About this file

The document is a Claim of Business Confidentiality form submitted to the Utah State Archives Office of the Government Records Ombudsman. The form allows a contractor or private provider to identify protected records or information when submitting documents related to a government contract opportunity. The contract opportunity is the Holden Springs Water Enhancement Project 2024, which is being solicited by the Utah Division of Wildlife Resources. The project involves the installation of approximately 8,250 feet of HDPE Fuseable Pipe and four water troughs.

The document outlines the process for making a confidentiality claim under Utah state law, including the required information and justification that must be provided. It also notes that making a confidentiality claim does not guarantee protected classification if a public records request is received. The form includes fields for the company name, contact information, the governmental entity the claim is being submitted to, the reason for the submission, and a statement of reasons supporting the confidentiality claim.

Business Request for GRAMA Business Confidentiality Claim use by contractors or private providers to identify protected records or information

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected.
