About this file
This file is a Bidder's Statement of Principal Place of Business form required by Hillsborough County Public Schools (HCPS) in Florida for the Food Service Sanitation Program solicitation. The form serves as a compliance document to establish whether a bidder's principal place of business is located within Florida or outside the state. For bidders with a principal place of business in Florida, completion and submission of the form with the bid response fulfills this requirement with no additional action necessary. For out-of-state bidders, the form must be accompanied by a written legal opinion from an attorney licensed to practice law in the bidder's home state, addressing whether that state or its political subdivisions grant bidding preferences to in-state business entities in the award of public contracts.
The legal opinion requirement mandates that out-of-state bidders' attorneys certify either that their state and relevant political subdivisions grant no preferences to local businesses, or alternatively, that specific preferences exist and must be identified with citations to applicable state law and local ordinances. This document is grounded in Florida Statute 287.084(2), which requires vendors with out-of-state principal places of business to provide this attestation as a condition of bid responsiveness. Failure to comply with these documentation requirements renders a bid non-responsive to the solicitation terms. The form requires the attorney's signature, printed name, state bar admission information, and contact details, ensuring verification of the legal opinion's authenticity and the attorney's qualifications to provide such counsel.
