About this file
This is a memorandum template documenting approved deviations from the Buy Indian Act for the Indian Health Service (IHS), a component of the Department of Health and Human Services.
The form is used to record contract actions that deviate from the requirement to provide preference to Indian Economic Enterprises (IEEs) under 25 U.S.C. 47 and 48 CFR Part 326, Subpart 326.603-3. The template requires identification of the procurement request number, solicitation number, and control number. Required authorization levels are tiered by contract value: Contracting Officer authorization for actions exceeding the micro-purchase threshold but not exceeding $25,000; Chief Contracting Officer or IHS Division of Acquisition Policy Director for actions exceeding $25,000 to $700,000; IHS Competition Advocate for actions exceeding $700,000 to $13.5 million; Head of Contracting Activity for actions exceeding $13.5 million to $68 million; and HHS Office of Small & Disadvantaged Business Utilization, Office of General Counsel, HHS Department Competition Advocate, and Senior Procurement Executive for actions exceeding $68 million.
The memorandum identifies six deviation authorization scenarios: pre-solicitation deviation for simplified or commercial items based on market research showing no reasonable expectation of competitive offers from two or more IEEs; pre-solicitation deviation for other items based on research indicating no reasonable expectation of offers from two or more responsible IEEs at fair market price; post-solicitation deviation for simplified or commercial items when only one offer from an IEE is received at unreasonable price or no IEE offers received; and post-solicitation deviation for other items when all acceptable IEE offers are unreasonable, only one offer is received at unreasonable price, or no responsive IEE offers are received. The form requires certification that supporting documentation from market research, sources sought, and pre/post-solicitation activities justifying the deviation is attached and that all information is true and accurate. Required signatures include the requestor/contract specialist and the appropriate authorization official based on contract value.

Deviation is authorized prior to issuing the solicitation for simplified or commercial items.

The Contracting Officer shall not rely solely on the program for this determination.
Deviation is authorized prior to issuing the solicitation for other than simplified or commercial items.
Basis: The Contracting Officer determines, after a thorough research, that there is no reasonable expectation that offers will be received from two or more responsible IEEs at a reasonable and fair market price. The Contracting Officer shall not rely solely on the program for this determination.
Deviation is authorized after issuing the solicitation for simplified or commercial items.
Basis: Only one offer has been received from a responsible IEE and the price is unreasonable, or no offers have been received from a responsible IEE.
