About this file
This document is an Indian Health Service (IHS) Buy Indian Act Indian Economic Enterprise Representation Form. The form requires businesses to self-certify their status as an "Indian Economic Enterprise" when responding to solicitations, with specific eligibility requirements at the time of offer, contract award, and throughout contract performance. Businesses must meet legal definitions of Indian ownership and be registered in the System of Award Management (SAM).
The form emphasizes strict compliance, noting that false or misleading information is a violation punishable under federal law (18 U.S.C. 1001 and 31 U.S.C. 3729-3731). Contracting Officers may request documentation to verify eligibility, and awards under the Buy Indian Act can be subject to protest if an offeror's eligibility is questioned. The form provides spaces for businesses to indicate whether they meet the Indian Economic Enterprise definition, including fields for the name of the Federally Recognized Tribal Entity, business name, UEI number, and owner information.
