About this file
This is a Build America, Buy America (BABA) Certification Form required by the City of Fort Myers Procurement Services Department for federally funded construction projects involving the Sanitary Sewer Evaluation Survey Program On-Call Contractors. The form mandates contractor compliance with BABA provisions established under the Infrastructure Investment and Jobs Act of November 15, 2021, which requires all iron, steel, manufactured products, and construction materials to be produced in the United States. The certification applies to the complete scope of work, including all subcontracted portions, and contractors must identify domestic sources for BABA-covered products and provide verification documentation for compliance. The form requires contractors to acknowledge understanding of BABA requirements and commit to providing waiver documentation per federal guidelines when needed. Key response elements include contractor signature, date, printed name and title, email, company name, phone number, and business address.
Contractors must certify their commitment to BABA compliance as a condition of contract award and execution. False statements on the certification form may result in rejection or termination of any award and contract. The City of Fort Myers emphasizes that BABA provisions apply to all federally funded portions of projects within the five-year on-call contract structure, which involves multiple work categories including new construction, repairs, and rehabilitation of water, sewer, and stormwater infrastructure. Additional compliance requirements include E-Verify participation, lobbying disclosures, Disadvantaged Business Enterprise (DBE) participation goals of 10.54%, and local vendor preferences with points awarded for physical business locations in Fort Myers or Lee County. Contractors must hold valid Florida Underground Utility and Excavation Contractor licenses and demonstrate three consecutive years of business operation prior to award consideration.
