FAR PART 13 JUSTIFICATION AND APPROVAL FOR BRAND NAME
1. Contracting Agency:
U.S. Army Corps of Engineers (USACE), South Atlantic Division (SAD), Wilmington District (SAW).
2. Description of Action:
FORSCOM requests a firm-fixed price new contract for commercial services. The Government projects award for September 2022 and fiscal year 2022, funds type (e.g., Operations and Maintenance, Army or Other Procurement Army) funds will be used.
Service shall begin no later than 30 September 2022.
3. Description of Services:
The proposed action is for preventative and emergency maintenance support for the Uninterrupted Power Supply (UPS) units located at FORSCOM/USARC headquarters building on Fort Bragg and at the DRC on Camp Mackall, NC.
o There are ten (10) Toshiba UPS units. Toshiba is the manufacturer and installer of these units and require authorized service providers with factory-trained technicians to provide service on their equipment.
o There are two (2) APC UPS units. APC also requires authorized service providers with factory-trained technicians on their equipment.
Period of Performance: 12-month base year and four (4) 12-month option years.

As described at FAR 13.106-1(b)(2), “For purchases exceeding the simplified acquisition threshold. The requirements at 13.501(a) apply to sole-source (including brand-name) acquisitions of commercial products and commercial services conducted pursuant to subpart 13.5.
5. Reasons for Authority Cited:
Subpart 13.5(a) states that sole source (including brand name) acquisitions are conducted under simplified acquisition procedures are exempt from the requirements in part 6. The Contracting Officer must justify in writing and receive approvals notated within this section.
Background: There is a need for UPS systems preventative and emergency maintenance service located within the facilities of FORSCOM/USARC Marshall Hall Headquarters and DRC in order to prevent the premature failure and deterioration of the network systems within both facilities. Marshall Hall is headquarters to the United States Army Forces Command and United States Army Reserve Command on Fort Bragg. The UPS system consists of 9 Toshiba UPS modules and 2 APC UPS modules within Marshall Hall; 1 Toshiba UPS module located at the DRC. These two commands are headed by a four star and three star General respectively. As a result of the vastness and essential missions of these UPS systems, these systems must be kept at a high state of readiness at all times. Not receiving these maintenance services as identified above on these buildings could adversely affect mission essential tasks of both FORSCOM and USARC.
Requirement for Brand Name: Due to the proprietary nature of the respective UPS units, Toshiba and APC require authorized service providers with factory-trained technicians to service their equipment for the following reasons:
o Manufacturer software is only issued to authorized service providers. They are the only ones legally able to do any firmware upgrades to the units for liability reasons.
o Manufacturer technical support is only provided to authorized service providers.
o These units are currently out of warranty but any replacement parts with associated warranties are void when non-authorized service providers are used.
o Manufacturer will not sell replacement parts directly to non-authorized service providers.
6. Efforts to Obtain Competition:
a. Effective Competition: Effective competition will be achieved. The solicitation for will be solicited as a request for quotation on https://sam.gov with a 100% small business set aside. Each offeror will independently price the required services.
b. Subcontracting Competition: Subcontracting competition will be achieved by market forces. While some UPS manufacturers such as Toshiba and APC restrict competition to vendors that provide factory-trained service providers, competition will still be realized.
7. Actions to Increase Competition: This will be competed openly to all service providers that can provide factory-trained service technicians.
8. Market Survey: A sources sought was posted to https://sam.gov. 6 responses were received: of those, 2 were large business; 2 were small business under NAICS 811310; and 2 were small business under other NAICS (811212 and 238900).
Additionally, the previous service provider was contacted to determine interest and capability; however, that vendor is no longer classified as a small business. An SBA search was also performed for NAICS 811310, and 165 small businesses were identified in North Carolina.
