About this file
This is a federal contracting clause template for the Buy American Certificate (October 2022 version), establishing requirements for offerors to certify compliance with Buy American provisions in federal procurements.
The clause requires the offeror to certify that each end product, except those listed in paragraph (b), is a domestic end product, and that each domestic end product listed in paragraph (c) contains a critical component. The offeror must separately list foreign end products manufactured in the United States that do not qualify as domestic end products, indicating whether those products exceed 55 percent domestic content (with an exception for COTS items). Additionally, the offeror must separately identify by line item number all domestic end products containing a critical component. The clause incorporates definitions for "commercially available off-the-shelf (COTS) item," "critical component," "domestic end product," "end product," and "foreign end product" from the "Buy American-Supplies" clause in the solicitation. The template includes blank sections for offerors to populate with line item numbers and country of origin information for foreign end products, as well as line item numbers for domestic end products containing critical components. Government evaluation of offers will follow the policies and procedures outlined in FAR Part 25. This clause is prescribed in FAR 25.1101(a)(2).
