, tree and brush removal; disposal of vegetation through prescribed/controlled burning or hauling away; grading/smoothing soil; seeding; and preparing a mineral soil firebreak. It may be necessary to relocate property lines due to the amount of damage to vegetation and boundary monumentation; this may require the assistance of professional surveyors/mappers.
Protection of cultural resources may require professional assessments prior to commencement of this work. This description list is not all encompassing; the Department reserves the right to utilize all available land management strategies to conduct this work in the most effective and efficient means possible.
The Department recognizes the total cost of all Projects potentially represents a greater dollar amount than the not-to-exceed value of this Task Assignment. Therefore, all Projects may not be implemented unless additional funding is allocated.
The Department will prioritize fire management restoration projects and tasks prior to submitting these projects to the Contractor requesting review, assessment, and possible implementation. The Task Manager will notify the Contractor regarding, which projects are chosen for Contractor activities described herein. This process shall allow the Department and the Contractor the ability to undertake multiple projects at once, and each project to be designed and managed independently with its own timeline for completion. The Department shall approve each action, in writing, prior to the Contractor (or Subcontractor) commencing any work. For example, the Department Task Manager or Contract Manager can approve a subtask on one project, while simultaneously approving a different subtask on another. It is expected that many projects will be in various stages of completion at any point in time.
Completion dates per project will be dictated by mutual agreement between the Department and the Contractor as work progresses. Furthermore, the Department may utilize the Contractor for any or all services listed in Tasks 1.A- 1.D.
A. Project Evaluation
Evaluations are designed to provide the Department with data and information that will help facilitate the decision-making process and support the timely and cost-effective implementation of projects. Evaluation of project data and information may also result in upgrading, downgrading, combining, or even discarding certain projects from further consideration.
DEP Contract PL352, Task Assignment 20, Page 2 of 4
The Department shall notify the Contractor regarding which projects to provide time and materials, not-to-exceed cost estimates to complete Task 1.A. Once received, the Department Task Manager or Contract Manager will review the cost projections and instruct the Contractor to either proceed or terminate its actions on the subject project.
Upon notification from the Department Task Manager or Contract Manager, the Contractor shall perform the following actions for each approved task:
1. Conduct Pre-Planning. Hold meetings with Department field staff to discuss goals for each project and receive pertinent documentation. Summarize meeting events in written format via meeting notes/minutes.
2. Inspect and Evaluate. Determine overall needs for each project and site; verify or estimate quantities, clarify methods, identify obstacles, and provide a written summary of observations, options, and recommendations. The summary will include estimated costs for all necessary labor, materials, equipment, subcontractors, any applicable markup to complete the project. Prices for the Contractor and/or subcontractor(s) to conduct on-the-ground treatments shall be per measurable unit (acre, linear foot, square foot, cubic yard, ton, gallon, etc.) and/or time and materials with a not-to-exceed total cost.
3. Develop and Produce the Scope of Work (SOW) Document. Contractor shall prepare SOW documents that will describe the project and its goals; tasks to be performed with specific instructions on what, where, and when these tasks are to be accomplished; how work will be managed and documented; and contact information for pertinent Department and Contractor staff.
Following the completion of Task 1.A., the Department will consult with the Contractor to discuss associated findings, deliverables, and the probability of project completion. The Department will notify the Contractor regarding which projects, or portions of projects, are approved to proceed.
Conversely, the Department will also notify the Contractor as to which projects are not approved;
the Department has the option of discarding, holding for a later date, re-configuring, or re-evaluating these projects.
B. Provide Cost Estimates and/or Bids to Implement Project(s): The Department Task Manager or Contract Manager will notify the Contractor in writing and identify the projects requiring an all-inclusive, total fixed cost per measurable unit and/or a time and materials estimate with a not-to-exceed total amount per project, to implement work.
Additional documentation may be required depending upon the nature of the work, such as equipment standards, materials specifications, treatment prescriptions, record keeping logs, scale tickets, timber sale settlement statements, etc. These forms or templates shall be supplied to the Contractor simultaneously with the notification to provide a fixed cost per measurable unit and/or a time and materials estimate with a not-to-exceed total amount to implement the specific resource management project(s). The Contractor shall submit to the Department the total cost and timeframe to complete the project. When subcontractors are being utilized, the Contractor shall provide a summary of any pre-bid meetings and bids received, as backup documentation.
Following the receipt of a total cost to implement the actions listed in the SOW (and any backup documentation), the Department shall notify the Contractor in writing regarding its decision to either proceed or cease actions on a particular project or group of projects.
Upon rejecting a project proposal, the Department may take any action available to pursue the project to include re-designing the project, holding until a later date, or utilizing alternative sources.
If approved, the project will move to subtask 1.C.
All costs for work conducted by the Contractor in Tasks 1.A. – 1.B. will be based on time and materials (to include travel) and invoiced monthly.
DEP Contract PL352, Task Assignment 20, Page 3 of 4
C. Implement Project(s): The Department Task Manager or Contract Manager shall notify the Contractor in writing regarding the status of each project considered, e.g., approved, postponed, or cancelled. Prior to the commencement of work, a kickoff meeting involving the Contractor, subcontractor(s), and Department staff will be held on site. Once implementation work on an approved project begins, the Contractor shall provide a periodic status summary or update of project events. The frequency of these “Project Implementation Status Reports” will be determined by the Department Task Manager and the Contractor and will be commensurate with the scope, scale, duration, and current activity level of a subtask supporting the project. For example, timber sale inspections may occur more frequently than those required for herbicide treatments. The Contractor will coordinate with the Department Field Representative (Park Manager, Biologist, or other Department staff as assigned by a Field Office District Chief) concerning project logistics.
All costs for work conducted by the Contractor and/or his assigns in Task Description 1.C. will be based on a total all-inclusive, per measurable unit fixed cost and/or time and materials estimate with a not-to-exceed amount to implement and manage the specific approved Project(s). Depending upon project needs, the Department and Contractor will determine invoicing periods. Most projects will be invoiced monthly, while others may be invoiced more frequently.
D. Project Management: Once projects are approved for implementation or are in the process of being implemented, the Contractor shall coordinate and plan with the Department as needed to manage the implementation of work. The Contractor will also manage the overall services, actions, and/or tasks supporting this task assignment. All costs for work conducted by the Contractor in Task 1.D will be based on time and materials (to include travel) and invoiced monthly.
2. DELIVERABLES: The Contractor shall submit the following deliverables to the Department (electronic documents shall be uploaded to the Department FTP site, or an alternative site agreed upon by the Department and the Contractor).
A. Conduct the Project Inspection and Evaluation: Documentation of this service shall be the summary of observations, options, and estimated costs to complete the project.
Project meeting notes/minutes documentation: For each in-person, or conferenced meeting conducted, the Contractor shall provide the Department with detailed written documentation of meeting events in a format approved by the Department Task Manager or Contract Manager.
SOW documentation: Each SOW prepared shall be submitted to the Department.
B. Implementation of Work: Performance of the services set forth in the SOW. The Contractor shall implement actions as defined in SOWs approved by the Department Task Manager or Contract Manager.
For each Project, the Contractor shall prepare and produce periodic Project Implementation Status Reports which must document the status of all ongoing implementation work related to each Project in this Task Assignment. Report format, frequency, and delivery methods shall be jointly developed by the Department and the Contractor. Additional metrics, reports, or other documentation that verify/quantify implementation of Projects and associated effectiveness will be developed by the Contractor and the Department prior to Project implementation. For example, prescribed burning and timber sale tasks will have unique sets of forms/documents, which will differ greatly from invasive/exotic plant control, and tree/brush removal. All documents supporting a timber sale will be submitted to the Department Task Manager and will include: 1) timber sale bid packages; 2) weekly settlement summary, chain of custody documents, scale tickets, timber Purchaser’s summary, and timber sale payment; 3) weekly concise summary of logging progress; and 4) weekly timber sale inspection forms.
3. TRAVEL: The Contractor shall be authorized to travel in supporting the services, actions, and tasks described above. Pursuant to Paragraph 8.A.4 of the subject Contract, each traveler must complete a Department Voucher for Reimbursement of Travel Expenses form and submit with receipts. Reimbursement shall be made in accordance with Section 112.061, Florida Statues (F.S.). The Contractor understands that no allowances
DEP Contract PL352, Task Assignment 20, Page 4 of 4 shall be made for meals when travel is confined to the city or town of the official headquarters or immediate vicinity (within 15 miles of the city or town of the official headquarter) of the contracted personnel.
4. PERFORMANCE MEASURES: Each deliverable shall be reviewed by the Department Task Manager or Contract Manager to ensure that work was performed as specified above.
5. FINANCIAL CONSEQUENCES: No payment will be made for unsatisfactory deliverables. In the event that a deliverable is deemed unsatisfactory, the Contractor shall re-perform the services needed for submittal of a satisfactory deliverable, at no additional cost to the Department within fifteen (15) consecutive days. If a satisfactory deliverable is not submitted within the specified time frame, the Department may, in its sole discretion, terminate the Contract for failure to perform, or implement other remedies as detailed in Section 12 of the Contract (PL352). The Department reserves the right to terminate this Task Assignment or any portion thereof upon notice to Contractor.
6. COST: As determined by the Department, the Contractor shall conduct and invoice the work outlined herein as an all-inclusive fixed rate per unit cost, and/or on a time and materials basis.
Per the Contract (PL352), the Contractor may utilize subcontractors and may markup subcontractor costs up to five (5%) percent.
Contractor fees under this Task Assignment are determined and approved by the Department per individual Project. Total of all fees shall not exceed $6,000,000.00 (six million and no/100’s) in this Task Assignment.
In the event that costs are anticipated to exceed the identified amount, the Department shall be notified as soon as possible in order to consider a change order.
Current Wage Rates for the Contractor are identified in Attachment B, Response Form of the Contract.
Any additional proposed costs must be reviewed and approved by the Department Task or Contract Manager.
7. PAYMENT: The Contractor shall submit itemized invoices to the Department monthly upon completion and acceptance of each task as identified in the Deliverables. Invoices for project implementation work may be submitted more frequently. Invoiced amounts will be based on the number of hours worked multiplied by the rates identified in Attachment B - Response Form of the Contract, as well as measurable unit fixed cost(s) as approved by the Department.
Partial payments for work implemented shall be available to the Contractor. The amount of work accomplished and payment amount to invoice shall be measured or estimated by the Department Field Representative and the Contractor, documented with signatures, and submitted to the Department Task or Contract Manager for approval and processing.
Payment shall be made pursuant to Paragraphs 7, 8, and 9 of the Contract and any applicable addenda thereto.
Per Section 8, Invoicing Requirements, No. 9 (Retainage) of the Contract, the Department reserves the right to establish and apply Retainage on a Task Assignment.
8. REIMBURSABLES: Specific requirements concerning reimbursable items are detailed in at least three (3) areas of the Contract:
A. Paragraph 8;
B. Attachment B (Response Form); and C. Attachment F (Contract Payment Requirements).
9. TERM: This task assignment shall begin upon execution and terminate June 30, 2020, unless the Department earlier terminates contract PL352 or this task assignment.

ISSUE: Hurricane Michael – Fireline Restoration in District 1 State Parks
SUMMARY: Hurricane Michael’s Category 4 winds caused devastating damage to many State Parks in the Panhandle region. As a result, tree canopies were broken and felled to the forest floor in abundant chaos. These tree tops act as fuel for potential wildfire or prescribed fire, making the safe implementation of a fire regime impossible. Without the regular occurrence of fire, many natural communities would perish and no longer sustain the abundance of biological diversity found in this region of the state.
Our goal is to regain the ability to manage frequent prescribed fire, and control wildfires on our Parks. Restoration of fire-dependent natural communities will likely be a decade or longer process of reducing or removing these fuels. Before restoration can begin, fire breaks must be re-established.
The Division received specific funding for this effort ($11,000,000.00).
KEY DATES: ASAP
ASK: Approve/sign this Task Assignment. Beginning this task will show forward progress on restoration activities. The contractor (F4 Tech) will assist us by hiring subcontractors in multiple parks simultaneously over a short time period in order to regain our ability to manage fire on these state parks. Subcontractors will clear firebreaks, re-open roads, and lower fuel levels where prescribed fire can re-applied / wildfires can be suppressed.
