About this file
This is a Justification for an Exception to Fair Opportunity or Brand-Name Restriction document issued by the United States Air Force at Tinker Air Force Base, Oklahoma, dated September 17, 2021.
The acquisition addresses a requirement for the Tinker Youth Center to replace existing bleachers that are approximately 25 years old and have reached the end of their service life. The Government is procuring one Hussey Seating MAXAM wall-attached telescopic bleacher system, approximately 45 feet in installed length and extending approximately 9 feet when fully deployed. The system must include integrated ADA-compliant wheelchair seating locations with companion seating, aisle handrails, end rails, all required safety features, delivery, installation, testing, and manufacturer's warranty. The contracting activity is AFSC/PZIOA with Purchase Request/Local ID Number F3Y0AK6076A002, classified as an Individual determination for Other Contracting. The estimated cost is redacted in the document.
The justification establishes that the Hussey Seating Maxam telescopic bleacher system is the only product identified through extensive market research that satisfies the Government's technical, structural, compatibility, ADA accessibility, and safety requirements. Multiple bleacher vendors were contacted, and all confirmed they could not provide equivalent products and referred the Government to Hussey Seating. Use of an alternate manufacturer's system would necessitate redesign, additional engineering analysis, potential structural facility modifications, increased installation costs, and extended downtime. The Contracting Officer, Program Manager, and Approving Official have certified that the brand-name restriction under FAR 16.505(a)(4)(i) applies and represents the best value to the Government. Future market research will be conducted prior to subsequent telescopic bleacher acquisitions to identify if equivalent products or additional qualified sources become available.

Justification for an Exception to Fair Opportunity or to Use Brand-Name Restriction
CONTROLLED UNCLASSIFIED INFORMATION
17 September 2021 CONTROLLED UNCLASSIFIED INFORMATION Page 2 of 317 September 2021 CONTROLLED UNCLASSIFIED INFORMATION Page 2 of 3 locations and companion seating necessary to comply with current accessibility requirements.
Use of an alternate manufacturer's system would require redesign of the installation, additional engineering analysis, potential structural modifications to the facility, increased installation costs, extended facility downtime, and additional Government expense. These impacts would not be in the Government's best interest. Extensive market research was conducted by contacting multiple bleacher vendors and reviewing commercially available products. All vendors contacted advised they could not provide an equivalent product meeting the Government's requirements and referred the Government to the same source for the required Hussey Seating system. No equivalent product or alternate source capable of satisfying the Government's technical, compatibility, structural, and ADA accessibility requirements was identified.
(5) Contracting Officer's determination that the anticipated cost to the Government will be fair and reasonable:
The proposed acquisition represents the best value to the Government because it provides the only system identified that fully satisfies the Government's technical, structural, safety, ADA accessibility, and compatibility requirements while avoiding significant additional engineering, facility modifications, project delays, and increased overall costs.
(6) Other facts supporting the justification:
The existing bleachers have exceeded their expected service life and require replacement. Procuring a different manufacturer's system would likely require additional engineering, structural modifications, increased installation costs, extended downtime, and potential disruption to facility operations. The Hussey Seating Maxim system provides the most compatible, safe, accessible, and cost-effective solution while minimizing risk to the Government.
(7) Actions the agency may take to remove or overcome any barriers to decreasing the use of brand-name items before any subsequent acquisition of the supplies or services:
Prior to any future acquisition of telescopic bleachers, the Government will conduct additional market research to determine whether equivalent products or additional qualified sources become available. At the time of this acquisition, market research identified only one brand capable of meeting the Government's technical, structural, compatibility, and ADA accessibility requirements.
(8) Program Manager's certification that supporting data is accurate and complete:
As evidenced by my signature below, I certify that any supporting data contained herein, which is my responsibility, is both accurate and complete.
(9) Contracting Officer's certification that the justification is accurate and complete:
As evidenced by my signature below, I certify that the justification is accurate and complete to the best of my knowledge and belief.
(10) Approving Official's determination that FAR16.505(a)(4)(i) applies to the order:
As evidenced by my signature below, I hereby determine that the use of brand-name restriction applies.
