About this file

This is a Bid Bond Instructions document issued by the State of Maryland for the contract opportunity to Replace Nine AHU Humidifiers at the Main Hospital in Cambridge, Maryland. The bid bond is required for Small Business Enterprises approved under the Master Contractors Eastern Region contract. The principal and surety are jointly and severally bound to the State of Maryland for a bid bond amount equal to at least five percent of the total bid amount. Upon acceptance of the bid by the State, the principal must execute all required contractual documents and provide performance and payment bonds within ten days of receiving the forms, or within the time specified in the bid. If the principal fails to execute the required documents and bonds, the surety is liable to the State for the difference between the principal's bid amount and any larger amount the State must pay to contract with another party to perform the work, not to exceed the bid bond penalty.

The bid bond document provides detailed instructions for completing and executing the bond based on the principal's business structure: individual, partnership, or corporate entity. All signatures must be executed in the presence of a witness, with appropriate seals affixed by the principal and the surety. The document requires that the original bid bond include the corporation's seal and the surety's seal, and an original power of attorney must be attached. The State of Maryland's Assistant Attorney General must approve the bond as to form and legal sufficiency. The bid bond remains valid for ninety days from submission unless otherwise specified, and the surety's obligation is not impaired by bid acceptance extensions aggregating no more than ninety additional calendar days.
