About this file
This is a Brand Name Determination document using Simplified Acquisition Procedures (SAP) for a federal procurement action not exceeding the simplified acquisition threshold.
The Department of Commerce, National Oceanic and Atmospheric Administration (NOAA), Acquisition and Grants Office (AGO), Eastern Acquisition Division (EAD), and National Ocean Service (NOS) at the Florida Keys National Marine Sanctuary require replacement of a Daikin-brand 60-ton air cooled chiller (Daikin Applied Model AGZ-004F) to integrate into an existing HVAC system. The solicitation is limited to Daikin Applied Americas, Inc., located at 13600 Industrial Park Boulevard, Minneapolis, Minnesota 55441-3743. The determination justifies single-source procurement based on brand necessity, as alternative manufacturers' units would require substantial modifications including new piping, electrical work, and a new cement pad mounting area. Using the same Daikin brand and model standardizes warranty, service, and repair requirements, which is particularly advantageous given the facility's remote location and limited access to typical supply routes and service companies. Market research conducted by the contract specialist, including online research through GSA and SAM databases and review of previous NOAA contracts, identified multiple small businesses capable of supporting the brand-specific requirement. A previous similar contract (1305M225P0075) for the same client was procured via open market with a small business set aside. The determination was certified by Jacqueline Laverdure, Program Support Specialist, on June 29, 2026, and approved by Michelle Walton, Contracting Officer, on June 30, 2026.

BRAND NAME DETERMINATION USING
SIMPLIFIED ACQUISITION PROCEDURES (SAP)
FOR AN ACTION NOT EXCEEDING THE SIMPLIFIED ACQUISITION THRESHOLD
(AUTHORITY: FAR 13.106-1(b)(1))
1305M226Q0177
1. Agency and contracting activity. Department of Commerce, NOAA Acquisition and Grants Office (AGO), Eastern Acquisition Division (EAD) and National Ocean Service (NOS), Florida Keys National Marine Sanctuary.
2. Description of supplies or services required to meet agency needs. Replacement of Daikin-brand 60-ton air cooled chiller (Daikin Applied Model AGZ-004F) to be integrated into existing HVAC system.
3. Identification of the brand name to be solicited.
Daikin Applied Americas, Inc.
13600 Industrial Park BLVD Minneapolis, Minnesota 55441-3743, United States
4. Supporting rationale. Only one source or brand name is reasonably available as detailed below:
Brand Name – This particular brand name is essential to the requirement and market research indicates similar products do not meet or cannot be modified to meet agency needs.
The Daikin-brand 60-ton air cooled chiller (Daikin Applied Model AGZ-004F) is required for the replacement to integrate properly into the existing HVAC system. Another manufacturer's unit would require additional modifications, including new piping and electrical work, as well as a new cement pad mounting area to fit within the current HVAC system. Using the Daikin brand and model listed above, no modifications would be required. Additionally, a different manufacturer's unit would require different repair parts and possibly a different service company for warranty service than which we currently use. Due to our remoteness and lack of access to typical supply routes and service companies coupled with the possible additional costs of using an equivalent unit, it is in the best interest of the government for the installed units to be of the same manufacturer, make and model as those currently installed for the standardization of warranty, service and repair.
5. Market Research.
Market research conducted by the contract specialist, to include online market research (GSA, SAM, etc.) and reviewing previous NOAA contracts for similar requirements shows that there are multiple small businesses who can support the brand-specific requirement. A previous similar contract for the same client (1305M225P0075) was procured via open market utilizing a small business set aside.
