ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT

YOUR EVALUATION OF THE CONTRACTOR’S PERFORMANCE

RATING DEFINITION NOTE

(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit.

The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.

An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an

Exceptional rating. Also, there should have been NO significant weaknesses identified.

(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.

A Very Good rating is appropriate when the

Contractor successfully performed a significant event that was a benefit to the

Government/Owner. There should have been no significant weaknesses identified.

(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.

A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.

(M) Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.

A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the

Government/Owner.

(U) Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.

An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.

(N) Not Applicable No information or did not apply to your contract Rating will be neither positive nor negative.

PERFORMANCE WORK STATEMENT

PARK CUSTODIAN

VENANGO PARK & RIVERSIDE PARK

KANOPOLIS PROJECT

C.1 GENERAL INFORMATION

C.1.1 Background: Kanopolis Lake was the first lake built in Kansas by the Corps of Engineers Kansas City District. Construction of Kanopolis Dam began in 1940 and was completed in 1948. The lake has a drainage area of 7,860 square miles. At the multipurpose elevation of 1,463msl, the lake has a surface area of 3,315 acres with 41 miles of shoreline. During periods of heavy rain the lake increases in size, as runoff is stored, providing downstream flood protection. Recreation, fish and wildlife enhancement, and water quality also are benefits of the lake. Many routine maintenance items are contracted to the private sector. Mowing, refuse collection, office janitorial and facility cleanup are just a few of the activities that are performed by private contractors for the Corps.

C.1.2 Scope of Work The contractor shall provide all labor, equipment, materials and supplies, and supervision necessary to clean and service the facilities and grounds of Venango Park and Riverside Park, Kanopolis Lake Project in Ellsworth County, Kansas. Services shall be completed as described in this Performance Work Statement (PWS) and elsewhere in the contract. The contractor shall perform tasks listed in Section C-10. Acceptable performance standards and current regulations are provided for each task. The contractor shall monitor performance and ensure compliance in accordance with the terms and conditions.

C.1.3 Dates of Performance: April 15 through 30 September of each year during this contract.

C.1.4 Hours of Operation: This schedule shall be subject to change with one (1) week’s advance notice.

Rescheduling will not affect the total number of hours worked per week. The contractor must remain in the park on work days and if needs to leave the park, permission must be obtained from the Contracting Officer Representative

(COR).

PWS – Performance Work Statement

Quality Assurance (QA): A method used by the Government to provide some measure of control over the quality of purchased goods and services received.

Quality Control (QC): A method used by the contractor to control the quality of goods and services provided.

"Service contract" means a contract that directly engages the time and effort of a contractor whose primary purpose is to perform an identifiable task rather than to furnish an end item of supply. A service contract may cover services performed by either professional or nonprofessional personnel whether on an individual or organizational basis. Some of the areas in which service contracts are found include the following:

Maintenance, overhaul, repair, servicing, rehabilitation, salvage, Modernization, or modification of supplies, systems, or equipment.

(b) Routine recurring maintenance of real property.

(c) Housekeeping and base services.

(d) Operation of Government-owned equipment facilities, and systems

C.1.6 Cleanup starting times may be adjusted within the scheduled workday (5 a.m. – 10 p.m.) by the COR giving the contractor 48 hours advance notice of such changes.

C.1.6.1 All work shall be accomplished within the timeframes specified above. Services rendered outside the time periods specified will not be compensated for unless specifically approved in writing by the COR or his authorized representative.

C.1.6.2 CLEANUP – All Facilities: The degree of cleanliness required following a CLEANUP will consist of completion of any and all necessary tasks to ensure that the facility is clean (See C.10 Specific Tasks).

C.1.7 Post-Award Conference After award, but prior to commencement of work, the contractor shall contact the COR, to arrange a mutually agreeable time to meet at the Kanopolis Project Office to review the contract requirements and details of the work.

C.1.8 Quality Control The Contractor will develop a Quality Control Plan designed to demonstrate how the contractor will meet the needs of the project. The Quality Control Plan will document how well the contractor is meeting these needs and will be submitted for approval prior to work on this contract. The contractor must provide and maintain an inspection system acceptable to the government covering the services under this contract. Complete records of all inspection work performed by the contractor must be maintained and made available to the government during contract performance for as long afterward as the contract requires. The Quality Control Plan may be a checklist that the Contractor will follow showing the standards of performance required.

C.2 QUALITY ASSURANCE

C.2.1 Quality Assurance Surveillance Plan.

A Quality Assurance Surveillance Plan (QASP) will be used during the life of the contract to ensure that the Service Provider is performing the services required by this PWS in an acceptable manner. The Government develops the QASP and the Project Office administers the plan.

C.2.2 The government has the right to inspect and test all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The government will perform inspections and tests in a manner that will not unduly delay the work.

C.2.3 In the event of unsatisfactory performance of specified work, the contractor may be directed to re-perform the unsatisfactory services at no additional cost to the Government. Failure of the contractor to perform the work as specified, or to re-perform work as directed, may result in withholding of payment for the portion(s) of the work not accomplished. Amounts to be withheld will be determined by prorating the amount of services satisfactorily performed against the amount of services required. When the defects in services cannot be corrected by re-performance, the government may (1) require the contractor to take necessary action to ensure that future performance conforms to contract requirements; and (2) reduce the contract price to reflect the reduced value of the services performed. Payment will not be made for work not performed or not performed to standard

C.2.4 If the contractor fails to promptly perform the services again or to take the necessary action to ensure future performance in conformity with contract requirements, the government may: (1) by contract, or otherwise, perform the services and charge to the contractor any cost incurred by the government that is directly related to the performance of such service or (2) terminate the contract in whole or in part.

C.2.5 Performance by Third Party or Government Personnel: In addition to the above remedies for nonperformance, the Government reserves the right to cause the specified work to be performed by a third party or Government personnel and the cost incurred thereby will be levied against the contractor. Any time government personnel are used because of contractor's nonperformance; the cost levied against the contractor will include all direct costs associated with the performance of the specified work. Such inefficiencies are determined on a daily basis at the applicable wage rate.

C.3 Coordination with the Project Office

C.3.1 As each item of work is completed, the contractor's representative at the job shall enter the time that the item of work was completed on a Contractor's Daily Worksheet. Completed and signed worksheets shall be delivered each day services are performed, as directed by the COR. The daily worksheet task is optional at the discretion of the COR.

C.3.2 Day to day contact with Government personnel, and telephone communication shall normally provide adequate information exchange. The Government reserves the right to schedule meetings at the Project Office as necessary to insure strict compliance with the terms of this contract. Such meetings shall be scheduled, to the extent possible, at mutually convenient times. However, upon notice, the contractor shall attend meetings regarding matters affecting this contract.

C.3.3 To assist the visiting public in reclaiming lost articles, all property left by visitors and found during cleanup operations shall be turned over to the campground park attendant as soon as possible or to the Project Office.

C.3.4 Any evidence of vandalism, instances of facilities not operating properly, or are in need of repair, shall be promptly reported to project personnel and the campground park attendant.

C.3.5 The contractor shall remove any dead animals within the area serviced under this contract, to the extent that the dead animal is small enough to be removed by the contractor's daily staff. Any large animal that would require additional staff or equipment to move shall be reported to the COR as soon as possible. Disposal of dead animals shall be as directed by the Operations Manager or his representative.

C.3.6 Required Insurance: The contractor shall provide and maintain during the entire performance of this contract, at minimum amounts of insurance required in the below. Before commencing work under this contract, the contractor shall submit proof of insurance to the COR.

C.3.6.1 The policies evidencing required insurance shall contain an endorsement to the effect that any cancellation or any material change adversely affecting the government's interest shall not be effective (1) for such period as the laws of the State in which this contract is to be performed prescribe, or (2) until 30 days after the insurer or the Contractor gives written notice to the COR, whichever period is longer.

C.3.6.2 The contractor shall insert the substance of this clause in subcontracts under this contract that required work on a Government installation and shall require subcontractors to provide and maintain the insurance required in the Schedule or elsewhere in the contract. The contractor shall maintain a copy of all subcontractors’ proofs of required insurance, and shall make copies available to the COR upon request.

C.4.3 All contractor personnel shall be fully clothed at all times while performing these services. “Fully clothed” shall be deemed to mean that a shirt (or T-shirt), trousers and shoes shall be worn at all times, except that this requirement shall not be construed to replace or eliminate the necessity for the wearing of appropriate protective clothing. While on duty, the contractor’s employees shall wear shoes that are enclosed. Sandals or open shoes are prohibited. Contractor personnel shall present a clean appearance and be easily recognized as contractor employees.

C.4.4 Contractor personnel shall utilize tact, diplomacy and courtesy at all times during contact with the public. The contractor or any of his or her employees must not consume any alcohol or drugs (except prescription drugs) during duty hours or when meeting the public.

C.4.5 The contractor shall designate, in writing, a responsible member of each work crew who shall serve as the contact for matters involving quality and performance of the required work assigned to that crew. The employee(s) designated in accordance with the above requirement shall be qualified and fully competent and shall insure that the work described herein is performed in accordance with these specifications. The contractor shall furnish the above written designation to the COR at the project the first day that an individual is a "responsible party." The designation shall include the name(s), address (es), and telephone number(s) of the responsible individual(s).
