About this file
This file is a Bid Bond Form with Preparation Instructions issued by the West Virginia State Agency through the Department of Administration's Purchasing Section. The document serves as a template and instructional guide for bidders submitting proposals to the state. The form requires bidders to provide a bid bond as a guarantee of their commitment to enter into a contract should their bid be accepted. The bond must be executed by both the principal (the bidding entity) and a surety (an insurance company licensed in West Virginia). The document does not specify particular products, services, project timelines, response dates, site visits, or bidder meetings, as it functions as a standalone form applicable to multiple procurement opportunities.
The minimum acceptable bid bond amount is set at five percent of the total bid submitted, though bidders may provide a higher amount if desired. The penal sum of the bond ensures that if a bid is accepted and the principal fails to enter into the required contract or furnish other mandated bonds and insurance, the surety becomes liable up to the bond amount. The surety must be licensed to transact surety insurance in West Virginia, must affix its corporate seal to the bond, and must attach a dated power of attorney with the surety's seal affixed. The form contains specific fields for completion including the agency name, RFQ/RFP number, principal and surety names and locations, scope of work description, and execution dates, with signatures required from authorized officers of both the principal and the surety's attorney-in-fact.
