About this file
This document is a Justification for Brand Name Exception to Fair Opportunity for the Department of Homeland Security, FEMA's Office of National Continuity Programs. The justification covers the procurement of a Cisco Interactive Voice Response (IVR) and Unity License renewal for the Integrated Continuity Communications Transport (ICCT) system. FEMA is seeking a multi-year subscription, with the justification specifically stating that only Cisco can provide the required software due to the unique and highly specialized nature of the existing system.
The document emphasizes that procuring an alternative software solution would require replacing all existing Cisco inventory and software, which would not meet the ICCT requirements. Such a change could potentially increase total program costs and cause delays in operations for this essential National Security System, which supports ONCP's compliance with OMB/OSTP Directive 16-1. The solicitation number is WX03007Y2025T, with the justification dated 5/19/2025, and FEMA intends to post the requirement on SAM.gov as required by federal acquisition regulations.

Justification for Brand Name Exception to Fair Opportunity Exceeding the micro-purchase threshold and up to the SAT pursuant to FAR 16.505(a)(4)
JEFO No.: 24-069
Date: 5/19/2025 PR Number: WX03007Y2025T
1. Nature and/or description of the item/service being procured and anticipated cost:
The Department of Homeland Security, FEMA, Office of National Continuity Programs, Continuity Communications Division, prepared this justification for an exception to fair opportunity for the purchase of the Integrated Continuity Communications Transport (ICCT) Cisco Interactive Voice Response (IVR) and Unity License renewal supporting ICCT for Multiple Year Subscription in the projected amount of $
2. Statutory Exception and rationale for brand name. Only one awardee is capable of providing the software required at the level of quality required because the supplies are unique or highly specialized pursuant to FAR 16.505(b)(2)(i)(B) and is an item peculiar to one manufacturer:
Procuring an alternate software other than Cisco will require all existing inventory and software currently supported by existing Cisco to be replaced with other software that does not meet the requirements of the ICCT. To support a different software solution would result in an increase in total program cost. More importantly and as described above, the procurement of a different software solution could cause delays in the operations and maintenance of an essential National Security System that supports ONCP’s compliance to OMB/OSTP Directive 16-1 mission.
3. FEMA intends to post this requirement on SAM.gov pursuant to FAR 16.505(b)(2)(ii)(D).
