About this file

This document is a Business Request for GRAMA (Government Records Access and Management Act) Business Confidentiality Claim form issued by the Utah State Archives' Office of the Government Records Ombudsman. The form is designed for contractors or private providers to identify and protect confidential business records or information, specifically addressing trade secrets and commercial financial information as defined under Utah Code §63G-2-305. The form provides a mechanism for businesses to submit a confidentiality claim when sharing sensitive information with governmental entities.

The form outlines the legal requirements for protecting confidential business information, including the need to provide a concise statement of reasons supporting the confidentiality claim. It requires detailed claimant information such as company name, address, representative details, and specific information about which records are being claimed as confidential. The form explicitly notes that making a confidentiality claim does not guarantee protected classification if the government receives a records request, and allows for specifying which pages, paragraphs, and reasons warrant confidential treatment. Additionally, the form includes a checkbox to indicate whether a public (redacted) copy of the records is being provided.

Business Request for GRAMA Business Confidentiality Claim use by contractors or private providers to identify protected records or information

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected.
