About this file

This is a Sole Source Justification memorandum issued by the Oregon Department of Education on November 15, 2021, authorizing a sole source contract with the Oregon School Boards Association to provide charter school evaluation services. The Department requires support in completing annual evaluations for four charter schools sponsored by the State Board of Education for the 2020-21 and 2021-22 school years using the Performance Framework. These evaluations are critical for managing charter contracts and informing high-stakes decisions regarding school renewal and ongoing operations. The contract is effective through December 31, 2023. The Department conducted web research to identify alternative service providers but was unable to locate additional vendors offering comparable charter school evaluation services. A protest period was established, with any protests required to be submitted in writing to karen.hull@ode.state.or.us by 5:00 PM Pacific Standard Time on November 23, 2021, in accordance with ORS 279B.410.

The total contract value is $26,800.00. The sole source procurement was justified under OAR 125-246-0170(2)(c)(H) and ORS 279B.075, with the Department determining that the award would not substantially diminish competition as it involved efficient utilization of existing services requiring compatible expertise. The Oregon School Boards Association was selected based on its specialized experience in charter school authorizing, operations oversight, and evaluation processes, along with its existing staff expertise in charter school administration and training. The Department retained the option to amend the contract as needed during the performance period.
