COMBINED SYNOPSIS/SOLICITATION ‘COMBO’:

Boiler/Water Heater Maintenance

(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with (IAW) the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; offers are being requested and a written solicitation will not be issued. Solicitation is a Request for Offers under solicitation number FA500024Q0014 is issued IAW FAR 13.106 and 13.5. The offer received in response to this solicitation, if accepted, will result in a binding contract.

(ii) Notice to Offerors: Funds are not presently available for this effort. No award will be made under this solicitation until funds are available. The Government reserves the right to cancel this solicitation, either before or after the closing date. In the event the Government cancels this solicitation, the Government has no obligation to reimburse an offeror for any costs.

(iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2024-05, effective 22 May 2024. The Defense Federal Acquisition Regulation Supplement (DFARS) provisions and clauses are those in effect to DFARS Change 05/30/2024, effective 30 May 2024. The Department of the Air Force Federal Acquisition Regulation Supplement (DAFFARS) provisions and clauses are those in effect to DAFAC 2024-0612, effective 06/12/2024. (iv) This requirement is a 100% small business set-aside under the North American Industrial Classification System (NAICS) code: 811310 –Commercial and Industrial Machinery and Equipment (except Automotive and Electronic) Repair and Maintenance

(v) The Government intends to award a firm-fixed-price (FFP) contract for boiler/water heater maintenance services.

See Attachment 1, Performance Work Statement, for a full description of the Government’s requirement.

(vi) The 773 Civil Engineering Squadron (CES) requires boiler maintenance on Joint Base Elmendorf-Richardson - Elmendorf (JBER-E), Alaska. The contractor shall provide all items and non-personal services to include but not limited to management, personnel (IAW DFARS 252.222-7000, Restrictions on Employment of Personnel), transportation, equipment, and supplies required to provide for maintenance of boilers and associated systems on JBER-E. The contractor is responsible for maintaining management control systems necessary to plan, organize and direct all activities necessary to fulfill this requirement. Encompassing preventative and corrective maintenance, the requirement is for service of approximately 153 steam boilers ranging from less than 500 to greater than 1000 MBh, 48 Hydronic Boilers, 2 Furnaces, 36 Steam Hot Water heaters, 89 Back Flow Preventers and 28 Gas Unit Heaters.

(vii) A site visit will be held for this requirement on 24 July 2024, but may be cancelled if there is not sufficient interest. If interested in attending the site visit, contact Kendra Lemke and TSgt Nicholas Cripe at kendra.lemke@us.af.mil and nicholas.cripe@us.af.mil by 2:00 PM Alaska Daylight Time on 22 July 2024 with the following information:

1. The first name, last name, and middle initial of the individual(s) attending.

2. Date of birth and license number/state (or other state-issued ID number) for each individual attending.

3. The make, model, and license plate number/state for each vehicle.

Those attending the site visit will meet at the Boniface Visitor Center at 09:00 AM Alaska Daylight Time to process through the visitor center, departing to the site at 09:30 AM Alaska Daylight Time. Attendees must be able to present a valid state ID, vehicle registration, and vehicle insurance to process through the visitor center. Each offeror may submit a maximum of three (3) personnel for the site visit.

(viii) This solicitation closes at 2:00 PM Alaska Daylight Time on 12 August 2024. All offers for this solicitation shall be submitted via email to Kendra Lemke and TSgt Nicholas Cripe at kendra.lemke@us.af.mil and nicholas.cripe@us.af.mil prior to the solicitation closing.

(ix) FAR 52.212-1 Instructions to Offerors – Commercial Products and Commercial Services (Sep 2023) is hereby incorporated by reference, with the same force and effect as if it were given in full text. The following have been tailored to this procurement and are hereby added via addendum:

(a) Paragraph 52.212-1(c), "Period for Acceptance of Offers," is tailored as follows: "the prices in its offer firm for 120 calendar days from the date specified for receipt of offers."

(b) The following is inserted as new paragraph (m) of the provision:

(m) Offer Preparation Instructions.

A. Offer Preparation. To assure timely and equitable evaluation of offers, offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The response shall consist of three (3) separate parts/files; Mission Essential Contractor Services Plan (IAW Attachment 3), Pricing Schedule (IAW Attachment 5), and Provisions and Clauses (IAW Attachment 6). Past Performance Questionnaire (IAW Attachment 4) will be submitted by the firms providing the reference for your company.

B. Additional Instructions:

1. PAST PERFORMANCE QUESTIONNAIRE -

(a) Performance Surveys/Questionnaires: The offeror shall forward a copy of the Past Performance Questionnaire (PPQ) and Cover Letter to at least three (3), but no more than five (5), points of contact for who the offeror has contracted similar services with Federal, State, or Local Government agencies and commercial businesses. The questionnaires must be forwarded to a point of contact (POC) at each of those agencies or business organizations for completion.

Prior to forwarding the questionnaire to each reference, the offeror shall insert in the "MEMORANDUM FOR" the contractor’s name, address, phone number and the point of contact. Offerors will notify the point of contact that the completed questionnaires will be sent directly to the Government POCs listed in this solicitation. PPQs shall be sent directly from your reference to this office via e-mail marked to the Kendra Lemke and TSgt Nicholas Cripe at kendra.lemke@us.af.mil and nicholas.cripe@us.af.mil. See Attachment 4 for Past Performance Questionnaire and Cover Letter.

THE RESPONSIBILITY TO SEND OUT THE PAST PERFORMANCE QUESTIONNAIRE

RESTS SOLELY WITH THE OFFEROR.

Once the questionnaires are completed by the POCs, the information contained therein will be considered source selection sensitive and will not be released outside the Government.

(b) Past Performance Information: Provide a list of three (3), but not more than five (5) relevant contracts performed for government agencies and/or commercial customers within the last five

(5) years prior to the date of this solicitation. Relevant contracts include those similar in scope to JBER's requirement as described in Attachment 1, Performance Work Statement.

The following information must be furnished for each contract listed:

(1) Company/Division name

(2) Description of Services, to include but not limited to, specifying number and type of boiler/hot water heaters maintained

(3) Contracting Agency/Customer

(4) Contract Number

(5) Contract Dollar Value Per Year

(8) Comments regarding any known performance deemed unacceptable to the customer, or not in accordance with the contract terms and conditions

(x) FAR 52.212-2 Evaluation -- Commercial Products and Commercial Services. (Nov 2021) this provision has been tailored to this procurement and is provided in full text below:

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer, conforming to the solicitation, will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

(1) Mission Essential Contractor Services Plan (MECSP)

(2) Past Performance

(3) Price (Total Evaluated Price)

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are unbalanced from one year to the next. Evaluation of options will not obligate the Government to exercise any of the option periods.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are interchanges after its receipt, unless a written notice of withdrawal is received before award.

Addendum to FAR 52.212-2, Evaluation - Commercial Products and Commercial Services

The following is inserted as new paragraph (d) of the provision:

(d) Basis For Contract Award: Award will be made IAW FAR Part 13 on a best value basis taking Price, Past Performance, and the Mission Essential Contractor Services plan into consideration. The Government reserves the right to award a contract to other than the lowest Total Evaluated Price (TEP). An acceptable record of relevant past performance may be considered more advantageous to the Government than a “neutral” rating. In that event, the Contracting Officer will be the Decision Authority and will make a best value award decision using the MECSP, TEP and the Past Performance rating. In order to be eligible for award, the offerors MECSP must be rated acceptable and Past Performance must not be rated unacceptable.

(1) Mission Essential Contractor Services Plan:

(A) The Government will evaluate the Mission Essential Contractor Services Plan on an acceptable and unacceptable basis IAW DFARS 252.237-7024, Notice of Continuation of Essential Contractor Services.

ACCEPTABLE Based on the offeror’s MECSP, the Government has a reasonable expectation that the offeror will successfully perform mission essential functions as required.

UNACCEPTABLE Based on the offeror’s MECSP, the Government does not have a reasonable expectation that the offeror will be able to successfully perform mission essential functions as required.

(B) If MESCP is rated unacceptable, the offeror will not be eligible for award.

(2) Past Performance Factor:

(A) The Government will evaluate past performance information IAW FAR 13.106-2(b)(3) on all offerors based on (i) the references provided by the offeror, (ii) responses received from past performance questionnaires (Attachment 4), (iii) consider an offeror’s supplier risk located in the Supplier Performance Risk System (SPRS) to assess the risk of unsuccessful performance and supply chain risk IAW DFARS 204.7603 (for more information see DFARS clause 252.204-7024, Notice on the Use of the Supplier Performance Risk System.), and (iv) the Government-wide Contractor Performance Assessment Reporting System (CPARS) at https://www.cpars.gov/, if available.

(B) Past performance will be rated based on an acceptable/neutral/unacceptable rating method outlined below.

ACCEPTABLE Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

NEUTRAL No performance record within the same scope of work is available or the offeror’s performance record is so sparse that a positive or negative rating cannot be reasonably assigned.

UNACCEPTABLE Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

(C) The “yes” and “no”, “acceptable” and “unacceptable”, and the complexity questions associated with section E of the past performance questionnaire (Attachment 4) will be utilized to determine if the vendor’s past performance is similar in scope and complexity to JBERs Boiler/Water Heater Maintenance requirement. To be rated acceptable, offers PPQs received by the government are required to cumulatively receive a “Yes” for questions 1-4, “acceptable” for questions 5-9, and have all complexity (types) check marked in questions 10 and 11. Cumulatively means that a collective review of all the PPQs provided on behalf of the offer will be reviewed and the rating will be given based on all PPQs received. It will not be based on any one (1) individual questionnaire. An “unacceptable” rating for questions 5-9 on any PPQ may result in an unacceptable past performance rating.

(D) If past performance is rated unacceptable, the offeror will not be eligible for award.

(3) Price Evaluation Factor:

(A) Total Evaluated Price (TEP): A TEP will be computed for each offer in order to meet the requirements of FAR 17.203(b). The price of a six-month extension authorized by FAR Clause 52.217- 8, Option to Extend Services, will be added to the submitted price for each potential contract performance period.

(i) The TEP is a two-part computation. First, the Offeror's total submitted price will be determined by multiplying the quantities identified in the pricing schedule by the Unit Price (limited to two decimal places) for each Contract Line Item Number (CLIN) to confirm the extended total amount for each CLIN; the sum of all extended amounts will be the Offeror's total submitted price.

Second, the total submitted price (total amount for All CLINs) plus the sum of FAR Clause 52.217- 8 Option to Extend Services formula (shown below) will constitute the TEP.

The formula for FAR Clause 52.217-8, Option to Extend Services amount is as follows:

Base Year = Monthly Price of Base Year x 6

Option Year 1 = Monthly Price of Option Year 1 x 6

Option Year 2 = Monthly Price of Option Year 2 x 6

Option Year 3 = Monthly Price of Option Year 3 x 6

Option Year 4 = Monthly Price of Option Year 4 x 6

(ii) Evaluating the Option CLINs does not obligate the Government to exercise any Options.

(B) IAW DFARS 204.7603(b) the Government will consider an offerors price risk in determining if a offerors price is consistent with historical prices paid for a product or a service or otherwise creates a risk to the Government. For more information see DFARS clause 252.204-7024, Notice on the Use of the Supplier Performance Risk System.

(4) Offer: Means a response to a solicitation that, if accepted, would bind the offeror to perform the resultant contract.

(5) Interchanges: The government intends to award a Firm Fixed-Price (FFP) contract without interchanges with respective offerors. The government, however, reserves the right to conduct interchanges if deemed in its best interest. Interchanges are the contemporaneous exchange of information between the Government, at its discretion, and one, some, none or all offerors that provided offers in response to the request for offer.

Under FAR 13 procedures the Government may hold Interchanges with offerors to address any aspect of the offer, which may include, but not be limited to, MECSP, price, and/or past performance. Interchanges may be conducted in writing or as oral conversations, will be conducted in a fair and reasonable manner, and will not favor one offeror over another. Offerors do not have to be offered the opportunity for final offer revisions (FORs) in response to interchanges.

(6) SAM Registration: Note that SAM registration must be current at time of offer submission and must remain valid through award. If SAM registration lapses during the solicitation and evaluation period, the offer will no longer be eligible for award.

(xi) FAR 52.212-3, Offeror Representations and Certifications—Commercial Products and Commercial Services (May 2024), hereby incorporated by reference with the same force and effect as if it were given in full text.

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u) of this provision.

(xii) FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders- Commercial Products and Commercial Services.
