About this file
This is a Business Continuity Agreement between the State of Nevada Nevada Health Authority and a vendor, effective July 1, 2025, establishing obligations for ensuring uninterrupted service delivery. The agreement requires the vendor to develop, implement, and maintain a comprehensive Business Continuity Plan (BCP) and Disaster Recovery Plan (DRP) within 30 days of contract signing. The BCP must include redundancy measures, failover capabilities, and mitigation of single points of failure across data centers, cloud-based systems, and key personnel positions. The DRP must outline detailed recovery processes with clearly defined roles, timelines, and escalation procedures. The vendor must conduct at least one full BCP and DRP test annually and provide results to the Client upon request. The agreement remains in effect for the duration of the vendor's contractual relationship with the Nevada Health Authority.
The agreement does not establish specific pricing terms, set-asides, or funding amounts within this document, as those details are governed by the underlying Vendor Contract. The vendor must notify the Client in writing within five business days of any changes to the BCP or DRP and immediately upon any service disruption, followed by a detailed report within five business days. All subcontractors and third-party service providers must adhere to the same business continuity standards through flow-down provisions, with the vendor remaining fully responsible for their compliance. Non-compliance remedies, including service credits, financial penalties, or termination for cause, are governed by the separate Service Level Agreement and Vendor Contract. The agreement requires compliance with HIPAA, the HITECH Act, 45 CFR 164.308(a)(7), Nevada Revised Statute 422, and CMS regulations.
