About this file

This addendum document is issued by the Massachusetts Trial Court, Office of Court Management, Facilities Management & Capital Planning Department in support of Bid BD-26-1107-FREG5-ACCOU-123584 for Brooke Cooling Tower Repairs. Addenda #1, dated March 3, 2026, removes the Owner Contractor Agreement from the required documents for bid submission. Bidders must acknowledge receipt of this addendum on their proposal forms, and failure to do so may result in bid rejection. The underlying project involves the replacement of damaged louvers and supports on two Baltimore Air Coil Model 3604C cooling towers located on the roof of the Edward W. Brooke Courthouse in Boston, Massachusetts. The scope includes replacement of 24 damaged fiberglass louvers and 8 stainless steel louver supports with original equipment manufacturer parts. Work must be completed during normal business hours between 6:00 AM and 2:00 PM, Monday through Friday, with one cooling tower remaining operational at all times. A mandatory site walk-through was scheduled for February 26, 2026 at 7:00 AM, with a questions deadline of March 2, 2026 at 12:00 PM and sealed bid due date of March 6, 2026 at 12:00 PM. The planned project start date is March 30, 2026, with completion required by April 26, 2026.

Bidders must submit detailed cost breakdowns, work schedules, proof of insurance, CORI background checks, certificates of non-collusion and tax compliance, OSHA certifications, and payment and performance bonds. A 50 percent payment bond requirement applies if the total contract exceeds $25,000, indicating the project budget likely falls in that range or higher. No set-asides are designated for minority, women, or service-disabled veteran-owned business enterprises; however, applicable workforce utilization requirements of 15.3 percent for minorities and 6.9 percent for women apply. Contractors must comply with Massachusetts prevailing wage rates, ensure all employees complete a 10-hour OSHA-approved construction safety course, and provide a one-year warranty on all parts and labor. Bids must be submitted electronically through COMMBuys.com in PDF format, with award to the lowest responsible and eligible bidder within thirty days of bid opening. No subcontractors may be used without prior written approval from the Office of Court Management.
