The project involves improvements to the existing Frank C. Mills Justice Center, including interior renovations and a new multi-story addition, as well as a mixed-use development with retail, office, and residential spaces, an 800+ space multi-level parking deck, and comprehensive streetscape enhancements. The solicitation follows a two-step selection process, with the first step being a qualifications review and the second step involving proposals and interviews. The project has preliminary stated construction cost limitations of $24.7M for the courthouse renovation, $30M for the Annex core and shell, $28M for the parking deck, and $36M for the mixed-use development. The CMAR will be responsible for preconstruction services, including technical review, cost verification, value engineering, and schedule development, with the potential to manage construction based on owner needs and funding availability. The selection will be based on a comprehensive evaluation criteria including stability (20%), experience and qualifications (35%), suitability (45%), and an interview process. The winning firm will be selected based on a total score combining proposal, interview, and pricing components, with the goal of selecting a firm that can effectively manage this complex, phased development project while incorporating sustainable construction practices and supporting local contractors.

B - SOLICITATION OVERVIEW
Construction Manager at Risk (CMAR) Services
The General Services Agency (GSA), on behalf of the Cherokee County Board of Commissioners (County) and the Downtown Development Authority of Canton (DDA) – Owners – is seeking Statements of
Qualification (SOQ) from Construction Managers at Risk with justice facility, parking deck and civic center mixed-use project experience interested in providing comprehensive pre-construction and construction management services for two projects known as Project No. GSA-2025-007 Justice Center Expansion by the County and the North Street Development Gateway Project by the DDA.
1. GENERAL PROJECT INFORMATION
Project Background:
To address the next iteration of growth at the Cherokee County Justice Center Campus at 90 North Street, Canton, GA 30144, the County seeks to undertake improvements to the Frank C. Mills Justice Center circa
1994 (Courthouse) to include selected interior renovations and building system replacements and a new, multi-story addition (Annex) as identified in the Justice Center Space Needs Assessment updated by the
National Center for State Courts earlier this year. See Attachment 1.
The Justice Center Expansion is a component within the site project boundary of the North Street Gateway
Development (NSGD), a mixed-use project led by the DDA. The approximately 6-acre project site is bounded by Brown Street, North Street, the east facades of the Courthouse and its parking deck. Other existing structures and components currently within the project area include the east entry drive, sally port, utility entrances and generator of the Courthouse, Cherokee North Apartment complex, the law office of Bray and Johnson and the property that lies between the apartments and the law office.
The DDA’s scope for the North Street Gateway Development includes a mixed-use building that will contain retail & office space along with residential units, comprehensive streetscape enhancements, a roundabout at the intersection of East Main, Brown and North Streets, utilities and infrastructure, a 800+ space multi-level parking deck to serve both the County Annex as well as the mixed-use development, and approximately 200 surface level parking spaces. The multi-level parking deck will include access to both the mixed-use development, secured access with checkpoint to the County’s Annex building and stormwater detention. Civil design and engineering for the entire site development area (including the
Annex) and the multi-story parking deck will be designed and engineered by the DDA in collaboration with the County and the design professional selected for the Annex. See Attachment 2.
Development Roles and Responsibilities
The County, the City of Canton and the DDA will co-design the North Street architectural façade of the
Annex (and possibly a portion of the east façade); a connection to the mixed-use project’s parking deck;
and the design and coordination of a security screening area within (or possibly adjacent to) the parking deck. The details of the County and DDA current responsibilities are outlined through an intergovernmental agreement which is included as an attachment to this solicitation.
Solicitation 2026-001 | GSA 2026-001 | Construction Manager at Risk (CMAR) Services Page 4 of 21
Authorities Having Jurisdiction
The project area is in the historic district and the water and sewer service areas of the City of Canton.
Although the City of Canton provides zoning, building, permitting, life safety, and preservation control of the project site, the County will provide review, oversight and approval for these tasks for the Annex addition and Mills courthouse renovation.
Project Scope
The CMAR will provide preconstruction services to include technical review, cost verification, cost evaluation, value engineering, schedule development, and schedule evaluation. Additionally, it is anticipated that the CMAR will manage the construction of the project depending on the needs of the
Owners and funding availability. The CMAR must be prepared to develop separate bid packages during construction should it become necessary to meet budget and/or schedule. In addition, the CMAR will be responsible for methods of construction, safety, and the scheduling and coordination of the work of all construction and miscellaneous contracts required for completion of the project within its predetermined budget and schedule. The successful CMAR will be required to work collaboratively with the Owners, Owners’ Design Professional, and other consultants, if engaged.
Project Budget
The preliminary stated construction cost limitation (SCCL) for the Mills Courthouse renovation is $24.7M, and $30M for the Addition (Annex) core and shell. The Annex Tenant/Court Set Upfit SCLs are TBD. The preliminary SCCL for the multi-level parking deck is $28M plus an additional $350K-500K for surface parking. The preliminary SCL for the mixed-use development, comprised of approximately 36,000 SF of office/retail space and 36,000 SF of residential space, is $36M. All budgets are subject to change pending final program, funding availability and/or other circumstances.
It is the Owners’ intent to retain one CMAR and contract separately for their respective scopes of work.
Sustainable Approach
The County requests that the CMAR seek to incorporate sustainable construction practices wherever practically possible within the stated scope and cost limitation; however, compliance with a specific sustainability program is not required and certifications are not sought.
Project Schedule:
The County’s schedule goals for the Justice Center Expansion are as follows:
Phase I: 2026 Addition (Annex) Core and Shell, Selected Mills Courthouse Renovations
(1st floor; East Façade) Begin Construction by late Q2/early Q3
Phase II: 2027 Initial Annex Tenant/Court Set Upfits and Mills Building Renovations
Phase III: 2028 Additional Annex Tenant/Court Set Upfits, as remaining budget permits.
The County’s goal/need for the North Street Development Gateway Project is to begin construction on the parking deck and associated site development for the addition (annex) by late Q2/early Q3 of 2026.
The DDA’s schedule goals for the remaining North Street Development Gateway components are TBD.

Project Management Reporting Systems
CMAR shall provide the Owners access to their Project Management Reporting system for contract administration processes including, but not limited to, Requests for Information, Change Orders, Payment
Applications, Notices of Non-Compliance and Encumbrance Records from award through completion of the warranty period. At the close of the warranty period, access in perpetuity or a digital transmittal of all project management information is required.
Contract Information
Upon award, the successful CMAR firm will work collaboratively with the Owners’ design professionals to develop a schedule for receiving design documents. The estimated percentage of document completion will be communicated to proposers prior to their submission of project proposals. The CMAR firm will assume responsibility for cost of the project construction by issuing a guaranteed maximum price (GMP) based on the design documents, with the support and assistance of the Design Professional. The CMAR will commit to a Guaranteed Maximum Price (GMP) for all construction and site development. The GMP will be a contractual obligation. The CMAR will also develop an overall project schedule, which will also be a contractual obligation. The CMAR will function as a CM-At-Risk (CMAR). During Pre-Construction, the
CMAR will be responsible for pricing, value engineering, and maintainability and constructability issues.
Construction will commence with the release of a distinct work package (or packages) based on the design documents. The CMAR shall competitively select all construction subcontracts and other work appropriate for competitive selection using cost and other factors. The successful CMAR shall not be eligible to bid or enter a contract or subcontract for any of the construction or other services of any nature on the project without the specific approval of the Owners. The Projects will be “Open-Book”. All savings, including unused contingency, will be returned to the Owners.
Firms are encouraged to review and become familiar with the terms and conditions of this agreement.
Firms participating in this procurement process agree to execute the contract form as part of (APPENDIX
“E”: ACCEPTANCE OF COUNTY AGREEMENT).
The contract for CMAR services will be an Actual Cost plus a Fixed Fee not to exceed the Guaranteed
Maximum Price (GMP) utilizing AIA Document A133™ – 2019, Standard Form of Agreement Between
