About this file

This document is a Bid Bond Preparation Instructions guide issued by the State of West Virginia Department of Administration for use in responding to Request for Quotation/Request for Proposal solicitations. The instructions provide a standardized template and detailed guidance for bidders preparing bid bonds required for state contract opportunities. The document specifies that bid bonds must be submitted with bids to ensure bidder compliance with proposal terms and conditions. The bid bond serves as a guarantee that if a bid is accepted, the principal will enter into the required contract, furnish any additional bonds or insurance specified, and perform all obligations outlined in the acceptance of the bid. The instructions do not specify particular products, services, project scopes, quantities, response dates, or contract terms, as this is a generic preparation guide applicable across multiple state solicitations.

The minimum acceptable bid bond amount is established at five percent of the total bid amount, which may be stated either as a percentage or as a specific dollar figure. The surety executing the bond must be licensed in West Virginia to transact surety insurance and must affix its corporate seal to all documents. A dated Power of Attorney with the surety's seal affixed must accompany the bid bond submission. The document requires that the bid bond be executed by a proper officer of both the principal and surety entities, with specific signature authority limited to the President, Vice President, or a Duly Authorized Agent. The surety's liability under the bond is expressly limited to the penal amount stated in the bond, and the surety waives notice of any extensions of time for bid acceptance.
