About this file

This is an insurance requirements memo from the Orange County Transportation Authority (OCTA) regarding RFP 250382 for Deferred Compensation Plan Investment Advisory and Consulting Services. The memo documents internal communications between Edwin Byrne and Gina Torres, Senior Contract Administrator, dated August 7-10, 2026, concerning the revision of professional liability insurance requirements for consultant proposals. The contract solicitation seeks qualified consultants to provide investment advisory services to assist the Authority's Deferred Compensation Plan Committee with fiduciary responsibilities, with a budgeted amount of $225,000 for a five-year term.

The memo establishes that Professional Liability (Errors and Omissions) Insurance requirements were revised from the original conditional language in Article 9.A.5 to a mandatory requirement. Edwin Byrne approved the insurance specifications with the modification that Professional Liability insurance with minimum limits of $2,000,000 per claim and $2,000,000 annual aggregate should be a firm requirement rather than contingent upon whether the consultant is required by contract or law to be licensed or specially certified. This revision was confirmed in Byrne's response to Torres on August 10, 2026, providing the exact language for the contract modification.

Yes ma’am TGIF!

Approved except Professional Liability (Errors and Omissions) Insurance with minimum limits of $2,000,000 per claim and $2,000,000 annual aggregate should be a requirement not “required if…”.
