About this file

The document is a Build America, Buy America (BABA) Certification Form issued by the City of Fort Myers Procurement Services for a water meter replacement project. The form requires contractors to certify compliance with federal regulations mandating the use of iron, steel, manufactured products, and construction materials produced in the United States, as stipulated by the Infrastructure Investment and Jobs Act passed on November 15, 2021.

The certification form obligates respondents to verify that all project components, including subcontracted work, will use domestically sourced materials and comply with BABA provisions. Contractors must identify domestic sources of BABA-covered products, provide verification documentation, and submit waiver documentation when necessary. The form warns that false statements may result in rejection or termination of the contract, and provides a link to the White House website for additional BABA requirement information.

The City of Fort Myers requires Contractors to use iron, steel, manufactured products, and construction materials that are produced in the United States in a manner that complies with the Build America, Buy America (BABA) requirement for federally funded projects that involve construction, alteration, maintenance, or repairs (Per the Infrastructure Investment and Jobs Act passed November 15, 2021). For more information about BABA requirements and authorization, visit the White House website:

As a respondent on the project listed above, I certify that I have read, understand, and will comply with the “Build America, Buy America” provisions as required by federal law. Furthermore, I understand that BABA provisions apply to any and all portions of this project, including subcontracted portions, and I certify to the best of my knowledge and belief that I will identify domestic sources of BABA-covered products, provide verification documentation for BABA compliance, and when needed provide waiver documentation per current federal guidelines.

I understand that a false statement on this certification may be grounds for rejection or termination of any award and/or contract.
