About this file
This document is bid bond preparation instructions provided by the State of West Virginia Department of Administration Purchasing Section. The instructions outline the standardized format and requirements for bidders submitting bid bonds in response to RFQs/RFPs issued by West Virginia state agencies. The document specifies mandatory information that must be included on the bid bond form, including the agency name, RFQ/RFP number, principal (bidder) identification and location, surety information, and a description of the scope of work. The bid bond must be executed and sealed by authorized representatives of both the principal entity and the surety company, with signatures required from the principal's president, vice president, or authorized agent, and from the surety's attorney-in-fact.
The minimum acceptable bid bond amount is established at 5% of the total bid amount, which can be expressed either as a percentage or as a specific dollar figure. The surety executing the bond must be licensed to transact surety insurance in West Virginia and must affix its corporate seal to the document. A dated power of attorney with the surety's seal affixed must accompany the bid bond submission. The bond conditions provide that the obligation becomes null and void if the bid is rejected or if the bid is accepted and the principal enters into the contract, furnishes required bonds and insurance, and performs all obligations created by bid acceptance. The surety's liability is expressly limited to the penal amount stated on the bond, and the surety waives notice of any time extensions granted by the state for bid acceptance.
